Steny Hoyer to Sandra Fluke: You should probably sue Rush, you know

Given the insane mileage Democrats are getting from this story, he could probably get David Boies to represent her pro bono. Anything to keep the headlines coming.

Someone, I forget who, tweeted a few days ago that they’d happily bet ten grand that Fluke will get a cameo speaking appearance on one of the first nights of the Democratic convention. Anyone want to take that bet? Bear in mind, Obama’s already dialing up women’s colleges and inviting himself to speak at commencement in hopes of squeezing every last drop of war-on-women goodness out of this fiasco. At the rate we’re going, Fluke might introduce him at his acceptance speech.

“I’d like to see her take him to court,” said Hoyer, who was in Selma for the annual Bridge Crossing Jubilee. “She is not a public figure and, for that reason, she should be able to sue for slander, libel or whatever else might be involved.”…

Joseph Lowery, former president of the Southern Christian Leadership Conference, said he is familiar with “vintage Rush Limbaugh.”

“(Fluke) has ample room to sue him and I hope she does because he’s gotten rich off the mess he causes,” said Lowery, who joined Hoyer and other national leaders in condemnation of Limbaugh.

She’s got two problems trying to beat him on a defamation claim. One: Hoyer’s probably wrong when he says she’s not a “public figure” for First Amendment purposes. Courts will treat someone as a “limited-purpose public figure” under certain circumstances; according to the EFF’s summary of the law, typically that applies to someone who “(a) voluntarily participates in a discussion about a public controversy, and (b) has access to the media to get his or her own view across.” Fluke voluntarily testified before Congress and, lord knows, she has all the access to the media she could ever want. Assuming she’s a “limited-purpose public figure,” that means she’d have to show that Rush was more than just negligent in calling her a “slut” but acted with reckless disregard for whether it was true. Not an impossible standard to meet but more difficult, and his extended apology today may affect the calculus. The other problem is that, at bottom, he was making a crude joke more than a sincere accusation of fact. His point was that if you want someone else paying for your birth control then you’re kinda sorta being paid to have sex, in which case you’re kinda sorta a prostitute. That analogy is obviously different from claiming earnestly that someone’s promiscuous, but Rush did go on and on and on with it, especially in riffing on the absurdity of the $3,000 figure, so who knows how a jury would disentangle it. Would the line, “She’s having so much sex it’s amazing she can still walk, but she made it up there,” be viewed in the larger context of the point he was making or would it be viewed as a bona fide assertion of fact? I don’t know. Defamation lawyers, any insights?

In fact, I’d say she succeeded just a few times in those 3 years she is claiming… I’d argue she is bitter that $3K ONLY covered alcohol and that lone condom she bought, oh, years ago now is most likely way past its Use By date…

I notified ProFlowers today that they should never send me another email soliciting my business. I explained I’d never deal with them, or any of their affiliates.

I’ll do the same to every advertiser that took the side of the liberal Democrat party on this one. People need to understand that we’re in a war for the soul and future of this country.

When I’m not exhausted as I am now I’ll share my shuttle bus experience in Vegas after they closed the airport roads three hours ahead of the President’s arrival – and the pangs of the passengers hoping to get out before the airspace was closed. I could go on and on, conversations with military seatmates, clients, ALL without me initiating the conversation, all without prodding. Don;t think this Country is asleep. They are not. speaking of ProFlowers, which I did business with BECAUSE they advertised on Rush, I also left Geico after a number of years after the Beck thing. I don’t subscribe to Emily’s List, but I would never, and anyone here who does should do a little research but my guess is that you already have……oh, and did I mention B of A? That after 20 years moved my mortgage and every single account out to BBVA?

Yeah, there are things we can do in a very civil and powerful way.

I’m not so sure this is really going to help democrats with women. I have a feeling after democrats see the polls on this one they will wish they never heard of Sandra Fluke.

Sure, but I am more interested in a list of companies I should really be supporting, not just those who still advertise with Rush. For example, as far as I can tell after 10 years in business, I am the only (openly) conservative in my industry and yes, I have paid the price. And then some. After I refused to “play along” with my heady list of Wall Street liberal customers, as well as those in CA, when I was expected to keep quiet hearing them discuss their liberal BS at gatherings. I am not Rush, by any means, in terms of visibility, although I have plenty of visibility in my field and understand how Rush feels now. Not that he has a dearth of companies wanting to advertise on his show, I am sure its just a blip for him, a very temporary one at that.

If I spend my money with those companies/proprietors who share my views I would be more than happy. And there is such a list, sadly so.

I have a better idea. If she wants us to pay for her having sex, then we should make sure she takes care of those less fortunate in the process. Like all the homeless in Washington D.C. We will actually save her lot many an hour this way, all the homeless will come to her dorm room already equipped with a contraceptive in hand. Win/win all around, she’ll have non-stop sex and homeless will be occupied as well. This should clear out lots of streets in quick order when peddlers simply head to Georgetown dormitories instead of hustling people for change. Like I said, win/win. Last month I posted around here somewhere about my barbershop experience. I’ll share it again.
Now. it is a barbershop and is all guys to begin with, but this was totally a new experience. When I arrived there was a hot discussion going on about Obama and it carried on until I left. I never spoke a word the entire time ( I might have said a “Yeah” or “Right” or something like that, but that was all) There were at least 8 -9 guys, coming and going, in that shop ranging from early 20′s to late 60′s… and it was all anger at Obama and the Democrats. People were just spitting including the barber. Never ever had that happened before. People talked fishing or about their kids or stuff, but it was all “Our country is going nuts and Obama has got to be voted out and I don’t care who wins the GOP” A couple people had their favorites but it was all passion in there and a sight to behold.

