Friday night news dump: Administration to move forward with and expand contraception mandate

The administration this afternoon released its “Advance Notice of Proposed Rulemaking on preventive services policy.” Translation: President Barack Obama and HHS Secretary Kathleen Sebelius are moving forward with their controversial contraception mandate, which requires even religiously affiliated employers to provide their employees with insurance that covers contraception — even if those employers object to contraception on religious grounds.

But don’t worry: Secretary Sebelius says your religious liberty is assured, so it is assured.

“The President’s policy respects religious liberty and makes free preventive services available to women,” she said. “Today’s announcement is the next step toward fulfilling that commitment.”

Never mind that, by drawing a distinction between actual churches and church-operated businesses like hospitals and schools, the administration effectively appropriated for itself the power to determine what constitutes ministry. Also, last I checked, there was no such thing as “free preventive services.”

Sandra Fluke should be happy, though. The administration made a final decision about whether it will require colleges to provide  students with insurance that covers contraception, as well. Take one wild guess as to what their decision was. Yep, that’s right:

Administration officials also released a final rule governing student health plans.  Under the final rule, students will gain the same consumer protections other people with individual market insurance have, like a prohibition on lifetime limits and coverage of preventive services without cost sharing.  In the same way that religious colleges and universities will not have to pay, arrange or refer for contraceptive coverage for their employees, they will not have to do so for their students who will get such coverage directly and separately from their insurer.

Note that the administration still pretends the mandate isn’t a mandate on religious employers if the insurers have to provide contraception coverage “directly and separately” to employees and students. Actually, it’s still a conscience-violating mandate, as Ed explained when the administration first announced its “accommodation”:

So these employers will still have to provide the health insurance, and the health insurance must cover the contraception and abortifacients.  The White House apparently wants to pretend that the funds for these outlays will come off of the Unobtanium Tree, where insurers find money to cover all mandates.  This exposes once again a stunning ignorance of risk pools and how costs are passed along to consumers.

Let’s just take this one step at a time.  Where do insurers get money to pay claims?  They collect premiums and co-pays from the insured group or risk pool.  No matter what the Obama administration wants to say now, the money that will cover those contraception costs will come from the religious organizations that must now by law buy that insurance and pay those premiums.  Their religious doctrines have long-standing prohibitions against participating in contraception and abortion, and nothing in this “accommodation” changes the fact that the government is now forcing them to both fund and facilitate access to products and services that offend their practice of religion.

Basically, the Obama administration told religious organizations to stop complaining and get in line.  This “accommodation” only attempts to accommodate Obama’s political standing and nothing more.

Consider also that many religious employers are self-insured and have no insurer onto whom they can push the cost of contraception insurance.

The timing of this announcement just couldn’t have been better. As The Washington Examiner’s Joel Gehrke put it, “The announcement came late Friday afternoon, on the eve of St. Patrick’s Day, as the second day of March Madness basketball games were under way.” People skip work to watch March Madness. Think they’re going to turn off the TV to dig up a dry statement from Her Consistency Kathleen Sebelius? Not likely.

This should NOT be an issue for Catholics or for religious institutions. What about the secular businessman who for religious or moral reasons opposes abortion and/or contraception? (And make no mistake: this has NOTHING to do with the “free” contraception and everything to do with setting up an infrastructure to force all “health” plans to provide free abortion coverage).

We have to get these fiends out of office. If you don’t like whoever we finally nominate, try a hanky to dry your tears, suck it up and pull the dang lever.

I think that if it had only been the contraceptive issue, the Catholics would have caved; there is enough dissension among the laity and enough liberal clerics that they would have defied Rome. That would also have separated out the other denominations that don’t view contraception as inherently sinful. They would have expressed moral support for the Catholics and decried the encroachment on freedom of religion, but it wouldn’t have impacted their own positions. However, placing the abortificent issue on the table is most likely a bridge too far. While many practicing Catholics may practice contraception, abortion is still viewed as murder by all but the most liberal. Also, all other mainstream Christian churches share that same view, again with the exception of the most liberal factions of various denominations. This is a unifying factor and will most certainly lead to a united front against this encroachment on religious liberty.

I honestly don’t think that the Catholic Church will stand up to Obama on this. I think it’s likely that they’ll accept the fig leaf and do it gladly. I’m saddened to say that. I haven’t been to mass in years. And this sort of thing is the reason why.

Wow. Talk about hubris. The Obama regime is counting on two things to pull this (obviously unConstitutional power grab off): 1) the (presumed) brain-dead apathy of the American citizen; and 2) the ability of the MSM to cover and spin their way through it.

The transformation of the Democrat party from party of the working class non-mainline Protestants to party of the upscale secular urban elites is now complete. Catholic voters used to be the Democrats’ bread and butter (so were Evangelicals). Now they’re assuming that there’s enough people who are Catholic in name only who will happily betray Catholic principles. Catholic institutions can’t defy the mandate unless they self-insure or can find an insurer that will join them in defying the mandate or stop providing any health care insurance for their employees. Otherwise the insurance companies will simply tell them they can no longer buy insurance that doesn’t include contraceptives and abortificients.

I agree that Obama and company would like to force people into a government controlled healthcare system but I don’t believe the infrastructure exists to immediately take over for all of the Catholic hospitals in the country short of the government going in and seizing said hospitals and I doubt that’s a stunt Obama wants to try pulling in an election year.

However, if the Supremes overturn the law, then the states have the legal standing to ignore anything Jugears demands regarding Obamacare. That will make it even more important that he be defeated in November; I can see him precipitating a constitutional crisis by using executive branch authority to attempt to punish the states who defy demands vis a vis Obamacare. Also important that we retain the House and take back the Senate; in the event he does initiate such a crisis, it will take a legislative branch action to resolve that crisis.

Until we confront sympathetic *.isms, honesty and integrity will always lose. Somehow challenging any minority (race/religion/sexual preference) has become unacceptable regardless of the merits of the issue. When the tyranny of any minority group shuts down intellectual debate the sooner we plunge into abhorrent civil disorder the better.

I like you when you do your comments slowly, you look to me as the ‘ I’m smarter than anyone here’ that’s not a good way to make friends, that makes enemies.

When did the US government make me buy myself like a commodity to be taxed by them in order to even exist? I must have missed that memo… Last thing I recall is was born into this country with unalienable rights per the Declaration of Independence with even further rights that our Constitution was set to uphold and that government was supposed to play a minimal role period. Now the government is saying they can tax me for simply existing like I am a commodity unto myself just because? And to heck my principles or personal beliefs.. Because I exist therefore I am… a taxable commodity to them and they can spend that money as they deem fit.

Really describes the appropriate use of what my Dad’s used to say when describing such a debacle, “It’s all going to hell in a hand-basket if they keep this up.” If he were still here I would tell him boy he is so right on this one.

What happened to people? They now think everything is “free” even when only a small percentage of American’s agree with Obamacare, yet even more people forget these few people are inflicting there way of living and life choices on everyone else, which really has nothing to do with true healthcare requirements. Are they blind to seeing the financial and personal costs everyone will pay when they become a taxable commodity of the government for their very existance on earth? People seem so like headless unthinking zombies believing the drivel coming from the progressive liberal front and taking it. I sure hope they all find their heads soon!

Lots of thoughts hope it makes sense to you, bottomline this just isn’t right.
