Allen West: “The resurrection of an imperial presidency”

The GOP is somewhat less-than-pleased with President Obama’s Friday announcement that he plans to take the United States’ deportation policy into his own hands and issue young illegal immigrants work permits allowing them to stay in the country legally, and several Congresspeople had some fightin’ words for the president on the House floor on Monday afternoon.

Rep. Ted Poe (R-Texas) quoted the president from a year ago, when he said the administration can’t ignore laws on the books — advice that Poe said Obama ignored last week. …

“He doesn’t like the constitutional process for lawmaking because it just gets in his way, so he acts like an emperor instead of a president,” Poe added. “It’s time for the former constitutional professor to read the Constitution.”

Rep. Mo Brooks (R-Ala.) said he is “deeply alarmed that America’s president so blatantly undermines the rule of law.”

“In America, we elect presidents, not caesars,” Brooks said. “The only way to change America’s immigration law is as our Constitution demands, through Congress not by imperial decree.”

Ouch — tell us how you really feel! But when it comes to calling people out for wildly presumptuous oversteps of authority and political pandering, there are few who do it better than Rep. Allen West (R-Florida). He pretty much sums it up:

“What country did we wake up in on Friday?,” West asked. “It just causes people to ask, where are we? You know, the last time we had this was with King George III, and we didn’t like it too much. And I think that you’re seeing the resurrection of an imperial presidency, and the arrogance thereof. To think that you can come out and basically tell the American people that this is what we’re going to do … and don’t question me.” …

“America is not about ruling by verbal edict or just whims; the president has been elected to enforce the laws of this country. And he doesn’t get to pick which laws he likes or dislikes. And I find it very perplexing and ironic that when he had control of the House and Senate, this did not seem like a very important issue.”

I know a number of people who went through all the steps necessary to become legal permanent residents. It is time-consuming (minimum of 2 years for Chinese) and expensive.

I think they should demand refunds for the total amount they spent, plus damages for having to wait so long.

The more I think about this, the more I think it isn’t an election-year pander. It is the last act of a President who knows he is going to lose, and thus will not be able to achieve his second-term goal of a full amnesty for everyone. A million new voters isn’t as good as 10 million, but it’s better than nothing.

Rep. Allen West has identified the goals that need to be accomplished in November 2012.

1) Vote our imperial President out of office.

2) Vote the 78-81 members of the Congressional Progressive Caucus out of office.

In a video clip of the event posted Wednesday, West was responding a question from a constituent asking “What percentage of the American legislature do you think are card-carrying Marxists?”

“That’s a fair question. I believe there’s about 78 to 81 members of the Democratic Party that are members of the Communist Party,” West says in the video.

He went on to say, “It’s called the Congressional Progressive Caucus,” according to a spokesman, Tim Edson.

As a person who is familiar with the immigration process, you know that there is a world of difference between having a green card, and not being deported if you’re arrested.

“DHS Secretary Janet Napolitano today announced that effective immediately, people who were brought to the United States before the age of 16 and meet certain criteria will be considered for relief from removal from the country or from entering into removal proceedings. Those eligible will receive deferred action for a period of two years, subject to renewal, and will be eligible to apply for work authorization.”

“eligible to apply” means that they’ll get them – probably age will be the only eligibility requirement. Same as just issuing them all work permits.

In order to join the US Military, you must either be a US citizen, or you must be a legal permanent immigrant, physically living in the United States, with a green card. The US military cannot and will not assist with the immigration process. If you are not a US citizen, you must legally and permanently immigrate to the United States first, via the regular immigration procedures and quotas, establish a residence, and then (if you meet the other qualifying criteria), visit a military recruiter’s office and apply for enlistment.

The left is now claiming that this isn’t going to have an impact on the job market because most of the illegals who qualify are already working in the United States, so they won’t be stealing jobs from legal citizens and residents.

One of the criteria for staying here and not being prosecuted is having a “clean criminal record”. Let’s ignore the illegal’s with no criminal record paradox for a second and focus on the work aspect.

If someone is already working here as an illegal, is that not violation of another law…now what if they had used a fake SS or ID to gain this employment and not pay taxes, more laws broken?

The only squirm left in the argument is that I am not educated in the law enough to know if identity theft and working illegally qualify as “criminal” or just “civil” offenses. Can someone help out here?

This is a slippery slope my frineds. Using prosecutorial discretion in groups sets a scary precedent. This means that the DoJ or DHS could just write a memo to stop prosecuting drug posession, fraudulent voting, and practically any other federal statue. Am I wrong on being so concerned?

President Romney needs to rescind this crap on Day 1. At least then we will have a nice list of those who are here illegally and in need of prosecution.

What do you think a work permit is? A work permit and a permanent residency (green) card are very different.

I do think that people are confusing work permits and green cards.

If you went to another country, you would need a visa, you would have to state your reason for applying for the visa “work” “tourist” “student” etc….

The only purpose for a Green Card is to work in the United States.

Your analogy is inapt, implying disparate ends but similar means where in reality we have (marginally) disparate means with similar ends. If you can’t get a hall-pass from the teacher because it’s against school policy, leaving and wandering the halls anyway without one is then purely your whim.

Identity theft is a federal crime. The Identity Theft and Assumption Deterrence Act of 1998 made it a federal crime for anyone who “knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of the Federal law, or that constitutes a felony under any applicable State or local law.”

The problem is, Obama’s new policy will give immunity from deportation and a work permit to foreigners who are living and working here illegally, so long as they have not been convicted of a crime. A lot of illegals in the U.S. are routinely committing crimes like identity theft, tax evasion, etc., but they have never been charged with or convicted of those crimes, so for purposes of Obama’s amnesty, they will be considered “law abiding” illegals because they have no criminal record.
