Pelosi: We have a clear agenda to amend the First Amendment

posted at 6:41 pm on April 19, 2012 by Tina Korbe

Eh, at least Nancy Pelosi isn’t trying to hide it that she wants to alter the First Amendment, that cherished declaration of the right to free speech:

“We have a clear agenda in this regard: [DISCLOSE], reform the system reducing the [role] of money in campaigns, and amend the Constitution to rid it of this ability for special interests to use secret, unlimited, huge amounts of money flowing to campaigns,” Pelosi said at her Thursday press briefing.

“I think one of the presenters [at a Democratic forum on amending the Constitution] yesterday said that the Supreme Court had unleashed a predator that was oozing slime into the political system, and that, indeed, is not an exaggeration,” said Pelosi. “Our Founders had an idea. It was called democracy. It said elections are determined by the people, the voice and the vote of the people, not by the bankrolls of the privileged few. This Supreme Court decision flies in the face of our Founders’ vision and we want to reverse it.”

The Supreme Court “decision” to which she refers is the SCOTUS majority opinion in Citizens United.

It ought to go without saying, but amending the First Amendment to allow Congress to regulate corporate political speech would significantly abridge the freedom of the press. Why? As CNSNews.com’s Terence Jeffrey writes, “Television networks, newspapers, publishing houses, movie studios and think tanks, as well as political action committees, are usually organized as, or elements of, corporations.”

Oh well, say Pelosi and other Democrats behind this three-pronged effort to rid the country of the Citizens United decision once and for all. Maryland Democratic Rep. Donna Edwards perhaps summed up the liberal position on this most clearly: “I mean, in my view, a corporation is not a person. It is not an individual. The rights that it has are those that are granted by the state, granted by the, by the Congress.”

Ms. Edwards misses a crucial point: The functions of government (what you might call the “rights” of government not in the original, inalienable sense, but in the sense of being the appropriate purview of government) are those that are granted by the people, with whom all power ultimately resides. If corporations as such don’t have natural rights (and I’d agree that they don’t, but the individuals that comprise them still do, including the right to pool their money for the purpose of political speech), then Congress certainly doesn’t have any rights of its own, either, including the right to regulate corporate political speech.

Fortunately, it seems highly unlikely that the people would grant Congress that ability through the amendment process — but trust Pelosi to continue to push for it.

She doesn’t miss the point; she doesn’t agree with the point. Leftists are bent on destroying western civilization one institution at a time. I wonder if the supposed defenders of free speech, the ACLU, will chime in, or if the time has come for them to display their colors more fully.

The US political system fractured as soon as it started. It has played host to blood enemies of all stripes, people for whom their political beliefs were so strong that dealing death to their fellow citizens would not be unjustified: from Federalists and anti-Federalists to abolitionists, slavers, state’s rightists, Communists, plutocrats, anarchists, old Progressives, new progressives, survivalists, Nazis, fascists, Bolsheviks, social revolutionaries, all the way to black liberation theologists.

Up until now, no major political group – not even the Woodrow Wilson Progressives who considered it a dangerous relic and fought to undermine it – have had the gall to expressly call to formally restrict the freedoms of the First Amendment.

Even if you concede their totally fantastical concept of the corporation – that they’re something other than groups of people – this movement would still be tragic for being the first Constitutional blow against the corporation, the backbone of America for two hundred years. Corporations are the greatest invention in human history. They are responsible for everything positive in the material world that has transpired since George Washington passed away on his s–tfarm in Virginia.

Al-Ozarka on April 19, 2012 at 7:29 PM

You are all looking at this wrong. Yes, Pelosi is crazy as a sh*t house rat. Yes, the ideas she speaks of in this are insane. But she is correct in that the right way to do what she wants to do is the amend the Constitution. In that we should all be cheering her for this statement.

I don’t think she has a snowballs chance in hell of getting this amendment through the entire amendment process, but I like seeing her side take that approach rather than their normal one of bypassing the constitution altogether.

MikeA on April 19, 2012 at 7:30 PM

Donna Edwards perhaps summed up the liberal position on this most clearly: “I mean, in my view, a corporation is not a person. It is not an individual. The rights that it has are those that are granted by the state, granted by the, by the Congress.”

The problem with the liberal position, of course, is that corporations are made up of persons. So how can the persons in a corporation lose their right to free speech just because there are more persons in a corporation? If one person has a right to free speech, do 5 persons in a corporation lose that right? If a corporation of 5 persons has that right, then does a corporation of 5,000 persons lose it?

