Palin threatens to sue publisher over new McGinniss book

I understand wanting to hit back at such a nasty book but there’s a reason why celebrities rarely sue tabloids.

“Random House is at the top of the food chain and published a book based upon acknowledged unsubstantiated gossip,” the source said. “The revealing email is key as evidence of this defamatory approach to politics through proxies.”…

Palin’s attorney continues, writing it is “malicious” for Crown to publish the book when they have proof McGinniss and Crown “were fully aware the statements in the book were false, intended to be false, and were intended to harm.”

“The final work that was published contains most of the stories that Mr. McGinniss complains were nothing more than ‘tawdry gossip’ that amounted to the wishful fantasies of disturbed individuals,” Tiemessen writes. “Since both your company, and the author, clearly knew the statements were false, admitted they had no basis in fact or reality, but decided to publish in order to harm Governor Palin’s family, you and Mr. McGinniss have defamed the Palins.”

Tiemessen ends the letter by warning the publishing house not to “delete e mails or destroy records” that may be used in the suit.

Big Government has a copy of the letter. Note the passage at the end suggesting that McGinniss might have inadvertently waived the attorney-client privilege with Random House’s lawyers by alluding in a conversation with a third party to advice they had given him.

If you haven’t already, you need to read two of Andrew Breitbart’s posts from last week to understand the basis of the claim. The first revealed an e-mail McGinniss had sent to an anti-Palin blogger back in January of this year listing six different gossipy allegations about the Palins and acknowledging that “[n]o one has ever provided factual evidence” that they were true. (McGinniss later confirmed that the e-mail is authentic.) The second was Breitbart’s attempt to cross-check those six gossipy claims against McGinniss’s book and show that not only did five of them make it into the final draft, but virtually all of the info McGinniss relied on to support those claims was obtained before January 2011 — which would mean that he still doubted their veracity after his research was more or less complete. Why is all that important? Because: It’s very hard for someone as famous as Palin to prove defamation under the First Amendment. Reporting that’s merely sloppy or negligent in its handling of the facts isn’t enough to create legal liability; if you’re a “public figure,” you need to show “actual malice,” i.e. that the reporter either knew that his report was false or that he published his report with reckless disregard as to whether it was false or not. Hence the importance of the e-mail that Breitbart posted: It’s potential evidence that McGinniss knew he was pushing nonsense and did it anyway.

McGinniss, of course, says there’s less here than meets the eye:

My email to Jesse Griffin was an effort to secure Alaskan help in obtaining further corroboration of allegations about Sarah Palin that came to my attention during my research. My reporting continued beyond the date of the email, and only information that checked out to my satisfaction and that of my publisher was included in the book. Ultimately, I published only those allegations which I found to be credible. Other allegations that could not be sufficiently verified, including some of those referenced in my email, are not in my book.

That’s what the trial would be about, then, if it got that far — how much of what made it into the book was based on stuff McGinniss discovered after that e-mail was sent? It’s possible that he corroborated all five allegations with solid evidence after January 2011, but that would be quite an investigative windfall in a short span of time after having dug for months in 2010 and found nothing. In fact, McGinniss told Dave Weigel a few weeks ago that he excluded 90 percent of the gossip he heard about the Palins from the book because he couldn’t confirm it. Sounds like the allegations in the e-mail were in that group — until suddenly they weren’t. How come?

Another question. Even if she might have a case — and “might” is really the most hopeful estimate given the high bar you need to clear to prove defamation — is it worth pursuing this? I understand the visceral pleasure of punishing a guy who went on a fishing expedition for smears, and there’s value in casting doubt on the book’s claims by threatening a suit even if you don’t follow through. But here’s the thing: The book’s a bust thus far, both financially and critically. Not only did the Times pan it, even Keith Olbermann felt obliged to defend Palin on it. A court battle would kick up free publicity for Random House (“read the book that’s making Sarah Palin sweat!” or whatever) and attract curiosity-seekers, which is precisely why celebs tend to ignore tabloid stories about them rather than sue. And there’s another risk. If she sued and Random House won on grounds that the book’s claims, while false, were the product of merely negligent reporting rather than actual malice, the headlines the next day would read, “Random House wins Palin suit,” etc. Anyone who glanced at those headlines without reading the story might deduce that Palin had lost because the claims had been proved true, not because they were false but had merely failed to rise to the constitutional level of liability for falsehoods. Maybe she’s simply looking for an apology from Random House and would drop the claim if they gave her that?

Just got off on the phone with a friend in the legal field and she says that a potential lawsuit against Random House by anyone of the Palin family involved in the “trash book” will most likely be quietly settled out of court because the idiot McGinniss opened up Random House to a whole lot of trouble and gives the Palin’s an upper hand and GIFT in Court because McGinniss waived attorney client privileged between him and RH by talking about it to a third party (Jesse Griffin) and thus Palin’s lawyers are entitled to ALL correspondence from Random House concerning the book.

