Pelosi: I’m darned proud of Obama for making these illegal recess appointments

Some said she’d never top her infamous reply when asked to explain the constitutional basis for ObamaCare’s mandate, but you know Nancy — always striving to improve. Notice here that she doesn’t try to defend Obama’s move on legal grounds. She could have, as that’s what the follow-up question is looking for, but all she’s willing to do when pressed is mumble something about “public debate.” For good reason: Even if there’s a constitutional argument to be made in Obama’s defense, that argument isn’t available to Democrats. They used pro forma sessions, successfully, to block Bush; the only way to square that circle is to argue that the GOP is being more obstructionist than they were, to the point where other branches are now free to ignore separation-of-powers provisions in the Constitution in order to break the impasse. It’s as if Obama, frustrated at seeing Democratic bills stalled in the House and Senate, had suddenly decreed that some of those bills will be treated as valid law. That’d show that “do-nothing Congress” a thing or two, eh? It’s nutty, and insanely shortsighted given that a Republican president will end up clubbing them over the head with this precedent, but it might help Obama’s reelection bid marginally, so hey.

Frankly, it astonishes me that anyone like Obama or Pelosi could be elected to power in the first place. And, after years of dismal performance and illegality, they remain unchallenged and their power seems to be secure.

How can Obama continue to poll in the 40′s? Have the voters become THAT stupid, ignorant and disdainful of the Constitution?

How is it, at this juncture, that Obama is even able to be given a CHANCE of re-election? This truly scares me. If we as a people have become this ignorant, then we are lost.

These are very serious times. There is a lot on the line in this coming election. I hope that we can muster enough support to get these people out of office and turn things around.

Ann is wondering if recess appointments in general are permissible the way they are practiced today. An argument has been made in the past that a recess appointment is only permissible if a vacancy occurs while the Senate is in recess. But nearly 200 years of precedent certainly runs counter to that argument.

Don’t stone me over this, folks, but I kind of see Obama’s point. Will this be how we do things from now on when the presidency and Congress are not in the same party’s hands? In other words, will a President’s ability to make recess appointments go out the window? I get that, originally, a recess appointment was intended as an emergency measure for when officers needed to be appointed while Congress was away and couldn’t convene. But it’s no longer that – it’s now used by presidents of both parties to appoint individuals who would otherwise not be confirmed. Again, nothing wrong with that from a constitutional standpoint, but in terms of who is right and who is wrong, it’s not nearly so black and white.

Between now and November, there will be some sort of event that Barry will use to a) impose martial law and b) suspend the elections.

It won’t matter who the Republicans nominate.

ah, yes – a year before the 2008 election i used to hear the exact same theory on left-wing sites except it was bush suspending elections instead of obama.
