Facebook co-founder Eduardo Saverin may not be allowed to return to the United States after he renounced his citizenship to save millions in tax

The timing of the move has raised eyebrows since Singapore does not have a capital gains tax, which could vastly reduce his bill on any [IPO] payout…

Despite leaving the U.S. behind, he will not avoid all taxes in the country.

He owes what is effectively an exit tax on capital gains from stock holdings, even if he doesn’t sell the shares, Reuven S. Avi-Yonah, from the University of Michigan’s law school, told Bloomberg.

This will be a brief note, because the likes of Eduardo Saverin merit only the tiniest slice of our attention. I will merely note that for some people, their citizenship is worth everything they have to give. For others, such as Saverin, it’s apparently worth a few million dollars. He fled to this country to save his life; now he’s fleeing from it to save his bank account?

The Schumer bill strikes me as a gimmicky waste of time, one that ironically enough treats citizenship in Saverin-style economic terms when it means much more. Mr. Saverin, you are certainly free to leave. I would merely ask that you never come back. Your very presence dishonors the memory of the men who died to create the refuge you so desperately needed when your family fled here almost two decades ago.

Whatever Mr. Saverin’s motivation, the more important point is that it is his decision, however misguided. America was built on millions of similar individual decisions to come to our shores. It is precisely that ability to decide for oneself that has made America such a magnet for two centuries.

The way to continue to be a magnet for the best and brightest is not to impose Soviet-style exit taxes to punish people who want to leave the country. That is what oppressive and demagogic regimes do, and it’s humiliating to see U.S. Senators posture in such fashion. The way to punish Mr. Saverin is to make the U.S. so appealing and dynamic again that he’ll be sorry he ever left.

It is the foolish and counter-productive tax policies of the left that are chasing Eduardo Saverin to another country, just as they are chasing companies away in increasing numbers. It is even more foolish to punish those people for leaving — what we should do is stop punishing them with high taxes so that they stay. We need to compete against the likes of Singapore. Singapore doesn’t make enemies of its most dynamic entrepreneurs and instead adopts pro-growth policies rationally aimed at improving everyone’s living standards. Naturally, when other countries adopt rational tax regimes, those countries with irrational ones (likes us) are put at a terrible disadvantage, but it’s our own fault. In particular it’s the fault of those who now propose the “Eduardo Law.”

As for Saverin being “ungrateful” in renouncing his citizenship, he might say the same of the U.S. government. After all, isn’t the U.S. being ungrateful to him by punishing his entrepreneurship?

The “Eduardo Law” is a terrible idea, and conservatives should fight it and everything like it tooth-and-nail. This is no time for cheap indignation targeted at individuals that are only doing what U.S. law impels them to do.

If high taxation chases successful people out of the country, that’s the country’s fault. Daniel Mitchell at the Cato Institute likens this to a “fiscal version of blaming the victim.” Obviously, attaching the word “victim” to a billionaire in an age of class warfare is not going to do much to bolster Saverin’s case. But human beings will act in their self interest. WE can’t stop it. Surely, with every person, there are a host of reasons for making these kinds of decisions – who knows, maybe Saverin hates eating American cuisine or the weather – but once the tax code pushes people away rather than entice them to come, something is wrong…

But even more irksome is the implicit message by some of those complaining about Saverin’s departure. Paying taxes is no measure of how grateful you are. Government should have no claim to a person’s wealth. We’re not letting him “keep” anything that isn’t his to begin with even if we don’t like what’s done.

There is a myth –often perpetuated by Democrats , and most (in)famously by Elizabeth Warren – that private sector success is predicated on a robust government. The reverse is true.

“I’m not a tax expert,” [Saverin] said. “We complied with all the known laws. There was an exit tax.” That tax is based on the assets held by a citizen leaving America. The exit tax was intended to make sure the departing wealthy paid something before they decamped.

He professes ignorance about his taxes and refuses to discuss his finances. “This had nothing to do with taxes,” he insisted. “I was born in Brazil, I was an American citizen for about 10 years. I thought of myself as a global citizen.”

At a news conference this morning, Sens. Schumer and Bob Casey, D-Pa., will unveil the “Ex-PATRIOT” – “Expatriation Prevention by Abolishing Tax-Related Incentives for Offshore Tenancy” – Act to respond directly to Saverin’s move, which they dub a “scheme” that would “help him duck up to $67 million in taxes.”

The senators will call Saverin’s move an “outrage” and will outline their plan to re-impose taxes on expatriates like Saverin even after they flee the United States and take up residence in a foreign country. Their proposal would also impose a mandatory 30 percent tax on the capital gains of anybody who renounces their U.S. citizenship.

The plan would bar individuals like Saverin from ever reentering the United States again.

Eduardo Saverin, co-founder of Facebook, could have saved at least $67 million by renouncing his U.S. citizenship and moving to Singapore, where the capital gains tax is 0%.

According to CNN’s Dana Bash, Saverin might pay those taxes after all. “He intends to pay all taxes he owes on us investments, despite renouncing us citizenship,” she tweeted.

Earlier today, senators Chuck Schumer and Bob Casey announced legislation that would impose a 30% capital gains tax on expats who leave the country for lower tax rates on investments. The senators mentioned Saverin by name in their press conference.

