Obamateurism of the Day

posted at 8:05 am on January 9, 2012 by Ed Morrissey

When Barack Obama issued his recess appointments of Richard Cordray as head of the CFPB and three nominees to the NLRB, he and the White House blamed Republican obstructionism for the decision to use the extraordinary appointment power. With Cordray, the GOP had unquestionably blocked his appointment. But how about the three NLRB nominees? Not only did the Senate not have time to consider their appointments, the White House hadn’t even had time to add two of them to their list of nominees awaiting consideration:

The two Democrats that President Barack Obama appointed to the National Labor Relations Board during what he considered a congressional “recess” are not on the White House’s official list of Obama’s appointments and nominations for various positions.

Obama referred his two Democratic nominees, Sharon Block and Richard Griffin, to the Senate on Dec. 15. The Senate adjourned for the year – but did not go into an official recess — on the following day.

WhiteHouse.gov tracks the status of all of Obama’s appointments and nominations. Block and Griffin do not appear on that list — a sign that the administration rushed the recess appointments through too quickly for the Senate to even consider them.

“It’s hard to argue that the Senate was obstructing these Democratic nominees when they don’t even appear on the administration’s own list of nominations and appointments,” U.S. Chamber of Commerce labor policy specialist Glenn Spencer told The Daily Caller.

Bear in mind that the NLRB had fallen one short of a quorum, which means that it couldn’t take any action until the Senate confirmed at least one of the appointments. Obama should have had these appointments to the Senate long before mid-December. Instead, they came so late that even the White House hadn’t had time to update its own records. That exposes the NLRB recess appointments as due to executive ineptitude rather than legislative obstructionism.

Got an Obamateurism of the Day? If you see a foul-up by Barack Obama, e-mail it to me at obamaisms@edmorrissey.com with the quote and the link to the Obamateurism. I’ll post the best Obamateurisms on a daily basis, depending on how many I receive. Include a link to your blog, and I’ll give some link love as well. And unlike Slate, I promise to end the feature when Barack Obama leaves office.

The next appointment will be golf-related: a Fore-Play Czar.

Whilst he is lazy, this was a calculated end around congress yet again.

You can do this kind of thing when you are King.

CorporatePiggy on January 9, 2012 at 8:23 AM

So…..

If the Congress was in recess as the 4th greatest President ever claims, how is it Congress managed to send the NDAA to him and he signed it? Bottom line is that these appointments are clearly unconstititional and will not stand the first contact with litigation (which is forthcoming).

That being said, I do not consider this an Obamateurism but rather a gross violation of the oath Obama took when he became President. Treason is something that should never be taken lightly.

Actually, the litigation isn’t partisan. All it takes is a ruling by these illegal appointments for the losing party to sue challenging the legality of the appointments. And rest assured, once somebody loses a case before the NLRB, they will litigate.

I’m working on Obama’s false meme/narrative and will post it weekly in the Green Room right up to Nov 6th (if necessary).

Here’s a little rough draft:

President Obama, Please Stop Lying About Congress Doing Nothing When It’s Your Democrat Senate That Has Done Nothing

President Obama’s campaign strategy is to stake the claim that Congress has stalled his domestic policies that would put people back to work and strengthen the economy. As you will see in this simple post, nothing could be further from the truth. Since the President’s economic policies and his big government spending programs—A FAILED STIMULAS AND OBAMACARE—has done little to produce real growth, his campaign will be based on blaming some one else for his failed leadership.

Now let’s get to which portion of “Congress” has and has not done to produce jobs.

http://majorityleader.gov/JobsTracker/

And can President Obama please explain to the American Public why HIS SENATE HAS YET TO PASS A BUDGET IN OVER 980 DAYS?

Rovin on January 9, 2012 at 8:38 AM

Normally, I would write a snarky comment. But, I can no longer do that.

The list of non-Constitutional, extra-Constitutional, un-Constitutional actions by this POTUS is disgusting. As the American people loose thier freedom and liberty, who stands in opposition? No one!

We are being sold down the river, and our elected officials are allowing it to happen.

Congrats to the president, he is fundamentally changing America. Not for the good or better. But, he is succeeding in fundamentally changing this country. A country of less liberty, less freedom, less natural rights, more government control, more government spending, and more goverment bureaucracy.

It is definitely unreasonable to expect the White House to worry about something as petty as the appointment process. Especially in mid-December what with all the parties, getting ready for vacation, the Kennedy Center honors, the decorating of 37 Christmas trees so that poor people who can’t afford a tree is able to live vicariously through our self-styled royals.

This is an excellent summary of how far O has gone to create his dictatorship. As the author points out, it was originally written by Naomi wolf in 2007 for GW, but it really is more aptly applied to this administration. I fear for this country unless we find a candidate who can articulate the multitude of anti-American moves the administration has made.

Or maybe it exposes that Obama intended to use recess appointments for his new NLRB nominees all along. That’s why he waited until the last second to disclose who they were.

My understanding is that Øbama didn’t make the nominations because he knew the people he wanted would not be approved by the Senate. IMV, it’s a matter more of executive guile (and overreach) than ineptitude.

Recess appointments should definitely be rare and not an end-run around the Senate to put unfit people in office.

That being said, let us continue to emphasize the that what Obama did was illegal since Congress was not in recess. It’s important not to call these appointments by anything but what they are. Unconstitutional usurptation by an arrogant narcissistic socialist who thinks he is the smartest kid in the class and can do whatever he wants.

nicefly on January 9, 2012 at 9:06 AM

I have never fully understood the concept of recess appointments. If a person can’t make it through the confirmation process legitimately, shouldn’t another nominee be considered instead? Why backdoor a person into a position? If, for example, the senate blocks three nominees, for purely political reasons and not qualification reasons, then I somewhat understand a recess appointment mechanism. But to pull this stunt with the NLRB appointments is shameful.

herm2416 on January 9, 2012 at 9:08 AM

I don’t consider this an Obamateurism. THE appointment of Cordray is what’s getting all the attention, but he wanted to slip these appointments for the NLRB in before the Senate could actually vet them. Given how the Democrats just did this to Bush, he had to know his party would support him and the LSM would wimp out too.

I’m amazed with how little regard there is, among liberals, for the constitution. It’s the only thing that separates us from Cuba and they’re willing to sacrifice it for this President. That’s how you end up with a Chavez and Castro.

It was done intentionally and with malice aforethought – to show that our supreme leader could do what he wanted, when he wanted; and damn the Constitution.
This may just be the most blatant of obama’s un-Constitutional actions – but it certainly won’t be the last.
Lil barry has no intention of relinquishing power – election or no election.

Any other white president, Republican or Democrat, would have been impeached long ago for such blatant and flagrant violations of executive power.

Of course, for having stated the obvious, I will now be called a racist by all the liberals here. I can assure you, my hatred for this man(?) has absolutely nothing to do with the color of his skin, but only for his disrespect for the United States and the Constitution.
