Obama “accommodation”: Insurers must cover contraception at no cost to … anyone?; Update: “Magical thinking,” says LA Times

Today, the Obama administration hastily called a press conference to announce a change to its HHS mandate for employers to cover contraception at no cost, including religious organizations whose doctrines oppose contraception and abortifacients.  Instead of religious organizations footing the bill directly, the revised “accommodation” now says that insurers must cover the costs, which changes … nothing:

The revised Obama mandate will make religious groups contract with insurers to offer birth control and the potentially abortion-causing drugs to women at no cost. The revised mandate will have religious employers refer women to their insurance company for coverage that still violates their moral and religious beliefs. Under this plan, every insurance company will be obligated to provide coverage at no cost.

Essentially, religious groups will still be mandated to offer plans that cover both birth control and the ella abortion drug

According to Obama administration officials on a conference call this morning, a woman’s insurance company “will be required to reach out directly and offer her contraceptive care free of charge. The religious institutions will not have to pay for it.”

The birth control and abortion-causing drugs will simply be “part of the bundle of services that all insurance companies are required to offer,” White House officials said.

So these employers will still have to provide the health insurance, and the health insurance must cover the contraception and abortifacients.  The White House apparently wants t pretend that the funds for these outlays will come off of the Unobtanium Tree, where insurers find money to cover all mandates.  This exposes once again a stunning ignorance of risk pools and how costs are passed along to consumers.

Let’s just take this one step at a time.  Where do insurers get money to pay claims?  They collect premiums and co-pays from the insured group or risk pool.  No matter what the Obama administration wants to say now, the money that will cover those contraception costs will come from the religious organizations that must now by law buy that insurance and pay those premiums.  Their religious doctrines have long-standing prohibitions against participating in contraception and abortion, and nothing in this “accommodation” changes the fact that the government is now forcing them to both fund and facilitate access to products and services that offend their practice of religion.

Basically, the Obama administration told religious organizations to stop complaining and get in line.  This “accommodation” only attempts to accommodate Obama’s political standing and nothing more.

Here’s where the magical thinking comes in. The following is from the fact sheet the White House released Friday:

Covering contraception saves money for insurance companies by keeping women healthy and preventing spending on other health services. For example, there was no increase in premiums when contraception was added to the Federal Employees Health Benefit System and required of non-religious employers in Hawaii. One study found that covering contraception lowered premiums by 10 percent or more.

Making everyone in a pool carry coverage whether they need it or not spreads the cost, saving money for those who really do need it and who’d choose to carry it if it were merely optional. But costs faced by the insurer are the same — and when the care is provided with no out-of-pocket costs, the insurer’s costs are likely to go up because more people will use it. Such is likely to be the case with contraception.

Also, let me emphasize one point that this does not address.  The government is forcing religious organizations to both pay for and facilitate activities that violate their religious doctrine.  If anyone thinks that passes muster with the First Amendment, that’s even more magical thinking than this funding shell game.

And the manufacturers of the product will also be required to provide it without cost, the truck drivers will be required to ship it without cost, the pharmacy will be required to hand it out without receiving payment.

In his press conference, he said something like we don’t have to agree on every issue all the time. THIS is some great orator, with high-minded rhetoric? So many straw men, so much vague, general BS in the way he frames issues. He first sets up a black and white, all or nothing situation, then says no, we can’t have that. Then he portrays himself as the sensible one, compromising between the black and the white. So pointless, empty, meaningless. And self-serving and self-glorifying.

Of course, there’s also the issue of the insurers’ constitutional rights. If Obama is truly mandating that they provide contraceptive services without the ability to recover their costs in doing so, then his new mandate amounts to a regulatory taking in violation of the Takings Clause of the Fifth Amendment.

Team Obama is taking a “What’s the least amount of pullback we can get away with?” strategy. Take marginal steps backwards from the original HHS edict, then do some polling and see if this offer is like to win people back to your side — in the case of Catholics, by splitting up the current unified opposition of not just the church leadership, but other prominent Catholics to the original mandate.

If they can get some of the liberal Catholic types, like E.J. Dionne or Chris Matthews, to start toeing the party line and telling other Catholics what a great new idea Obama’s announced, that’s where they’ll stay at least until some new poll numbers show the masses are still siding with the Church leadership. The White House doesn’t want to anger their feminist base, and that base isn’t going to let them back off on mandatory contraception services, including the “morning after” pill option, until they decide Obama can’t be re-elected unless he moves away from their stance. As militant as the pro-abortion types are, we’re way to far out from Election Day for them to abandon their demands right now.

Essentially, what is being said here is that the federal government supercedes the right to free speech and religious freedom. Apparently, the commerce clause can force one to participate in private transactions and to unwillingly participate in funding procedures they disagree with. If an individual happens to be employed by a firm that the president decides unilaterally to exempt, they are freed from this obligation, at the expense of everyone else. By definition, this has moved from a representative democracy to a dictatorship.

It is time to have a serious discussion about how the federal goverment will be replaced by the people.

And if not, why not? I take drugs I have to take every day, and I pay a hell of a lot more than 60 bucks or so a month in co-pays.

Seems reasonable to me too. I mean, after all, I have to pay for food, for my house, stuff like that. As far as recreation and entertainment goes, I also have to pay the cable bill, the Internet bill, to go to ballgames and to travel and the like.

Hell, as far as sex goes, my wife had a tubal ligation years and years ago and I paid for that too.

I have a funny feeling behind the scenes – the Insurance lobby is hammering the WH with cost assesments that equal a huge loss.

The loss of religious employers is in the hundres of millions, if not billions. So while the Freedom of religion is the crux of this issue – Obama never cared about that, except to usurp it all together. Its the cost/rate of return that matters to them.

And if the CBO had a set of walnuts – their recalculation of Obamacare – less religious groups – would double any “forecasts” of cost and half the “savings” – if we are to believe anything they put out.

Sooooo, does this mean pharmaceutical companies will give it out free? Do their workers and suppliers contribute labor, materials, and transportation? If the insurance companies have to pay for all this, are they going to reduce their labor force or maybe raise their premiums and make the cost fungable so no one KNOWS their paying for it?