But liberals don’t feel the need to think things through to a logical conclusion. All they have to do is feel.

It is perfectly legitimate to call for a change in the US Constitution, as long as it is done through the amendment process and not by activist judges.

We have changed the Constitution in the past, and, in fact, the founders anticipated such a need by expressly outlining how changes could be made.

Let her convince the US House, US Senate and 2/3 (or is it 3/4?)of State Legislatures to restrict free speech. I wonder how that campaign will go over with the general public…..

Why don’t they just be honest for once and change the name from the Democrat Party to the Fascist Party?

Has anyone noticed that for about the last 5-10 years the Democrats have slowly slipped into the American lexicon the phrase “Democratic Party”? It’s slimy subliminal advertising on the part of the Democrats and their MSM fifth columnist Quislings to brainwash the American people that the Democrat Party members are democratic, i.e. the Democrats practice little-D democracy and that the Republican Party members don’t.

“I’m a Republican and a member of the Republican Party.” – it passes the smell test. But if we get down to the nuts & bolts of the Democrats’ scheme, then a Democrat should say “I’m a member of the Democratic Party and I’m a Democratic.” So henceforth if you hear anyone say in conversation “Democratic Party”, straighten their a$$es out and expose them for the duplicitous dullards that they are.

These maroons don’t understand that the legal fictive “personhood” of a corporation is foundational to the workings of the modern American economic system. Without corporate personhood there would be NO stock market as investors would be radically disincentivized to buy an ownership share because they would then take on the entire liability of the company. Corporate personhood allows these groups to purchase property, engage contracts, and do countless other things that would otherwise require the agreement of tens of thousands of owners. They are idiots and fascists, but I repeat myself

Our Founders knew that pure Democracies ALWAYS fail. There is a role for Democracy within our government, but it is limited and counter-balanced… it’s called the House of Representatives. Every member of the House MUST be elected democratically by the people (vacancies are NEVER filled by appointment). In the House, the majority rules and the minority has little to no power. But the House is counter-balanced by the Senate, and the two together are only one of the three co-equal branches in our Constitutional Republic.

minnesoter on April 19, 2012 at 10:34 PM

Pelosi clearly has a problem with national historical fact and constitutional knowledge, but then what loony socialist liberal doesn’t.

One prime example self deception is their insistence that our Constitution includes the separation of state language. Our’s doesn’t, but the old Soviet Union Constitution did. It was necessary to remove the power of the church so that the government, not the church, was in complete control of education, welfare and health of the people. We see that process in the making today with Obama’s attack on the church in such a way that either the churches accept government control over their beliefs and actions, abandon all their activities in those areas, or get fined out of existence.

The second need was to make the Constitution irrelevant which the excelled at doing which again is clearly a part of Obama’s agenda.
Pelosi shows her like of understanding of the very basic sense of our government by her statement;“Our Founders had an idea. It was called democracy.”

The founding fathers strongly rejected the creation of a “Democracy”. That is not the same as the democratic process used to vote or decide issues. A democracy is defined as a government with a strong central power of control. It should not be confused with the process that we use to vote and make decisions. Democratic derived decisions do not make a democracy.

Our founding fathers created a “Constitutional Republic”. Our Republic, the great experiment, is shared power between the states, of whom the people are citizens of, and a weaker Federal government of whom the states are represented in by representatives elected by the people of each state.

Socialism cannot function in a Republic, though it may in name only. Socialism requires a strong central government in which the states become the messenger of its dictates and enforcers of its laws. Our constitution is a barrier that it must removed, or made irrelvent, for socialism to exist.

Over the decades the socialist and communist have worked to transfer power from the states to the federal government while diminishing the power of the constitution and increasing the power of the administrative branch that will become the central power under socialism. Obama has been tasked with increasing the power of the administration and putting in place through his healthcare laws the control that will end our Republic and replace our economic model of Capitalism with Socialism.

That effectively ends our existent as we have known it and our children will never know in the true sense of what was once their inheritance.

Keep a count of how many Progs are in her caucus. They concur with this kind of twisted thinking.

You are correct that they are serious. The Left never stops with its efforts to erode our nation and its founding principles.

Scott Adams (creator of Dilbert) once said that the government can’t give you rights – it can only take them away. And will!

As I search for signs that there may be a glimmer of hope that the people of San Francisco might finally vote Nancy Pelosi out of office, I cling to the new “Top Two Open Primary” system that California will be using for all Congressional races for the first time in the June 5th California Primary election.