My friend say that Random House may have a lot of leftists there and may hate Sarah Palin with a passion but its pure suicide for them legally to open up their correspondences in the “discovery phase”….they may have more damning info in those correspondence that was meant only for “Random House Eye’s Only”.

She said Random House and Jon Meachem may do a kabuki dance in the public defending the book and its “sourcing” on these false allegation but behind the scenes they will most likely quickly call for a settlement before the case got to discovery phase or even before the case is brought forth.

Legally, The Palin family has Random House and Joe McGinniss is a terrible legal bind.

A 4-year degree isn’t for everyone, especially on your timeline. She probably makes more per episode than most recent graduates make in a year, if they have a job. I believe she started college courses, she can always go back or for that matter, how do you know she isn’t taking classes right now?

It proves that people have staying power and the discipline to get all that research and homework done, in time, or just in time.

Too much emphasis is given to degrees and too little respect granted to the professionals, who do well, but have not gotten one. One should encourage it, but not knock those who don’t have one. A certification for a well-paying profession should also be encouraged and respected (not talking about Bristol – she can do whatever she pleases).

One last thought, no one can ever take the degree away from one’s ‘pocket’, nor the stupidity from one’s head.

He is a rotten presenter, very nervous, fidgets, uncomfortable.

Palin has violated the first law of litigation. Never threaten a lawsuit — file one along with subpoenas for the documents you want. Since Mr. McGinniss is running a business, his e-mails are fair game.

That gives the opposition no time to tidy up. It’s what I did with Ford, and it took Ford less than a day to settle after the suit was filed.

Perry got his 1st term free, because of Bush leaving to be President.
He won his 3rd term because his opponents weren’t that great and he barely won (by 51%).
To say that the Governor of TX is a figurehead wouldn’t be an understatement.

with the candidates as it shows who has been successful in
raising money and who hasn’t in the last quarter. Successful
fundraising usually shows vibrancy and competitiveness in
campaigns; unsuccessful fundraising generally is a warning sign
that a campaign is flagging and not generating momentum.
Look for the story next week in this regard to focus on the
presidential candidates, i.e. is President Obama on schedule to
raise $1 billion this cycle or has his donor base hit a bump? Has
Rick Perry’s rise in Republican primary polls been accompanied
by equal momentum in fundraising or does Mitt Romney still
have an edge there? These reports are also watched by major
donors who have not yet picked a candidate since they are
more drawn to a candidate perceived to have momentum.
Many political obituaries are written after these quarterly
reporting periods, and this one will be no different.

This letter isn’t a threat, it is more of a notice to stop any innocent destruction of records. Suits are typically filed after such letters.

Palin’s celebrity status makes libel and defamation claims harder to establish, but NOT impossible. Writers and newspapers have pushed this to the limit over the years, but it does appear it has been exceeded here. McGinniss’ email alone establishes a reckless disregard for the truth, it would be up to the defense to establish confirmation. And it is also close to actual malice, given Griffin’s history as well. Discovery would likely provide more ammo, and if privilege is ultimately held to be waived (which the alleged conduct of discussing the advice with third parties, if true, would accomplish) then the legal department AND counsel of record are all discoverable on those points.

This is a serious case. Winning often depends upon the jury, but they can come in with big numbers when plaintiffs win. In the meantime, the publisher’s reputation is damaged with every notice of the trial in the press, and other potential litigants encouraged to try their hand.

Random House and Bertelsmann have a lot to lose.

Because of the McGinnis email virtually admitting he was publishing unsubstantiated rumor, and because of his evident malice toward the Palins, a suit if brought has a very real chance of overcoming the high threshhold of proving libel and defamation against a public figure. Random House has a lot to lose.

If they are smart, they will pull the book, apologize, and offer to settle out of court.

If not, the Palin family should definitely proceed with a lawsuit, beginning with a subpoena for every scrap of correspondence between McGinnis and the publisher, and then for all of his research notes and records.

Assuming all of the claims really are bogus and false, it would be nice to see this sleazeball McGinnis and the unscrupulous publisher hung up by their own petard. /Mr Lynn

I’m curious as to when did so many Conservatves become sissies? When did the mindset of “we have to be more milktoast in order to appeal to Independents” set in – after the semi-RINO McCain couldn’t pander enough to win?

