FBI investigating possible hate-crime charges in Zimmerman/Martin case?

This really isn’t news, and it’s almost certainly not being reported accurately, but it’s worth reviewing nonetheless:

WFTV has learned charges against George Zimmerman could be getting more serious.

State prosecutors said Zimmerman, a neighborhood watchman, profiled and stalked 17-year-old Trayvon Martin before killing him, so the FBI is now looking into charging him with a hate crime.

The WFTV headline is less ambiguous, and more incorrect:’ “FBI may charge George Zimmerman with hate crime.”  The FBI doesn’t charge people with crimes; they investigate crimes on behalf of the Department of Justice (as well as conduct intelligence operations, but that’s not germane to this issue anyway).  The US Attorney for the region would have to charge Zimmerman with a hate crime, and that would likely be Robert O’Neill, US Attorney for the Middle District of Florida.

The fact that the FBI is conducting an investigation into possible hate-crime charges isn’t news.  The Department of Justice announced weeks ago that they would investigate the case for a potential hate crime; the FBI is the appropriate agency for the investigation.  Their presence doesn’t indicate that charges will be filed or are likely to be filed.  It just means that they’re conducting an investigation and will report any evidence to the US Attorney.

As the video report notes, it will be difficult to present charges of a hate crime in this case.  First, as a neighborhood watch volunteer, it’s going to be difficult to argue that Zimmerman deliberately and maliciously “stalked” Martin while calling the police about him.  Second, as the legal analyst notes, hate crimes are based on states of mind — and Zimmerman’s own heritage and history would make it extremely difficult to argue that the defendant acted out of a hateful malice based on Martin’s ethnicity.  That doesn’t mean the US Attorney night not try to make the case, but given the incendiary and controversial nature of the case, most prosecutors wouldn’t roll the dice on those kinds of odds.

Of course, the investigation might well turn up enough evidence to warrant those charges.  We’ll know soon enough without baseless speculation at this point.

I’ve examined the document that led to Zimmerman’s arrest, and there was no new information in it, and lots of legal experts, including Alan Dershowitz, thought it was a joke. Since I’m not going to be on Zimmerman’s jury, I can look at all the facts that I have and determine that there is no reason to doubt the initial investigation’s conclusion that he killed Trayvon in fear of his own life. That has nothing to do with wishing he gets off because of “politics,” as you’ve asserted that we all believe.

You make sweeping generalizations about other people and then you have the gall to complain when other people make sweeping generalizations about you. You’re a hypocrite, and you are no more objective than anyone else. Your mostly clueless comments establish that beyond a reasonable doubt.

That’s the reason there are degrees of murder and manslaughter charges with varying penalties-because the circumstances are different, the punishments need to be different to fit the crime.

I remember the case just a couple of years ago, I think it was in Louisiana. A woman was raped in her own home by a home invader with a long criminal record. He was caught and arrested. When he made bond, the woman borrowed a shotgun from a neighbor.

That night she shot and killed the guy breaking into her home again. No doubt he planned to rape her again, and then silence her. Permanently.

But this jackass wishes death on her for defending herself, and in the process protecting who knows how many future victims.

Just one excerpt apropos “profiling”…

“Let’s talk about the elephant in the room. I’m black, OK?” the woman said, declining to be identified because she anticipated backlash due to her race. She leaned in to look a reporter directly in the eyes. “There were black boys robbing houses in this neighborhood,” she said. “That’s why George was suspicious of Trayvon Martin.”

There’s much more. Reuters has no reason to lie about this or to try to spin it.

I guess it may depend on whether blacks who live in the neighborhood decide they want to crucify the “white hispanic”, or if they are pressured into doing so.

This whole trumped up charge is just shameful pandering for the black vote. Racial politics by the Justice Dept at its worse. Had Zimmerman been black, with all else the same, we wouldn’t have heard about it. But if Zimmerman can be called at least partially “white” by some stretch, then it’s tribal reactions from most blacks and all black “civil rights spokespersons” – just as in the O. J. Simpson murder case where had OJ’s wife had been black the reaction would have been very different. It’s race that matters. This is tribal America.

I think the idea is that if they can’t get the charge to stick (and they can’t), then they will have at least caused this partially “white” man to suffer.

Invesitagions in this adminstration don’t mean squat.

It’s the political advantage the they might leverage from any unfortunate situation.

I expect the DoJ to press for a hate crime charge if for no other reason than to fan the flames among the minority voters in November.
