Allen West: We need a special prosecutor to investigate Holder’s role in Operation Fast and Furious

Via our Townhall cousin Katie Pavlich, who makes an important distinction that’s occasionally been overlooked in all the Gunrunner/Fast and Furious coverage. Namely, they’re not the same program. Gunrunner is the ATF’s umbrella operation for selling guns to straw purchasers and then immediately busting them; F&F is the op that let those purchasers walk them across the border, where they ended up in the possession of cartels. It is true that Holder acknowledged the existence of Gunrunner in a 2009 speech in Mexico, but as Mike Riggs of Reason points out, there’s no evidence — yet — that Holder authorized or even knew about Fast and Furious. To the contrary:

DOJ Spokesperson Tracy Schmaler said in an email today that it was inaccurate to conflate the two programs.

“Holder said he became aware of the ATF agents concerns about certain tactics used in Fast and Furious earlier this year. That’s when he asked the IG to investigate those concerns,” she emailed today. “That’s different than knowing there are enforcement efforts along the SW border to stop illegal gun trafficking. The department has several agencies working on those efforts including ATF, FBI, DEA, Marshals.”…

There’s also the word of Acting ATF Director Ken Melson, who told [the House Oversight Committee] last week that Holder had no knowledge of Fast and Furious. The entire transcript from that hearing has not been released, but according to the Washington Post, “people familiar with [the hearing] said that [Melson] indicated that Attorney General Eric H. Holder Jr. did not know about [Fast and Furious], that it would be unusual for other Justice Department officials in Washington to know the details and that the U.S. attorney’s office in Phoenix was overseeing the program.”

Verrry curious that the DOJ would be so reluctant to let Melson testify before Congress, in that case, but then that’s part of the reason for a special prosecutor. Why the curious reluctance? Katie makes an interesting point too: In his April 2009 Mexico speech mentioning Gunrunner, Holder referred to a “major new effort” the ATF had launched the week before to “break the backs of the cartels.” Was that an obscure reference to Fast and Furious? From what I can tell, the program didn’t launch until the fall of 2009, but Katie claims it started in April, which means it could be the program Holder was referring to.

Sure would be nice to have someone get to the bottom of this without the stonewalling that Issa has encountered. Meanwhile, here’s the feds’ attempt to do damage control: Gun shops in four border states will now be required to report multiple purchases of certain types of rifles in a five-day span. The ATF screwed up in Fast and Furious, and so now lawful gun buyers have to be tracked more closely. Okay then.

We already know that this operation crossed departments (Justice and Homeland Security) as well agencies within Justice (DEA, BATFE) and outside Justice (again Homeland Security — including ICE, Border Patrol), so clearly Holder, Napolitano and Obama all had to authorize these actions. Further, now that we know that guns were also channeled into Honduras as well as Mexico, the purpose behind all of this is clear too. That is, justify signing the UN Small Arms Treaty as well as to justify new US gun control laws. The plot here is really quite sinister. Obama, Holder and Napolitano must be held accountable — clearly that means impeachment for Obama and indictment for Holder and Napolitano.

Under the new policy, federal firearms licensees in Texas, California, Arizona and New Mexico must report purchases of two or more of some types of rifles by the same person in a five-day span.

There is NO statutory requirement for this and ATF lacks the legal authority under the Gun Control Act to implement such a “policy”.

Sounds like Barry’s “we’re working under the radar” is bearing fruit.

… Two American agents killings were linked to the operation, but just how many deaths, rapes, assaults, shattered lives of the innocent and family members of the dead are there to be counted because of this?

Actually it is a big deal. In VA if you buy a firearm you are not allowed to buy another for 30 days…

I can’t remember how many State/Federal databases are checked for a legal purchase (+7 checks as if I remember correctly).

That is all fine and good however weapons were being shipped to other countries illegally under the direction of Obama or his cabinet members.

Someone needs to answer for/get pardoned for that.

Look, Melson doesn’t know what Holder knew or didn’t know. It might be unusual for Holder to be aware of local BATFE ops, but this op was run by the DOJ through Dennis Burke, US Attorney in Phoenix and former Napolitano flunky. Melson claims he was himself unaware of the details, so how would he know who did know them?

And I agree with Pavlich 100% on Holder’s remarks. It doesn’t mean anything that he mentioned Gunrunner, but the veiled reference to a “major new effort” seems likely to be a reference to Fast and Furious.

But the main reason I think Holder is up to his elbows in this mess is the magnitude of the stonewalling. If Holder could have pawned this one off on subordinates he would have done it already. That US Attorney in Phoenix HAD to be getting his marching orders through Lanny Breuer, head of the Criminal Division. That is ONE STEP removed from Holder.

Right now, Burke is the key. But there may be other doors with other keys like Operation Castaway in Tampa, which apparently sent a couple of thousand guns to MS13 in Honduras.

Eventually someone in the know is going to realize their best interests lie in cooperating just like Melson did. When they do I’m still betting the path leads straight to the thoroughly incompetent and completely corrupt Eric Holder. Given the Burke-Napolitano connection, I wouldn’t be one bit surprised if she was behind this bloody travesty too.