The attacks on her and her family is unprecedented…it was the worst of the worst.
Her ability to withstand that, and her family to do the same, is a tribute to how strong of a woman Palin is…nobody could have withstood more pain and anguish…imagine a number one rated talk show host calling for the raping of your daughter, it boggles the mind, and then it was defended.
Palin’s other attributes are she talks to the people, and that drives people nuts. Voters expect and elect “professional politicians”, that is why we are in the mess we are…like a battered woman, they keep going back to the same “man”.
Time to wise up, unfortunately, Palin has become one of those politicians, or she is wisely staying out of the fray and will be content to be a power broker.
If she stays out, she will be the one that can deliver whatever votes are needed to push a candidate to the top.
I am hoping that Cain continues to pick up momentum…he is one that I think Sarah Palin would like to see chosen, there philosophies, their histories, their background, their goals match up better than any other candidate.
Ideally, Cain with a strong VP, Sarah as a major cabinet member…Dept. of the Interior, with the EPA & energy rolled into that…Mitt Secretary of labor/commerce/…Newt, Santorum, Bachmann…what I would like to see is many of the candidates actually be given high ranking jobs…we have a great field of candidates.

About the problem that college grads are supposed to face . . . my niece when she graduates next year is already looking forward to a 6 figure salary. Why? Because she worked hard and is being highly recruited.

I was the first one in my family on both sides to get a college degree. I would never put down anyone seeking a college degree. I encourage others to do so.

I have mixed thoughts on the political wisdom of a law suit. I have no qualms with someone fighting back. The Progressives can win only if the Conservatives roll over. The Progressives’ game plan is based on the Conservatives’ unwillingness to engage in their warfare.

Alinsky’s Rules For Radicals is mentioned here often, but I’m not too sure that some of you give them much thought. You don’t need to read the book, just look at the enumerated rules. That’s all you need to know to understand the left’s battle plan. That’s all they’ve got. In our day-to-day lives, most of us have learned to pick our battles. Usually, if it’s not going to affect us personally, either morally or financially, we tend to walk away from battles. What the Progressives are doing goes well beyond that. They are confident they can win because historically the Right won’t engage them and fight back. Palin’s not made that way, and you should be damned thankful that she’s not.

Along comes someone like Palin who lives by the creed, “Don’t retreat, reload” and she’s accused of being thin-skinned. Whether you support Palin as a prospective candidate for POTUS or not, you should separate your political opinion of her from your opinion of her as someone who will take the fight to them.

The Left, and some on the right, have tried every tactic to destroy her and convince her to sit down and shut up. It ain’t working folks. Her easiest road would have been to give a few speeches for pay, write a book every once in a while, and sit back and enjoy her freedom. Imo, the best thing that could happen for the Left is for her to run and fail, but only by degrees. If she chooses not to run, she will only become a greater nightmare for the political class.

For those of you who seem to think your role at HA is to launch verbal attacks on Palin or her supporters, it’s time you grow up and knock it off. She’s on your team whether you accept it or not. If you support someone else for POTUS, that’s great, but using space here to attack her or her supporters only make you look foolish and juvenile.

The fact that many people can’t grasp…when you are in a position of leadership, and make literally thousands of decisions…some are wrong, just plain wrong.
Nobody is perfect, and over the years if one wants to, they can isolate decisions, pick them apart, tie them to other decisions (sometimes years apart), and create a common thread that looks “ominous”.
The MSM is great at that, and I am constantly amazed how easy it is to manipulate people through a press that they distrust.

With the amount of time spent socializing (getting drunk, sleeping around, being fools) and the liberal agenda being pushed as ‘education’ as well as in ‘action groups’ on campus, I hold college degrees in much lower esteem than I did in the past. Post-grad work even less. I dated a girl in a doctorate program whose best friend was kicked out because she was pursuing research that went against one of the advisors own research. It had all the trappings of a clique of high school girls and the diploma was just an acknowledgment that the mean girls still liked you.

Some of the hard sciences (engineering, mathematics, etc) aren’t so bad, but the arts (including literature and its cousins), social sciences, phychology, philosophy, etc are all too often a lot of fluff mixed in with an agenda and the degree is of little real value except it may get you a better paycheck than someone with skads more common sense and life experience (which is unfortunate).

A lawsuit takes a long time to prosecute. This is only the opening salvo: a demand letter. And that’s what it is. If Random House is smart, they’ll settle quietly, if they’re allowed.

Some of the posters here seem to think that you can’t be involved in a lawsuit and run for president. Well, you can. That’s what your lawyers are for. And Sarah Palin, like most strong women, can multitask till the sun goes down. It’s not impossible. It’s the status quo.

Remember, Sarah has said, in essence, “I’m not going to sit down and shut up.” So, IOW, quit telling her to.

For the Palins, suing Random House and McGuiness would be a game of real-life Whack-A-Mole. Why waste time and resources going after bottom-feeding trolls? Character assassins like these want a response, they want to know they’ve hurt the target. Ignore them and move on. If she’s going for the big brass ring, Sarah Palin needs to avoid punching down, fighting below her class.

A while back, Palin made some disparaging remarks about Kathy Griffin, the standup comedian who used Levi ‘Johnny Hollywood’ Johnson as a prop on one of her shows. Palin’s comments were gold to Griffin, drawing attention to her act and giving Griffin greater credibility among her Hollywood peers. Same thing here, with McGuiness.