Looks like it worked! America wins!

I voted for Casey because Santorum’s stance on gays and abortion is so insane. But if I had known that Casey would sponsor Communist anti-Saverin legislation, I would have voted for Santorum. There is a point where Democratic economic insanity trumps social conservative insanity. I find that point to be here.

…I have two girls!…I give the boys a questionnaire that has boxes to check off…it’s two pages long! Questions like…have they ever had broken limbs… what area of the body would they LEAST like to be shot…phone numbers of every family member, priest, minister, rabbi…are they suppossed to be buried or cremated, do they have a family plot?…health care up-to-date?…do they know what “NO” means?…what a curfew is?…you know – just general questions!…When they fill it out…I know they’re ok!

Would that be cool or do you think all Americans should only have dual citizenship? Or do you think it should be reserved for a privileged few?

Jews don’t need to have dual citizenship anymore than an Italian needs dual citizenship.

Americans are free. Free to renounce their citizenship, if they so desire. And if they do so to legally avoid paying taxes, that is their right. It is the job of America to be attractive. TO be a place that people clamor to get into – legally – not a dumping ground for illegals to flood the nation and receive special treatment by the same scum who then deign to dictate that Americans are not free to choose to leave.

Schumer is the lowest form of existence there is and the rest of the dems and the Dog-Eating Retard are right there in the slime with him. They are dangerous. Walling Americans in. Threatening anyone who makes money that they can leave America, but only with one suitcase of assets and the rest is forfeit to a government that stomps on the rights of citizens to pander to the illegals and their unlawful presence and drain on OUR money.

These people are little Stalins in their own pea-brains. They think everything they see is theirs for the taking – and they will – certainly as they are spending so much money that they never have enough and see everyone else as always having too much.

Chuck Schumer should leave. He can take all his sh#t with him. Just go to a country that loves totalitarians. This nation was not built for such enemies of liberty and freedom.

I’m not concerned about Americans collecting citizenship. The number really doesn’t matter.

I have no real opinion one way or the other on dual citizenship, but the question is, what does citizenship entail? Some people might want to view it as a statement that, when push comes to shove, you pledge to support one country, rather than the other. I think it’s a little silly to think that kind of thing can or should be formalized, though I suppose in the event of a war, it is useful to have a legal obligation for people to not support a hostile power.

As for “Herr Doctor”, he might be antisemitic, but it strikes me as much more likely that he suffers from that strange, seemingly paradoxical mix of cynicism and naivete that is found in people on ideological fringes. Cynical enough to “accidentally” publish almost comically racist and hateful trash with his signature on it, and naive enough to think that either people wouldn’t notice, or that they wouldn’t care when they found out.

Regardless of anything else, the fact is that immigrants are forced to renounce and give up any and all citizenships in order to become naturalized Americans. That is the law. Just because we stopped following it doesn’t mean that it is not the law of the land.

This has nothing to do with Americans renouncing their citizenship, but it would be nice if America did return to a Rule of Law some day.

INA: ACT 337 – OATH OF RENUNCIATION AND ALLEGIANCE

Sec. 337. [8 U.S.C. 1448]

(a) A person who has applied for naturalization shall, in order to be and before being admitted to citizenship, take in a public ceremony before the Attorney General or a court with jurisdiction under section 310(b) an oath

(1) to support the Constitution of the United States;

(2) to renounce and abjure absolutely and entirely all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty of whom or which the applicant was before a subject or citizen;

etc.

And for those who don’t read the law, they say this part in the beginning of their oath of citizenship.

That said, once an American, we are free to leave if we choose, for whatever reason and the government has no right to put some asinine and SOviet-style exit tax on us to suck out any wealth we might have that makes the commies’ mouths water. That is as un-American as it gets.

So, legally, Saverin was never really an American citizen because he didn’t renounce his Brazilian citizenship when he took on American citizenship, thereby rendering his oath invalid, which means that he didn’t have to renounce anything on his way out.

But … we don’t have a Rule of Law, so this is just a hypothetical for a nation that does. We have a Rule of Empathy (by deranged personalities) and Envy. It ain’t pretty.

There is no greed like a politician’s greed!

Our “public servants” squander money by the tens of $Billions and it’s no big deal, a rounding error. This guy wants to keep a comparatively paltry $57 million that he earned with his vision, passion and hard work and suddenly the politicians are aghast at losing this HUGE sum of money that wouldn’t pay for their wasteful spending for a single second of any day of the year.

I did get a good laugh when this guy says that he considers himself a citizen of the world. The left loves the whole “citizen of the world” crap until it’s used against them.

This is such a cop-out. If we have to put up with these absurd acronyms, then the rule should be that you use the first letter from every word in the name, no more, no less, no exceptions.

They’re close, but it’s still the EPBATRIFOT act.

Maybe we can take this to the supreme court and have laws with incorrect acronyms ruled unconstitutional.

Lots O Folks are Getting out while the get’n is good. The collapse of a giant can be really ugly….. History is replete with lots O examples… Look around, the illusion of freedom is become’n quite apparent to people with eyes. I know, I did okay the last few years and I have the IRS up my anal track. Better to make less and not feel punished. Gets to the point where I say..whats the point?
