DoJ figure taking the 5th in Fast & Furious probe

It’s every citizen’s right to take the Fifth Amendment in court and Congressional hearings when testifying.  When the sitting chief of a criminal investigation division for a US Attorney’s office does it, though, it certainly calls into question what in blazes the Department of Justice has been doing, especially with Operation Fast and Furious:

The chief of the Criminal Division of the U.S. Attorney’s Office in Arizona is refusing to testify before Congress regarding Operation Fast and Furious, the federal gun-running scandal that sent U.S. weapons to Mexico.

Patrick J. Cunningham informed the House Oversight Committee late Thursday through his attorney that he will use the Fifth Amendment protection.

Cunningham was ordered Wednesday to appear before Chairman Darrell Issa and the House Oversight Committee regarding his role in the operation that sent more than 2,000 guns to the Sinaloa Cartel. Guns from the failed operation were found at the murder scene of Border Agent Brian Terry.

The letter from Cunningham’s Washington DC attorney stunned congressional staff. Last week, Cunningham, the second highest ranking U.S. Attorney in Arizona, was scheduled to appear before Issa‘s committee voluntarily. Then, he declined and Issa issued a subpoena.

Cunningham is represented by Tobin Romero of Williams and Connolly who is a specialist in white collar crime. In the letter, he suggests witnesses from the Department of Justice in Washington, who have spoken in support of Attorney General Eric Holder, are wrong or lying.

Rep. Darrell Issa, chair of the House Oversight and Government Reform committee, issued a statement few minutes ago calling this move “extremely rare” and “an indictment” in itself of the DoJ’s integrity.  Issa also points out that the scope of the strategy that Cunningham will employ will leave him answering no questions except his name and title:

“The assertion of the fifth amendment by a senior Justice official is a significant indictment of the Department’s integrity in Operation Fast and Furious. The former head of the ATF has previously told the committee that the Justice Department is managing its response to Operation Fast and Furious in a manner designed to protect its political appointees.  This is the first time anyone has asserted their fifth amendment right in this investigation and heightens concerns that the Justice Department’s motivation for refusing to hand over subpoenaed materials is a desire to shield responsible officials from criminal charges and other embarrassment.

“Coming a year after revelations about reckless conduct in Operation Fast and Furious were first brought to light, the assertion of the fifth amendment also raises questions about whether President Obama and Attorney General Holder have made a serious and adequate response to allegations raised by whistleblowers.  Did Attorney General Holder really not know a senior Justice Department official fears criminal prosecution or is this just another example of him hiding important facts?  The committee will continue to demand answers.”

While Cunningham has the right to take the Fifth under questioning, Congress also has a duty to oversee operations within the Department of Justice, and the DoJ has a duty to answer to Congress.  A refusal to do so should mean the end of Cunningham’s employment at the DoJ; if he cannot testify before Congress about his official actions, then he should not be employed in that position any longer.

The tactic leaves Issa with another option, too.  He could offer Cunningham immunity from prosecution, which would then force him to testify before Congress about what he knew of OF&F — and perhaps more importantly, what his superiors knew about it, too.  A refusal to testify at that point would amount to contempt of Congress, for which Cunningham could find himself facing significant jail time.  That depends on how critical Issa views Cunningham to the OF&F scandal, and whether Cunningham himself was a big fish in the operation or just one of the middle men.

One point is pretty clear, though.  Officials at the DoJ involved in this operation are fearing criminal prosecution, which means that this scandal just went prime time.

If he was acting under orders as a justice department official, he is acting under executive privilege. This means that he has no personal criminal liability, and therefore the Fifth Amendment cannot apply to his testimony.

In other words, pleading the Fifth is the same thing as saying that he WASN’T acting under orders. In which case, Holder should take action to investigate and punish Cunningham just. Which, of course, he has not done and will not do.

In my view, the only thing that will effectively counter MSM bias would be if prominent and visible Republicans and conservatives engineer the equivalent of a shut-out, an absolute refusal to cooperate with the mainstream media, especially the most egregious offenders: no interviews, no access, and certainly no debates. Cut them off and publicly say exactly why this or that media outlet is being excluded: strip them of their legitimacy as objective news-gatherers and reporters. While some of the liberals may be delighted with this kind of action, the MSM would need to explain to its audiences why this senator or that congresswoman refuses to talk to them. It’s worth a try, anyway.

The MSM can’t convict these guys, investigate them, put them under oath…only committee’s like Issa’s can do that, and I could care less if the MSM reports it or not, as long as the perpetrators are convicted.

Regardless of what the law says, if you exercise your rights under the 5th amendment, its cuz’ you might say something that’ll send you to jail.

“I didn’t do anything wrong, but…..I might say something that would incriminate me.” The logic of that statement fails.