Due to the redistricting that was done after the 2010 Census, Nancy Pelosi will now be running to represent District 12 which may turn out to be a tad less liberal than her old District 8.

In District 12, Nancy Pelosi will be running against:

3 Other Democrats
1 Green Party Member
1 Ron Paul “Liberty” Republican

in the June 5th Primary.

http://www.sos.ca.gov/elections/2012-elections/june-primary/pdf/june-2012-candidates-abbrev-list.pdf

Since only the “Top Two” candidates who earn the most votes in the Primary will appear on the ballot for the General Election in November, regardless of political party, it is very possible that Nancy Pelosi will be running against a fellow Democrat in the November election.

Dare we dream that Pelosi might be voted out of office, if she has to run against another Democrat in the General Election?

Oops! It looks like the direct link to the PDF list of California Congressional candidates didn’t work in my post above.

Here is another link which will take you to the California Secretary of State web page where you can select the “Certified List of Candidates – Abbreviated List” link to see the PDF that I was trying to show you in my comment above.

Mental illness of epic proportions in California and illegal voting blocks are the only reason this woman continues to inflict major damage to her own state and every else’s country.

ActinUpinTexas on April 19, 2012 at 11:42 PM

So, she’s totally against unions being able to do this then? Is that what I’m hearing?

After years of unions having the ability to bankroll politicians without much competition, now that the competition is there to have just as much money for the other side, now all of a sudden it’s a bad idea.

Funny how dramatically perspective changes due to the difference between getting screwed and doing the screwing.

Ms. Pelosi, you can’t amend an Amendment. You can only repeal it. See the 21st Amendment as an example.

Go ahead, Congresswoman: Make your pledge to repeal the 1st Amendment.

Scratch a progressive, find a fascist.

(Just as true without the scratching…)

Another reason is that English is a very distant second language for a huge number of Nancy Pelosi’s constituents in the Sanctuary City of San Francisco.

That Pelosi chick is one scary broad.

This article comes on the 237th anniversary of the Shot Heard Round the World. How’s THAT for sick irony / intent?

AND the day that Big Sis / Homeland Security announces their nazi VIPR teams are now going to randomly search Houston busriders. With Shiela Jackson Lee’s strong encouragement / approval.

And ALL of the congresspersons quoted and related in these issues are ALL members of the Progressive Caucus. The communist caucus.

You fogot to add that Pelosium (symbol PU) is highly unstable. Unlike other heavy elements, PU does not fission or split into lighter elements, rather PU sucks money and energy from living tissue and continues to grow. Remarkably, PU is a realization of the film, The Magnetic Monster.

Gladtobehere on April 19, 2012 at 7:36 PM

Pelosium (PU) draws atoms from surrounding molecules and makes them dependent on the newly created molecule called Governmentium.

So braindead corrupt Pelosi understands the constitution better than SOTUS?

Man, doesn’t anybody learn Civics or History anymore? The 21st Amend. repealed Prohibition. The 18th Amendment. Can’t even ‘vacate’ the Amendments.

rayra on April 20, 2012 at 12:25 AM

I can;’t afford to buy a TV ad on my own. I’m well off, but not that rich.

However my message is popular enough to get 100 like minded people with me, and I can afford 1% of a TV ad. Make a nonprofit, pool our money, and buy the ad that the group agrees on.

Oh, sorry; now I must be silenced for the good of the people. Only by silencing those who can’t afford to pay for a TV ad themselves can we have a fair and open election… by silencing anyone who doesn’t have clout and authority.

I think I understand what you’re saying Pelosi; but I’m not sure you do… why do we need to silence the poor and middle class again?

I went over and had a quick look at your blog. Nicely done. I especially liked the set of five illustrations “Don’t Play With Medicine”, “Don’t Play With Fire”, etc. I laughed out loud when I came to the last one.

. Corporations are the greatest invention in human history. They are responsible for everything positive in the material world that has transpired since George Washington passed away on his s–tfarm in Virginia.

HitNRun on April 19, 2012 at 7:27 PM

Perhaps, in your enthusiasm, you neglected the historically true basis for success, and it wasn’t the faceless corporation, but the family that founded in love for doing good, that provided the human fuel that drove all of our successful institutions.

Sadly, the modern destruction of the family unit (that was once founded in belief in “nature’s God”)is responsible for the break down in all of our institutions.
