Lawyer for Cain’s accuser: On second thought, she’d rather not relive this publicly

Bennett said his client sees “no value” in revisiting the issue now, but “stands by the complaint that she made.”

Bennett said his client would disagree with Cain’s characterization of the alleged harassment incidents.

He confirmed that the alleged harassment occurred in 1999 over a period of “at least a month or two.” There was “more than one incident,” he said.

And here’s the key part of the statement from the NRA:

“Based upon the information currently available, we can confirm that more than a decade ago, in July 1999, Mr. Bennett’s client filed a formal internal complaint, in accordance with the Association’s existing policies prohibiting discrimination and harassment. Mr. Herman Cain disputed the allegations in the complaint. The Association and Mr. Bennett’s client subsequently entered into an agreement to resolve the matter, without any admission of liability. Mr. Cain was not a party to that agreement. The agreement contains mutual confidentiality obligations. Notwithstanding the Association’s ongoing policy of maintaining the privacy of all personnel matters, we have advised Mr. Bennett that we are willing to waive the confidentiality of this matter and permit Mr. Bennett’s client to comment. As indicated in Mr. Bennett’s statement, his client prefers not to be further involved with this matter and we will respect her decision.

Does that waiver apply only to today’s statement or is it a general waiver that would allow her to speak if she changes her mind down the road? Because if he’s the nominee, the left will be keenly interested in hearing from her, especially now that the promise of multiple incidents has been dangled in front of them. And the worse the economy looks, the keener that interest will be. There is, or was, potential for this to hurt him among GOP primary voters too, but unless something more specific than gossip like this drops, that potential’s gone now. WaPo’s new poll, conducted after the Politico story broke, finds him still neck and neck with Romney, with 70 percent saying the allegations won’t matter to their vote. There’s room for that to change — 37 percent of Republicans polled called the charges a “serious matter” — but it’s 4:45 p.m. ET on Friday as I write this and, after a full week of accusations, we still have yet to hear a single credible detailed account of what happened between him and the accusers. Hard to believe anyone’s vote is changing based on that.

Here’s CBS’s report on the settlement agreement that was signed between the NRA and one of the accusers in September 1999 (yes, 9/99). Cain himself didn’t sign, and had actually left the NRA in June of that year; it’s unclear if the woman filed the complaint before or after he departed. CBS points to that as evidence that Cain really might not have known about the settlement, as he first asserted earlier this week. Could be, but he did find out about the underlying accusations at some point: Remember, he told Richard Miniter that he mentioned them to Curt Anderson back in 2003 when he was a Senate candidate. Ah well. Maybe the timeline will be clarified in one of Politico’s next 90 stories about this.

Update: Jim Geraghty summarizes the argument from the accuser’s lawyer thusly: “I won’t say what he did, but trust me, he’s guilty of wrongdoing.”

Update: Interesting question from Nate Silver. Cain’s numbers probably won’t shrink because of this, but will the way the campaign handled things create a ceiling on his support?

Pretty much a done deal here – he’s clear now of one of these allegations and you could say he’s “bullet proof” on it if it comes up in the General.

This ALL we anti-cainistas wanted – was for the confidentiality agreement to be lifted so the woman could talk. It was offered to be lifted – and she declined. You can now conclude with cold dead certainty that this one case is baseless – as Cain said.

There is STILL one case out there. They need to handle it the exact same way. Give the women a chance to talk NOW – if they won’t – then there’s nothing there and you can bank that Cain won’t face this in a general election should he be the nominee.

You are correct – but don’t forget there is still one woman out there who filed a complaint that we haven’t heard from. She needs to be offered the same waiver of the confidentiality agreement. If they do this and she doesn’t want to talk – case closed on this and the cloud is lifted off Cain.

I read here that Cain left in June 1999, she filed the complaint in July 1999 and settled in Sept 1999.

This is why I have not been too worried about this “scandal”. Given the opportunity to speak, the “victim” won’t air her grievances, not even to an obviously sympathetic media.

The Cain train rolls on, and all the haters can wail and gnash their teeth in futility.

This is what happens when people trust the media only slightly more than they trust their own government. We are in the process of completely re-making how our government works for us, and our media is doing it’s best to impede that. This cannot go on forever because it is so obvious.

No egg on this face – I have argued from the beginning that the confidentiality agreements had to be lifted in order for Cain to be cleared here.

This one was and he’s cleared. There’s still one more complaint out there – though I suspect it will go the same way.

Truth lady – that’s all I wanted – because I don’t trust Cain’s word alone – especially since he had such a hard time being consistent about this.

I’m satisfied on this one charge. There’s one more – and hopefully this gets put to bed soon too.