If you didn’t do anything wrong, why not prove it? Why go through the whole process and take a chance with a jury…who in this case just might be itching to punish everyone involved?

Once again, one has to ask, “Whose in charge here?” If the chief executive of this organization, Holder, had no idea what his underlings were up to, it speaks to his malfeasance as an executive and he owes his stakeholders (Congress & taxpayers) a proper accounting. If he’s unwilling to acknowledge responsibility, then someone else will have to take the fall on his behalf to protect him. The fact that he has already declined to take swift action or even committed to his stakeholders to immediately fire or prosecute those responsible suggests that he is not inclined to act and, therefore, must be held to account himself for his criminal lack of oversight.

This is the only way out-of-control federal agencies will ever be held accountable. It’s of constitutional importance and for the protection of gun owners, imperative that these goons do NOT get away with this style of law enforcement tactic. First, the letter from his attorney clearly indicates that a wedge has been at least successfully driven between Cunningham and the other “bigs” at DOJ regarding the allegations of a criminal cover-up of Fast and Furious. For example, he stresses, in part, that the documentation tends to show that DOJ itself appears to have made false accusations (presumably about his client).

. . . Regrettably, he now finds himself caught in the middle of a dispute between the Legislative Branch and the Executive Branch, with both, according to the allegations in your letter finding it convenient to make accusations that are inconsistent with the documentary evidence and the public record.

The letter from his attorney also seems to be focused exclusively on the question of Mr. Cunningham and his role in advancing the alleged cover-up, not on any role he may (or may not) have played in the launching of F&F.

The objective evidence collected by this Committee demonstrates that Mr. Cunningham did nothing wrong and that he acted in good faith. Further, although your staff purported to provide me with all documents sent or received by my client it has provided no documents supporting the allegation in your letter that my client had anything to do with approving the “unacceptable tactics used in Fast and Furious.” Indeed, it is a matter of public record that the Fast and Furious investigation began in 2009, months before my client even started at the United States Attorney’s Office in 2010.
. . . .

So, I’d say that is literally an open invitation to the Committee to grant him some form of testimonial immunity in order to facilitate their process. If it is true (as the letter states) that he had nothing to do with the initiation of F&F, then it appears that Issa’s committee can pry this wide open by giving him some form of limited testimonial immunity, and then Cunningham could be compelled to testify.

Here is the language in the letter that specifies what they are looking for — an evidence-backed timeline regarding the written cover-up with Congress, which could then be used to help nail down who actually approved the project in the first place.

. . . Indeed your staff has provided me with documentary evidence demonstrating the following. First, Mr. Cunningham proposed draft language internally to his supervisor in the United States Attorney’s Office. Second, Mr. Cunningham vetted the accuracy of the draft language with others in the United States Attorney’s Office. Third, Mr. Cunningham’s supervisor reported that he provided the draft language to the Department of Justice. Fourth, the Department of Justice did not include in its response to Congress the draft language Mr. Cunningham’s supervisor reportedly provided.

Depends. If Obama himself is under threat from being brought down by this for personal involvement then he’ll throw anyone and everyone under the bus to protect himself. If he’s not directly responsible and under no personal and/or professional threat then he’ll dig in his heals and do everything he can to cover up for and protect his goons.

When the sitting chief of a criminal investigation division for a US Attorney’s office [take the Fifth Amendment in court]… it certainly calls into question what in blazes the Department of Justice has been doing, especially with Operation Fast and Furious

It’s almost as if the vast majority of the media to the Americans is a de facto campaign arm of the one-who-makes-the-seas-recede.

At present, something like 138 Americans outside of this site know anything about this scandal. But, on the bright side, the numbers increase by one or two every day!

Prime time? What I know from watching NBC this morning: Gingrich went through an awful divorce, Mitt Romney has shady finances, and Obama sang at a fundraiser.

That is the straight dope on the MSM.

I have NO IDEA what would make this scandal go “prime time”.

Think of how this would have been treated had a republican been president. There already IS a dead body of a US LEO, and there are HUNDREDS of dead bodies of Mexicans, including at least one Mexican gov’t official. No matter what one thinks of anything Mexico is our ally and our next door neighbor and we permitted illegal weapons to enter their country and we NEVER TOLD THEM. And people died, people died, PEOPLE WERE MURDERED.

And this is not front page news, or evening news, or any kind of news.

The biggest scandal of this scandal isn’t what Holder did or Obama or anybody else, it is what the MSM has failed to do with a few noble exceptions.

And I’d been willing to be a dollar to a donut that if Obama gets tossed in November (please dear Providence let it be so) none of these people will be held account since nobody will want to pursue wrong doers from a prior administration.
