PETA sues SeaWorld for “enslaving” killer whales

If you’ve ever wanted to watch killer whales perform for your benefit, book your trip to SeaWorld now! If the People for the Ethical Treatment of Animals has its way, those poor whale slaves won’t entertain tourists much longer …

This story serves up too many fantastic quotes to ignore. Like one commenter on the case, I’m not surprised; it is PETA we’re talking about, after all. Yet, somehow, they always manage to be more over-the-top than before. The organization sincerely claims that SeaWorld is in violation of the 13th amendment’s ban on slavery because it holds five orcas – Tilikum, Katina, Kasatka, Ulises and Corky — at its parks in Orlando, Fla. and San Diego against their will. How they know that the whales don’t want to be SeaWorld stars I’m not sure — it might just be a killer whale’s dream — but, to give PETA the benefit of the doubt, I suppose the fact that Tilikum killed a SeaWorld trainer in 2010 might be an indication the animal is unhappy.

At any rate, here’s Jeff Kerr, the PETA lawyer who is representing the five orca plaintiffs, explaining to San Diego News why this case is actually of monumental importance:

“[The suit] eradicates slavery in all forms and slavery should not depend upon the species of the slave anymore than it depends upon gender, race or ethnicity of the slave,” said Kerr.

PETA will argue that if the orcas can suffer from enslavement, they should be protected from it.

“They were ripped from their homes and families, with whom they would have spent their entire lives,” said Kerr. “They’re held in the equivalent of concrete bathtubs. They’re denied everything natural to them… They’re forced to perform for human amusement and they’ve been turned into virtual breeding machines. By any reasonable definition, they’re slaves.”

Here he is again in The Daily Mail:

‘This case is on the next frontier of civil rights,’ said Mr Kerr, representing the five orcas. …

Brushing animals off as property is the same argument that was used against African-Americans and women before their constitutional rights were protected, PETA says. …

‘This is an historic day,’ Kerr said. ‘For the first time in our nation’s history, a federal court heard arguments as to whether living, breathing, feeling beings have rights and can be enslaved simply because they happen to not have been born human. By any definition these orcas have been enslaved here.’

Eh, I suppose I’m OK with this if Kerr can manage to find a jury of the orcas’ peers to decide the case, as Kimberly Guilfoyle suggested last night on The O’Reilly Factor.

It’s easy to laugh this story off, but it’s actually deeply disturbing. The constitutional claim is ridiculous: All the founding documents are clearly written by and for persons. The preamble of the Constitution starts with “we the people,” and the Declaration says, to secure rights, governments are instituted among “men.” It’s highly, highly insulting to those persons whose personal dignity was denied by slavery to suggest that animals-as-property is the same argument as persons-as-property. For that matter, it’s highly insulting to the babies whose personal dignity is denied by abortion to suggest these whales need to be fought for in court. This case likely won’t go anywhere, but that a judge has to hear and decide it in the first place is an enormous waste of time and taxpayer money — and troublingly indicative of how relativistic a society we’ve become.

There seems to be no end to the horrible consequences brought on by the subprime housing debacle. All those killer whale homes now vacant because Seaworld evicted a bunch of orcas from their homes.

If they’d just worked with the killer whales, their wouldn’t be such a glut of vacant killer whale houses on the market.

I sincerely hope Mr. Kerr amends his complaint to address the predatory housing practices Sea World has engaged in as well as cetacean slavery.

If we’re to take this case seriously then it should be first proven that whales are sentient (and sapient?). Then we need to go through some messy review on their citizenship, though if the first can be proven then I suppose you’d already prove an American company such as Sea World would be in violation of using them… though they are getting room & board and a lot of other expensive treatment so I guess you could make an argument that they’re kinda employees…

One thing though, I don’t full agree with the sentiment behind the ‘persons’ remark in the above article. If we discover alien life then I am sure rights given to persons will apply to them, same if we ever conclusively proved some sort of life other than humanity has sentience/sapience – or if we reach a point where we uplift animals into that category. True, there is hypocrisy regarding the unborn & there is some disservice to those in our history who have truly suffered but I belive those aren’t the same issue as we’re discussing here.

I’m sure that outside California, this case will little chance of awarding reparations to the cetaceans.

You assume far too much. There is absolutely no legal reason to grant any liberties to extraterrestrials or sapient whales. You can’t just say, “Oh, I think they’re smart. Poof! God given rights!”

I’m no fan of PETA and frankly think many of their aims are more than a little off kilter. But as far as Sea World’s treatment of cetaceans (and this includes all of those bottle-nose dolphins as well as the various Shamu whales), I’m not a fan. I’ve read too much research about these animals and their unexpectedly high levels of demonstrable intelligence and I find that the conditions that even American amusement parks like Sea World keep these creatures in to be appalling. While I understand some individuals continue to question the animal intelligence of certain species of whales and dolphins, it still is a question to be answered and until then, we should do our best to treat the denizens of the ocean with respect.

Or as every Trekkie knows, a giant spaceship from the other side of the galaxy will be dispatched to annihilate us thanks to how we’ve treated these “animals”

I’m no longer too thrilled about holding these animals in captivity, but the ones there now cannot be released successfully. And PETA is just nuts.

I happen to be a mind reader of mammals and have talked to the whales, they love to perform, they love the diet, and the babes are great to look at…there is one gay whale who especially likes Mark, one of the trainers.
They hate the ocean, it’s scary and they have to hunt for food, here they are safe, and can frolic with no fear, they love to hear the children scream with delight, and would miss them terribly.
They are afraid that they will be taken away from the only home they know, and want nothing to do with this thing called “court”.
PETA is of no use, since they enjoy consuming other fish…meat is their diet.

Shouldn’t we try to relocate the bacteria into another host before murdering millions of them? So what if a person dies from strep. It’s not the bacterias fault. It’s just the circle of life. Bacteria have as much right to live as the rest of us.

How can we call our self civilized while Americans are murdering billions of germs everyday by cleaning their kitchen counters!

Of course, too, you could make the case that plants deserve rights. Is not a field of corn a field of life? That farmers ruthlessly harvest and kill! Every time we eat, whether it’s meat or vegetables, we kill.

I’m a big animal lover, and I’m uncomfortable with zoos and animal parks like Sea World — but where will the next generation of animal lovers come from if kids never see orcas and tigers and elephants, up close? It’s a sacrifice that has to be made for the species (and luckily, most though not all, are treated well and fed better than they’d ever be in the wild).

Oh, and PETA are animal-killing psychos.

How does PETA figure they have standing to represent the orcas? Did the cetaceans pay them a retainer in herring? Do they have a flipper print on a Power of Attorney form filed with the court? Even if this is a class-action (or is it “species-action”?) suit, they still need a specific complainant to get in the courtroom door.

I suppose if the state decided to put Tilikum on trial for murder, PETA could act as his lawyer and argue self-defense against illegal confinement. But if PETA does manage to win personhood for the killer killer whales, they should remember that there’s no statute of limitations on the charge.

The AP is reporting the Judge threw out the case.
