GOP leadership piling the pressure onto AG Holder over Fast & Furious

Democrats are hoppin’ mad about Congressional Republicans’ calls to hold Attorney General in contempt of Congress — even though he’s consistently failed to comply with the House Oversight Committee’s requests for information concerning the not-botched gunwalking operation known as Fast and Furious, including a Congressional subpoena. “Unprecedented,” “witch hunt,” “unwarranted,” and etcetera are some of their favorite terms for categorizing those darned Republicans’ attempts to actually get to the bottom of the deadly operation.

At first, Speaker Boehner seemed cagey about actually forging ahead with holding Eric Holder in contempt — and perhaps he still is, because he’s finally decided to throw more of his weight behind getting Holder to pony up with the withheld documents, before Congress has to take it to the contempt-level. Earlier this week, Boehner personally asked Obama to pressure Holder to quit stonewalling, and today sent Holder a letter co-signed by Majority Leader Eric Cantor, Majority Whip Kevin McCarthy, and Chairman Issa. And they did not mince words:

Dear Attorney General Holder:

We write to express our concerns with the lack of full cooperation from the Department of Justice (“the Department”) with the ongoing Congressional investigation into the operation known as “Fast & Furious” and the related death of Border Agent Brian Terry.  While we recognize that the Department has provided some documents in response to some aspects of the October 11, 2011, subpoena from the Chairman of the Oversight & Government Reform Committee (“the Committee”), two key questions remain unanswered: first, who on your leadership team was informed of the reckless tactics used in Fast & Furious prior to Agent Terry’s murder; and, second, did your leadership team mislead or misinform Congress in response to a Congressional subpoena?

We are troubled by the Department’s assertions that the Executive Branch possesses the ability to determine whether inquiries from the Legislative Branch have been fully complied with.  As the Supreme Court has noted, each co-equal branch of our Government is supreme in their assigned area of Constitutional duties.   Thus, the question of whether the Executive Branch has sufficiently complied with a Congressional subpoena requesting specific information pursuant to Congress’ Article I responsibilities is one only the Legislative Branch can answer.

One fact appears to be undisputed by all concerned: Fast & Furious was a fundamentally flawed operation.  It was taken to an extreme that resulted in at least one death of a U.S. Border Patrol agent and unknown other consequences, because U.S. law enforcement agencies allowed thousands of firearms to be illegally “walked” into Mexico and into the hands of drug cartels.  Beyond the horrific impact on the Terry family, there is no doubt that this operation has done serious harm to one of the United States’ most important bilateral relationships.  It is our hope that, in finding the truth, we can both provide closure to the Terry family, begin to repair our relationship with Mexico, and take steps to make necessary changes at the Department. …

Politico reports that the letter scales back somewhat on the broad range of requested information, and that its intent was more to establish the Republican leadership’s support of the investigation more than threaten contempt charges (an act they consider too aggressive for the time being), but still — the fat’s really in the fire now.

One fact appears to be undisputed by all concerned: Fast & Furious was a fundamentally flawed operation.

It was not flawed in the sense that it was meant to lead to civilian disarmament.

They’ve already used the pretext of this scandal to Fast and Furiously try to implement gun registration of certain types of guns in four states.

With that registration requirement to be expanded to all 57 states and all types of guns in short order.

Follow this up with feral control of the sales of guns [Closing the nonexistent “Gun- show loophole”] and you’ve got the beginnings of your needing the government’s permission to defend yourself.

Permission that can soon be withdrawn with the onset of an appropriate “Serous crisis” – along with all of your guns.

The more I watch the back peddling by the conservatives and republicans, the more I feel that Bohner is the problem, not part of a solution. Through out the postings all over HA, I see the disillusionment and mistrust of the republican leadership. That even includes my own senator Coburn. Time for games and protection our congressional and senatoial collegues to end! Either be strong, and do the jub we sent you to Washington to do or get out. If I’m willing to get rid of my weakling senator Coburn, then the rest of you should be willing to get rid of Bohner, McConnell, etc.

Since I live in his district and have hounded his office over the years I get unsolicited e-mails from my rep Al Green D9-Tx. Today I received two different ones letting me know he is working for me on the Houston cop on trial for beating a burglar as he tried to get away. Yes, he has formally requested the DOJ make a determination on whether any civil rights were violated.

So I called his Houston office to ask if they’d forward Mr. Green’s request for DOJ inquiry into Operation Fast and Furious. The guy that answered the phone had no idea what I was talking about.

Thanks for the “not-botched” at least, Erika. When I hear talking heads spouting off about the “botched” gun running scheme I just want to smack them.

But I fail to see how this letter amounts to a significant increase in the pressure being put on Holder. It should be abundantly clear to everyone by now that Holder will never produce the documents and evidence subpoenaed unless he is faced with the prospect of immediate jailing for contempt. (From this we may infer that their disclosure would mean the end of his tenure, so that he has nothing to lose by stonewalling until he is staring down a jail cell.)

At this point, only the actual filing of a citation for contempt will significantly raise the pressure on the most corrupt and incompetent political hack ever to be confirmed as Attorney General.

The thing that everyone is ignoring is when someone is cited with contempt of congress; the enforcement agency is the Justice department. As much as we would like to see Holder frog marched to prison, Holder isn’t going to arrest himself.
Boehner and Issa know that if Obama and Holder ignore a contempt charge they could end up looking weaker than they do now.
Let’s just hope they have a plan to make political capital out of it before November. Obama will pardon Holder, but if the Romney administration lets Mexico know we would gladly extradite Obama and Holder to stand trial for the deaths of 300 plus Mexicans, True justice might prevail.

I’ll believe it when I see it. The Republican leadership doesn’t have the backbone to do anything like holding Holder in contempt. Remember how fast Pelosi made Bush get rid of a Attorney General to bad Boehner Doesn’t have that kind of guts.

Spineless and ball-less. This isn’t pressure. Boehner has to go. The time to pursue this crime was before Holder had time to shred the evidence.

The only upside is he can never scrub it all. The net is forever. But they all appear to want to drag this out as long as possible and let it die quietly. For political reasons.

The political aristocracy in the United States declares themselves above the law. They allow themselves license to surveille us, detain us, seize our assets according to their warped definition of “fair” and cause our deaths with impunity.

Meanwhile they party on. I seem to remember a rather famous document signed on July 4 that kinda objected to that sort of thing.

We are no longer a nation of laws if they do not apply to all citizens in equal measure. If one of us sold guns to another person who used those guns to commit an atrocity or murder, you can be certain the full weight of the legal system would apply to us.

Just sayin….

Quite frankly, I will be really, really surprised if Boehner does anything even remotely like criminal action, or even mild reprimand. Johnnie and the House leadership seem to be especially frightened of Eric.