I wanted to say something else about Rush.

Quite frankly, I think his show yesterday was one of his better shows.. possibly the best one I have heard in a long time. Before yesterday, ( I don’t get to listen all the time ), but before yesterday, I think he has been a bit lazy with his show. He has bordered either on depression or just boring. This Fluke thing was a good example. He started one day last week by saying how Fluke was a distraction… and then went on for 3 hours being distracted with her. I couldn’t stand it and eventually turned him off.

I have always tuned him in because he’s positive in the face of all of the stuff that is going on, plus he’s informative. He usually always has had new information on things. He doesn’t seem to be doing that anymore. He seldom comes up with inside information on anything anymore and he usually seems depressed.
I don’t need depression in my life and I don’t need to listen if he has nothing new to say.

We’ve got Obama wanting to dismantle our nukes, destroying our economy, fast and furious, seizing more power for himself almost daily.. the list is a mile long and Rush rambles on and on about Fluke.

Yesterday he seemed to have the show he should’ve been having all along. I couldn’t hear all of it, but he covered a lot of issues and actually seemed upbeat.

Someone, I forget who, tweeted a few days ago that they’d happily bet ten grand that Fluke will get a cameo speaking appearance on one of the first nights of the Democratic convention.

My guess a better bet would be that this vile shrew gets a slot on Dancing with the Stars, Survivor, or (my personal hope) The Bachelorette where she gets to show just how easy it is to blow through all that contraception in a far more graphic way than a sham Congressional hearing held only because the real hearing rejected her as a speaker.

The left is perfectly happy to keep the distraction going but this is not about Sandra Fluke’s sex life or whether or not she is truly a slut (for my money she is). Obama wants to force religious institutions to pay for contraception and procedures that run counter to their tenets of faith. In short this is a religious freedom case. That fact seems to be somewhat out of focus as Ms. Fluke flits from left-wing media outlet to left-wing media outlet whining that she has to pay for her contraception because those Catholics are anti-women or something.

Slightly OT, but has anyone brought up how much her insurance rates would go up to provide all that “free” contraception?

I suspect it would be rather more than the $9 a month the generic costs, since if it’s free, students would be more than happy to get the newest (read: most expensive) brand out there. So students who don’t want birth control, or who already use the $9 generics quite happily will also get their pockets picked.

And, as a number of folks have already mentioned on this thread and others, if she sues, discovery could be quite …. intersting. I suspect it won’t happen.

I already saw some blogs where that exposed her activist roots. I really was not surprised to find out that she advocated not only for contraception but also for abortion rights.
however, proving that she went on Georgtown and payed their enormous fees as a plant is a unbelievable story. more likely she went on there to take her law degree while still pursuing her activism passion.
also, whatever she advocates personally, does not diminish her testimony in the dem organized congressional theater which she crafted to make sure only widely supported issues(cysts and stuff) were brought up.
none of the above, of course, can ever justify calling her a slut and prostitute repeatedly.

the reasonable conservative response should be:
1) make medical exceptions for the use contraceptive pills that are used as treatment for issues unrelated with birth control(cysts, post menopause hormonal treatments, pain relief, etc).
2) keep pounding away on the religious freedom boilerplate.

instead, we had a horrible ad hominen attack made by rush, that is destroying rush and everyone associated with him.

now that fluk is already a martyr, unless a gangbang video is discovered, any further ad hominem attack on her will seem like a attempted justification of the slut attacks and will discredit however makes them.

She can’t sue him for anything except calling her a prostitute and I think he was smart enough to couch those words. “Slut” is a subjective term. It would be hard for anyone to prove that one way or another. The classic libel case is you can write that some one is an “a$$hole” because there is no way to prove it, but if you call them a “thief” you better have enough evidence to make a reasonable assessment that they are a thief.

Rick Santorum made a mistake when he let his Catholic opinions on contraception become a matter of public debate, since they are not widely shared. This and being led into a serious of unfortunate and easily misunderstood remarks about the role of religion in public life let the politically liberal media to paint him as an overzealous bigot, deflect public attention from his attack on Obama’s economic policies, and blunt his appeal to religious and social conservatives.

I suggest that Pelosi and Fluke laid a clever trap..to present an outrageous case for contraception as a case of women’s health. This would serve multiple purposes. It would score political points with the Feminists who actually agree with and practice the lifestyle Fluke described, and who form a highly vocal and influential part of Democratic support. It would also bait someone into (Likely Limbaugh, given his known penchant for such things) into making comments on Fluke’s sexuality, and allow them to igniting a firestorm of controversy, painting Fluke as an undeserving victim, that would obscure anything else he might say. It would also let them portray Fluke as an undeserving victim, scoring yet more feminist sympathy points.

Rush took the bait, and now his entirely valid points about the irresponsibility of such conduct, the folly of a government subsidy of it, and the attack on religious freedom have been obscured. The proposed lawsuit pumps air into the controversy and helps keep the public discussion toward where the Democrats are stronte and away from from where they are vulnerable.
