DHS to halt deportation proceedings on case-by-case basis

The Department of Homeland Security today announced new rules that will allow the DHS to halt deportation proceedings against illegal immigrants who meet certain criteria, from attending school to having family in the military to bearing primary responsibility for other family members’ care. The Washington Times reports:

Homeland Security Secretary Janet Napolitano said her department and the Justice Department will review all ongoing cases and see who meets the new criteria on a case-by-case basis.

“This case-by-case approach will enhance public safety,” she said. “Immigration judges will be able to more swiftly adjudicate high priority cases, such as those involving convicted felons.”

The new rules apply to those who have been apprehended and are in deportation proceedings, but have not been officially ordered out of the country by a judge. Miss Napolitano said a working group will try to come up with “guidance on how to provide for appropriate discretionary consideration” for “compelling cases” in those instances where someone has already been ordered deported.

It was unclear how many people might be affected by the new rules, though in fiscal year 2010 the government deported nearly 200,000 illegal immigrants who it said did not have criminal records.

Deportation is messy and ugly — who, for example, wants to advocate to separate illegal immigrant students, many of whom didn’t enter the country illegally of their own volition, from their families? But these new rules are entirely inappropriate, as they usurp Congress’ legislative authority. Dan Stein, president of the Federation for American Immigration Reform and quoted in the WT article, said it best: “Supporters of comprehensive and targeted amnesties for illegal aliens have consistently failed to win approval by Congress or gain support from the American public. Having failed in the legislative process, the Obama administration has simply decided to usurp Congress’ constitutional authority and implement an amnesty program for millions of illegal aliens.” This isn’t a new trend for the Obama administration, of course (DISCLOSE and DREAM, anyone?), but that only makes it that much more troubling.

Furthermore, as so often happens whenever the federal government attempts to address illegal immigration, the rules ignore the fundamental importance of the rule of law to a democratic republic like the United States. The deportation of every illegal immigrant in the nation at this moment might not be a realistic or even advisable solution to the problem of illegal immigration, but to halt deportation proceedings even on a case-by-case basis sends a message that is disquietingly similar to the message amnesty sends — that the executive branch doesn’t take seriously its responsibility to uphold the law as it is.

Congress needs to get these laws changed so that discretion is removed from the equation.

Because all this discretion is turning into bias, favoritism and seeking to remove the equal application of law to all, with favor towards none. When that is gone, then it is just a question of what sort of dictatorship you get… you WILL get one.

Just wait until the DEA with DOJ get a order from above not to not charge any more federal drug crimes and set up a new criteria that will be issued on a case by case basis if they will be charged with illegal activity at the federal level or not.

With the order also being retroactively to all persons currently incarcerated to find out the that federal drug crime was warranted with the new criteria to charge and prosecute. If they are found not to meet the criteria then step will be taken to have the person released of the federal drug crime as time served.

It is NOTHING like the generous version of the US.

I have less of a problem with this as the end result will be a fast tracking of deportation for criminals and nuisance Illegals. We don’t have the judges, facilities, or adaptability to even have a hope and a prayer of deporting illegals quickly and efficiently. Why not make these cases lower priority in order to push out scum faster?

First of all … perhaps the first question you should ask is … “Why is my government giving out any benefits to people who aren’t productive?”

People take advantage of their advantages – you can hardly fault them for that. Some illegals come across the border and work very hard – hoping for opportunity – I’ve personally seen these guys at work after Hurricane Katrina – they were key in rebuilding New Orleans.

I actually LIKE those illegals – a lot more than some guy drawing welfare who sits on his couch all day and plays X-Box.

Other illegals come here for the free benefits. Would they come if we didn’t have those benefits? Perhaps the question you should really be asking is “Why do no-loads in the country get any benefits?”

Illegals don’t “magically” produce benefits for themselves – we give them to them. But – we also give them to a lot of other people who don’t deserve them. You can “kill” two birds with one stone by just ending Federal entitlement programs.

This actually carries a little political risk. As
dereliction of duty goes, refusal to enforce DOMA isn’t important to the people. But, refusal to enforce immigration law? Both are impeachable derelictions. If the people agitate for enforcement of immigration law, then the House might become emboldened. And does a Democratic Senate really want to go down with this ship if the people want their Obamoid scraped off early.

Regardless of the charge(s), if O gets tossed it will be because of the lousy economy and the people just wanting to be rid of him. Same thing as Clinton only in reverse, the people didn’t then want to rock the boat during good times even though he was obviously guilty of purjury and had finger wag lied to our faces.

It’s hard to believe this could happen to the first black President, but people unaccustomed to it are being forced to cut back substantially and they’re figuring out it’s because of him and his promotion of Big Government.

Very simple, the anchor baby(ies) leave the country with their parents. When the parents can enter LEGALLY, their kid(s) can return. If their parents can’t, their kid(s) can return when they reach the age of 18.

Amnesty was wrongly granted in 1986 and made the problem worse. Granting another one would officially make the U.S. a third world country.

Hey, guess what – when parents break the law, being a parent doesn’t absolve them from punishment for any other crime – why should it absolve them on this one?

For what other crime is this line of ‘reasoning’ used? Murder? Rape? Bank robbery? Assault? Drugs? Fraud? Embezzlement? Pick one, and then use the “you can’t send them to jail and separate their innocent kids from their parents/families!” argument – go ahead, we’ll wait.

Very simple, the anchor baby(ies) leave the country with their parents. When the parents can enter LEGALLY, their kid(s) can return. If their parents can’t, their kid(s) can return when they reach the age of 18.

Amnesty was wrongly granted in 1986 and made the problem worse. Granting another one would officially make the U.S. a third world country.

As this ludicrous order of Presidential decree, whereby immigration scofflaws are all, in fact, criminals in their own right and therefore fall into the category of ‘criminals get deported first’ even by this latest decree, gets hotter by the minute, I imagine President Barack Hussein Obama and his administration have long already prepared his and their responses and talking points. Among them look for ‘The Tea Party made me do it‘. That or some variations thereof should eventually rank right up there somewhere near the top. After all, if you object to amnesty for scofflaw criminal Illegal Immigrants be it via backdoor amnesty by presidential decree or Congressional legislation, you are positively and without a doubt a bigot and ‘anti-human rights’.

BHO and the Democrats would never let such a perfectly good opportunity to further vilify the Tea Party and conservatives in general pass them by.

Sorry, Tina, but this kind of mushy-headed thinking from the heart, rather than using the mind, would dictate that any criminal who has children can’t go to prison. We wouldn’t want to “punish the children”, would we?

Deportation of parents doesn’t separate the family — parents can always take their children with them to their home country. Only a heartless parent would abandon their children in a foreign country, right?

Just think — their children have had a great free education (scratch that – a mediocre education in most public schools) and now they get to go home with their parents and contribute to their home country’s economy, instead of draining ours.