Show me a post where I said Cain was guilty? Show me one.

I did say Cain was an inexperienced clueless clown and his stories changed so much there was no reason to trust his word on this alone.

He’s still a loser … and he’s not going to be the nominee of the party. People forget that Cain has a gaffe every 5 minutes – so when this is off the plate – he’ll be back to pontificating about opening diplomatic relations with Taiwan or being Pro-Choice at the same time he’s 100 percent pro-life.

All I ever wanted was for this to be resolved in a manner that it couldn’t come back on the GOP in the general. Either it was true – and we nominate Cain – or it was proven false – and Obama couldn’t hit him with it.

One of the charges now – he’s clear of in my book. I have the right to conclude that don’t I?

The NRA statement only references 1 complaint/1 settlement not two.. Who said there were two? An anonymous source close to the “offended” anonymous source and the witness to the “offense”, Mr. Wilson (who works for the Perry camp)…

Cain said he did not harass anyone.. he related an incident involving a hand gesture comparing the poor victim to the height of his wife… Cain said that there was no other “incident” that he was aware of. Either produce the second victim or give Cain the benefit of the doubt that it never happened.. except in the mind of some anonymous source.

This was a hatchet job of the highest order. I’ve said many times before, that Republicans do not simply run against their democrat opponents. They have to run against the media, the unions, their special interest groups and all the dishonest liberal bloggers out there.

The media is doing exactly what they always do…extending a hand to the democrats. Now Politico and other outlets can go back to Obama and say “look what we did for you! How about an interview?”

The worst part is, that some on our side fall for this stuff every time. Democrats stick together, our side gets wobbly knew when the media reports one of “our own” farted in a bistro. Pull your heads out and stop letting the media run the election.

Her problem is that whatever Cain said/did is going to be in her complaint with the NRA. The time for her to give an election year embellishment to her story is loooong past, because the details are there, in writing. Since we’ve heard none of the details, it isn’t hard to imagine they were along the lines of “You look nice today. Do you have a boyfriend?” And now we learn that she didn’t even file a complain until after Cain left the NRA, so there could have been no claim that she was worried about her job. It looks like they didn’t think this would get as big as it did, and now they know that the actual story is just not going to match the media hysteria it has caused.

Dear Mr Cain,

Get any and all info out now. care about this country and ABO winning the election. If there is anything to this you can bet that A) leaders at the NRA will change(count on the O admin to force this) before the election and JUST LIKE HOW O got his Senate seat, documents will be made available to the press. They will do this 4 weeks in front of the election so that there is no recovery time B) the lady, or ladies will be found by the O campaign and money will be made available to them that will soften any fines for breaking the agreement. They probably have already been offered money or their lawyer suggested it to them -that they would reap more money later if they keep quiet, for now, so that if their story is needed, ie you get the nomination, they can do max damage right before the election.

Of course she can. She made career-ending allegations against a conservative. She deserves her privacy.

It’s not like she asked a question of a Presidential candidate and got this response: “and I think when you spread the wealth around, it’s good for everybody.”

Doing THAT deserves full media scrutiny and judgement. Darn plumbers. The scourge of society.

Very shameful and embarrassing, indeed. I was on the Cain train when WAPO hit Perry with that stupid five page article trying to portray him as a racist, with not a shred of evidence other than the fact that Perry and his family actually righted a wrong.

Perry was not my preferred candidate, but I defended him on Wapo, Politico and other places in the comments section.

Should we not be sticking together when the media does this? Who here DOESN’T know this is what the liberal media does?

I’m reminded of when the LA Times ran their groping stories about Arnold about a week before the election in CA. Pretty much everyone then recognized it for the hatchet job that it was and gave it all the credence it deserved.

None of this is going to hurt Cain with his supporters. If anything it’s galvanizing their support due to the unfairness of it all. Hell, I’m not supporting him and it pisses me off.

What this is really hurting is the Republican party because it’s put everyone at each others throats. Politico has uncovered the big chink in the armor that all media outlets will look to exploit for the next year.

At this point I think every candidate needs to go on record that they will support the eventual Republican nominee, whoever that may be, and rule out any 3rd party challenges. Make it crystal clear that while we may not like each other, we will be united in the need to defeat Obama.

The agreement contains mutual confidentiality obligations.

Something I’m not sure I’ve heard addressed yet is that if Cain wasn’t party to the contract – only NRA and the woman who filed the complaint and her attorney – and NRA wasn’t the source of the leak, then the woman and/or her attorney are the source and have violated the agreement.

*Those* people need to be on the receiving end of a lawsuit.
