Breaking: Obama to reject Keystone XL pipeline

Big deal or just a paperwork shuffle?  The Washington Post’s Juliet Eilperin breaks the news that the Obama administration will reject the application for the Keystone XL pipeline — but with a caveat:

The Obama administration will announce this afternoon it is rejecting a Canadian firm’s application for a permit to build and operate a massive oil pipeline across the U.S.-Canada border, according to sources who have been briefed on the matter.

However the administration will allow TransCanada to reapply after it develops an alternate route through the sensitive habitat of Nebraska’s Sandhills.

There had already been talk of adjusting the pipeline route to satisfy some concerns over the risk being taken with aquifers in Nebraska.  The permit application would have had to be amended in order to make those adjustments.  Did that require a rejection from the State Department?  Probably not, although it’s unclear whether the law would have allowed for a change in the current application.  Perhaps some EPA-experienced attorneys could address that point.

Here’s an even more interesting question.  The rejection allows Obama to fulfill the requirement in the compromise 60-day payroll-tax holiday bill for a decision on Keystone.  If Republicans want to force Obama into a decision on the new application, they’ll have to force it into another bill, probably the eventual compromise bill that extends the payroll-tax holiday for the entire year.

Update: Looks like the recommendations of Obama’s own jobs council got as much attention from Obama as the Simpson-Bowles deficit commission, huh?  “Drill, drill, drill” just got changed to “delay, delay, delay.”  Leadership!

President Obama’s jobs council called Tuesday for an “all-in approach” to energy policy that includes expanded oil-and-gas drilling as well as expediting energy projects like pipelines.

“[W]e should allow more access to oil, natural gas and coal opportunities on federal lands,” states the year-end report released Tuesday by the President’s Council on Jobs and Competitiveness.

The power to permit or reject this and other pipelines is originally that of Congress. It has only been delegated by legislation to executive branch agencies. They could pass a law granting the right to build it if they wanted to, but it’s more fun to keep Obama between the rock and hard place of his split base. Just keep passing bills that make him do it over and over.

Meanwhile, of course, even Canadians have limited patience and the oil will end up in China, turned into rocket fuel, and some day delivered to our shores unexpectedly–just like the scrap steel we sold to Japan before WW II.

If that happens, he would probably completly empty out the petroleum reserve in the name of a national emergence (namely his political future.)

(4) For the purpose of the permit issued under subsection (a) (regardless of any modifications under subsection (d))–

(A) the final environmental impact statement issued by the Secretary of State on August 26, 2011, satisfies all requirements of the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) and section 106 of the National Historic Preservation Act (16 U.S.C. 470f);

(B) any modification required by the Secretary of State to the Plan described in paragraph (5)(A) shall not require supplementation of the final environmental impact statement described in that paragraph; and

(C) no further Federal environmental review shall be required.

(d) Modification- The permit issued under subsection (a) shall require–

(1) the reconsideration of routing of the Keystone XL pipeline within the State of Nebraska;

(2) a review period during which routing within the State of Nebraska may be reconsidered and the route of the Keystone XL pipeline through the State altered with any accompanying modification to the Plan described in subsection (c)(5)(A); and

(3) the President–

(A) to coordinate review with the State of Nebraska and provide any necessary data and reasonable technical assistance material to the review process required under this subsection; and

(B) to approve the route within the State of Nebraska that has been submitted to the Secretary of State by the Governor of Nebraska.

This is going to be a shell game. The prog narrative will not be ‘pipeline denied’, it will be that all they have to do is find an alternate route and all will be well. Of course that will mean another two-year environmental study done by those that oppose the pipeline yet have to be paid for the study by those in favor.

Obama needs to be STOPPED if he attempts to release the strategic reserves. “My re-election is in danger” might be a “national emergency” to Obama but it is NOT an actual national emergency. The strategic reserves exist to ensure that if an enemy invaded us and supplies got cut off that our TANKS AND PLANES have fuel!

Indeed he did. Amazing what you can learn if you take the time to listen to the words that come out of his mouth. He also said, very plainly, that under his plans the cost of energy would “necessarily skyrocket”.

Raising the cost of fossil based fuels has multiple purposes, among them diminishing use of those fuels and making so-called “clean” energy more cost competitive. The destructive consequences for the economy and the damage done to the budgets of American families is not as important to Obama as pretending to the planet from global warming to keep the green fanatics on board and lining the pockets of “clean” energy investors so they can make campaign contributions. Hell, more families below the poverty line means more voters dependent on gubmint cheese, and voting for the leader of the party of more gubmint cheese.

I saw a report on our local news last night that gas will be $5+ by this summer.

Harper is very careful.

My guess is that he will limit his comments so as not to be seen “interfering” with the US election and he will begin negotiating with China. However, no deal will be signed before the election in November and if the GOP wins the presidency, no deal will be signed until after the inauguration.

It’s in Canada’s interest to do the deal with the US so there is no way he will burn any bridges.

Bill Clinton did not strangle the energy supply that powered the internet/computer boom.

Jimmy Carter did not PURPOSEFULLY strangle the energy supply that powered the still industrial economy of 1970s America.
