The Blaze: “Hustler” smears S.E. Cupp; Update: Planned Parenthood, Sandra Fluke denounce

Follow the link to see what I mean. Pure degradation, and not the first time an “adult magazine” has taken special aim at conservative women. Playboy did it too with their “hate f***” piece in 2009, but that got pulled after the outcry threatened the mag’s reputation for being kinda sorta respectable. How do you shame “Hustler,” though?

Better question: Can she sue? My gut reaction was no, partly because “Hustler” has famously been down this constitutional road before and came out a big winner. But note the fine print in that decision:

This case presents us with a novel question involving First Amendment limitations upon a State’s authority to protect its citizens from the intentional infliction of emotional distress. We must decide whether a public figure may recover damages for emotional harm caused by the publication of an ad parody offensive to him, and doubtless gross and repugnant in the eyes of most. Respondent would have us find that a State’s interest in protecting public figures from emotional distress is sufficient to deny First Amendment protection to speech that is patently offensive and is intended to inflict emotional injury, even when that speech could not reasonably have been interpreted as stating actual facts about the public figure involved. This we decline to do…

We conclude that public figures and public officials may not recover for the tort of intentional infliction of emotional distress by reason of publications such as the one here at issue without showing in addition that the publication contains a false statement of fact which was made with “actual malice,” i. e., with knowledge that the statement was false or with reckless disregard as to whether or not it was true.

The image in the Falwell case was a caricature; no one could have mistaken it for reality. A photoshop is different. The question for the court would be whether the disclaimer that “Hustler” posted alongside the image of Cupp is enough to make clear that it’s a parody or whether, in the age of the Internet and Google Images, the image has to be considered in isolation. (In that case, would they be off the hook if they simply slapped a “Satire” label in the corner of the image itself? Probably.) A separate question is what claim(s) Cupp would assert and whether the legal standards for each would be materially different. Remember, the Falwell case wasn’t a defamation claim, it was a claim of intentional infliction of emotional distress, although the legal touchstone that a public figure needs to show “actual malice” is the same in both. Could Cupp show that “Hustler” had reckless disregard for the truth here notwithstanding the big disclaimer next to the photoshop? It’d be a heavy lift, but we might get to find out.

It seems that feminism has devolved into an institution that has picked losers and winners and has decided that some women qualify for respect and other women do not.”

Why did Falwell lose? Because the article was obvious parody, ala National Lampoon, but of a form Hustler writes.

It’s about context. Without it, it’s libel, slander or defamation.

Falwell had context.

There is no context behind the picture other than hatred for her, since she’s become a regular on MSNBC.

Is it ok to admit I laughed and laughed at Rush’s Fluke satire? I really thought that was hilarious stuff, those audio tapes of her giving testimony were ripe for satire. How does somebody like Rush not talk about that in the way he talked about it? I think Cupp and a lot of other conservatives are too eager to concede Rush was “over the line” on his Fluke comments but there was nothing wrong with his comments. Lot of Republican pundits kind of get off on lecturing Rush and I think too eager to accept liberal criticism that isn’t based on on reality. If you are going to tell the world you spend 3000 dollars in the 3 years on sex, you can’t complain when Rush or anybody pokes fun of you. You set the table for it.

The image might get split off, but not by Hustler. Whoever subsequently splits it off might be an easier target. But in that case, it would seem Hustler would have no more liability than the photographer who took the original picture which Hustler altered.

I don’t she’s all that upset that she’s on the cover of Hustler, it’s kind of a compliment and I think she knows that. Since that can be easily lost, I would think that if they have an obligation with that photo, that it would be to have “Satire” all over the image the way news sources do when they want to make sure they get credit.

Considering this is the digital age, I would think they have some obligation to safeguard the photo lest it ruin her reputation even years later when the controversy has died down.

The “actual malice” standard encompasses, but is not limited to, reckless disregard for the truth. A known falsehood meets that standard, obviously, as does the obvious malicious intent in publishing a picture of a woman degraded as S.E. Cupp is pictured.

Furthermore, the Hustler case had sexual overtones, but was ultimately obviously a parody, since it wasn’t literally about sex; it was about drinking. That made it satire or a parody; this goes far beyond that and is about nothing more nor less than degrading Miss Cupp.

“The digital age” is not a legal description. There is no mention of the word digital in the US Constitution. What you are suggesting is Constitutional heresy.

We cannot and should NEVER abridge our rights to appease our egos. S.E. Cupp is a capable, outspoken, well-spoken media-personality. She’s popular now but just like the rest of us will not be around one day. When that day comes, I hope that America’s future citizens have all their rights intact, regardless of how many times their words make me turn-over in my grave.

Say what you want about Sandra Fluke but her instant response to the Hustler photo gave me a bit of respect for her. She must know she wont win any points defending a conservative but she did it anyway, and showed some consistency in an era when that is very rare on the left.

As for Ms. Cupp. My super mega fanboy crush on her makes me want to defend her in any way i can, up to and including standing in front of her with my sword and shield as i take on all on comers in her honor.

Well I didn’t remove the comment if it was removed. I think it’s a funny joke personally, it has nothing to do with S.E. Cupp as a person, I’m saying the name seems like a porn star name. Part of that is she’s abbreviated for some reason, according to one person to be gender neutral or non-specific or whatever, which is kind of funny to me as well. I don’t know you hide the fact you are a female. Anybody who knows who S.E.Cupp is knows she is a female so why not go with your first name there.

Well I don’t buy books by conservative writers b/c I generally already know what they will talk about or I don’t really want to get down into the weeds on whatever their topic is. I’m against illegal immigration so there’s really no need for me to read Michelle Malkin’s Invasion, for example, b/c it’s already confirming things I aleady know from a big picture standpoint and I don’t really need all the details. :)

I really care about animals, and any story where they’re abused and so on infuriates me – not only did he rape that poor bird, but left it injured, killed it then dismissed the whole thing by saying ‘so what it’s just a chicken.’

He should be flogged for all that.

The article also says,

One of his daughters says he molested her. Another of his daughters reportedly says he asked her to marry him.

He is beyond reprobate and vile.

I skimmed over a lot of the rest of it, and it’s filled with other disturbing things.

Again, I know the names of other conservative pundits books, like Goldberg, Levin, etc. Doesn’t mean I’ve read them though. I didn’t know S.E. Cupp wrote books. Abortion only became illegal in the US in the late 1800′s. If Adams, Jefferson, Madison and Washington had anything against abortion they sure as hell kept it to themselves.

They probably didn’t anticipate the Catholic Church getting its hooks in the country’s society and legal system the way it has and therefore could never have imagined an organized movement to ban something that was seen as perfectly acceptable.
