Energy Committee to consider contempt citation against White House for Solyndra stonewalling

What all present White House scandals have in common: An utter lack of transparency, thanks in part to MSM whitewashing and in part to stonewalling of Congressional investigations by the administration. House legislators are as tired of the latter as conservative new media journos are of the former.

In fact, legislators on the House Energy and Commerce Committee are so tired of the administration’s lack of cooperation that they might sue the White House. For months, the Energy Committee has attempted to investigate the circumstances in which the federal government made a $535 million loan to the now-bankrupt solar company Solyndra. But, predictably, the administration has complied with congressional requests by granting the committee the bare minimum access to information. Now, the Committee might vote on a contempt citation against the White House — and, failing its enforcement, might even file a civil lawsuit against the chiefs of staff of the president and veep.

FoxNews.com reports:

Sources told Fox News an official from the White House counsel’s office was to confer with committee investigators by telephone on Friday, but that no agreement on the outstanding documents and interviewees was expected.

For that reason, lawmakers on the panel are considering holding hearings — first at the subcommittee level, then for the full committee — to vote on a contempt citation against the White House. Experts said that if such an event were to come to pass, the full House, which is controlled by the Republicans, would have to vote on the citation. If that in turn were to happen, the House would officially refer the matter to the U.S. Attorney for the District of Columbia for enforcement against the White House.

However, since the U.S. attorney for the capital, Ronald C. Machen Jr., is an Obama political appointee, committee Republicans are not optimistic that he would vigorously pursue a contempt citation against the White House.

In that event, committee staffers have explored the prospect of filing a civil lawsuit against William Daley and Bruce Reed, the respective chiefs of staff for the president and Vice President Biden.

Committee Chairman Fred Upton (R-Mich.) says he expects these measures won’t be necessary because he still thinks the White House will cooperate with the investigation, but a WH spokesman suggested to FOX that he thinks the investigation is a waste of taxpayer time and money because the decision to loan money to Solyndra was clearly a “merit-based” one.

My thought: If that is truly the case, what is the harm in complying with congressional requests to clear the air and quickly move past this? In both Fast and Furious and Solyndragate, I’ve been almost as disturbed by the administration’s callous dismissals of concern as by the initial allegations. Don’t these people know they work for us and that we could fire them as soon as November 2012?

Ha! To make matters worse, it wasn’t a loan, it was a grant. And Chicago is the perfect place for solar energy what with its warm, sunny climate. Oh wait! We all know what this is – make work jobs – which have already been given billions under the so-called “Stimulus”. Remember the weather-stripping boondoggle? The announcement comes from the U.S. Dept. of Energy as part of the Sunshot Initiative Rooftop Solar Challenge.

The city and its solar development partners will begin several projects over the next 12 months.

Some goals include developing solar-ready building standards, developing solar installer certification and a code official training program.

The Solyndra debacle is the gift that keeps on giving.

Unless you’re Jonathan Silver, former head of the DOE loan program. Or unless you’re Brian Harrison, the former CEO of Solyndra currently under investigation by Congress, the FBI and probably several other investigative organizations.

But if you’re on the House Committee of Energy and Commerce — Solyndra really provides a reason to get up out of bed. It is also managing to keep journalists busy.

Anyway — I hope congressional staff members have a lot of reading time on their hands.

The House Committee on Energy and Commerce has just requested pretty much the entire document file for every loan guarantee under the DOE’s 1705 program including independent due diligence, audited financial statements, etc. Here’s a link to download the letter.

Realize that Solyndra was just one of about 40 loans and loan guarantees issues by the department spanning solar photovoltaics, concentrated solar power, wind farms, and biofuels.

Here’s a list of just the solar loan guarantee recipients, followed by the letter from the Committee to DOE Secretary Chu.

In direct violation of Federal Acquisition Regulations (the bolded part). As such, the agreement they signed should be null and void, the US should retain first rights to any proceeds from the bankruptcy, and the officials who signed that agreement in violation of the FARs should, at a minimum, be disciplined, re-trained, and re-assigned.

The fact that the administration officials approved deals in direct violation of the FARs is sufficient reason for the House Oversight Committee to demand full and complete disclosure.

Too bad We the People don’t have a group that files lawsuits against the actual people who are making these ‘merit based’ decisions. Why do we even have a D of Homeland Sec? We’ve already got an FBI and a CIA. Repeal the Patriot Act, and get rid of the alphabets. TSA should be run by the private sector. Maybe some sanity could be returned to passenger screenings.

Just so the record is straight, the referenced article and quotations refers to investigations into how the 2004 elections might be delayed legally if there were to be a terrorist attack right before the elections.

Of course, Del and the World Socialist web site conveniently omit this fact. Doesn’t fit the BusHitler narrative.

Tina – there’s a simple phrase to explain the actions & thoughts of the Obama misAdministration……BUNKER MENTALITY.

Obama and his legion of appointees and czars are hunkered down in their foxholes and bunkers, cringeing at the artillery barrage that is coming down on them that is a direct result of their disastrous policies and regulations.

I’m concerned that in these last months of Obama’s doomed presidency, he & his soulless amoral corrupt fascist minions will concoct a Reichstag Fire v2.0 as a way to eliminate the 2012 elections and thus cling to power.

Even if we somehow get through the November 2012 elections unscathed, we will still need crowbars & teargas in mid-January 2013 to pry Obama out of his Wolfschanze our White House and the rest of the scum out of assorted other US Gummint buildings.

If you have to ‘consider’ a contempt citation by now . . . . it ain’t gonna happen. One should have been issued weeks ago. Just shows me that Congress wants to be slow rolled and lied to over time. Beats dispensing with the side shows all too quickly and getting on with dealing with the debt monster that lurks over virtually everything.