Obama has made it clear how much he fears armed citizens, especially those domestic terroist who have armed forces training before returning to civilian life.

It has long been known that any attempt to invade our country would fail simply because they could not prevail over the armed American citizens who would fight them.

The same is true for a domestic invasion by anyone who tries to establish a dictatorship from within the government.

Obama is well aware of that fact as shown by his attacks on the citizens that have arms or military training to use them, i.e, those terroist on his domestic terroist list. We have seen repeated attempts by his administration to make the second admendment, along with the rest of the constitution irrelevent or superceded by other laws, notably the United Nation’s.

We now see the TSA, a federal government police force that answers only to Obama and it’s immuneity to the laws of state and federal governments as well as the constitution itself. Non compliance or resistance of any kind, to any demand they give, is an arrestable offense or effectively punishable as they desire without arrest or due process by being detained as long as they desire. Effectively it is social programing and conditioning to educate the public that they have to comply with the demands of the government. Is this the beginning of that citizen army that Obama needs and is building?

Holder can lie all he wants, but with Obama’s “Under the Radar” Gunwalker plan now including Operation Castaway and guns being funnelled into Honduras, this is going to be bigger than getting rid of Holder can solve.

Watergate was a break-in at DNC headquarters. Gunwalker is a Stimulus-funded multi-million dollar plan to strip Americans of their gun rights and fuel violence throughout Mexico and now Central America, possibly overthrowing the nation of Honduras to reinstall Manuel Zelaya.

Gunwalker’s gotten so big I think I may need heavier tinfoil.

So we’re to believe that someone at the ATF, without any senior authorisation, decided to allow thousands of American guns to flow across the border into a sovereign nation for the purpose of…? (There was no tracking involved, no way of following the guns once they were in Mexico to see whose hands they passed through)…and they did this without Eric Holder or someone in the highest echelons of the government knowing anything about it. Really?

We’re also supposed to believe that when the ATF whistleblowers came forward, Eric Holder and others at the highest levels of government found out for the first time about this insane plan to allow guns into the hands of criminals in another country- one of which was used to kill a Border Patrol agent– and instead of freaking out about this incredible abuse of power and affront to the chain of command they, instead of firing those responsible, set about obfuscating the details of the program to a Congressional inquiry?

Either the Obama administration had no idea about a rogue program involving hundreds of people to illegally let guns cross the border into another nation where they were used to kill dozens of people (guns that are now starting to appear back in the USA in the hands of criminals) which suggests to me a stunning level of incompetence or, worse, they permitted the program to go ahead regardless of the cost of life which displays a chilling disregard not only for the laws of the nation but for human life itself in the face of their political goals.

Either way, whoever was responsible for this program, whoever in authority knew about it and allowed it to continue, needs to not only be removed from their positions of power immediately but they need to be prosecuted for their role in the deaths of the Border Patrol agent, dozens of foreign nationals of what’s supposed to be an ally of the USA and the injury or death of anyone else who falls victim to these weapons as they are smuggled back across the border.

Personally I also think it’s thoroughly revolting that the majority of the press is not treating this scandal with the attention and outrage it deserves because the current occupant of the White House has a D after their name rather than an R. When the press does their best to ignore and underplay a story where government malice or incompetence led directly to the death of a law enforcement official doing his duty they have lost any vestige of credibility left to them.

How many have to die before the press does their duty and treats the Obama administration the way they would if Republicans were currently in charge?

Besides, what are the odds we’ll bet a good one? Very slim. Whatever special prosecutor this congress picks, will either be a Democrat hack who will turn the investigation towards Bush and the NRA or something, or he’ll be a really nice bumbling fool who will promise to bend over backwards to be nice, fair and friendly to all Democrats, for the good of the country, of course.

What would Republicans do if their special prosecutor to investigate the obvious? Hire another one?

The biggest problem is that the GOP leadership is so spineless that they won’t pull the trigger on any of these corruption charges and start anything other than hearings. The House should be doing everything they can to get these people out of their positions of power at the ATF, Dept. of Justice, EPA, HHS, Homeland Security, et al. But no, they are doing nothing but holding hearings here and there and nothing will happen.

We have to get rid of the current GOP leadership because they think this is a game and have no intention to do what is needed. They have been there too long and worry too much about being called names by the Dems and MSM.

To the contrary, I think there’s plenty of evidence he could not have been unaware. Consider the attendees at 2009 meeting about, not Gunrunner, but Fast and Furious:

The October 27, 2009 email from ATF Phoenix Field Division Special Agent in Charge (SAC) William Newell regarded a Southwest Border Strategy Group meeting that focused on Fast and Furious. It contained a laundry list of high ranking Justice Department officials that attended the meeting, including:

Assistant Attorney General (Criminal Division) Lanny Breuer,
Kenneth Melson, Acting Director, ATF
William Hoover, Acting Deputy Director, ATF
Michele Leonhart, Administrator, DEA
Robert Mueller, Director FBI

Four other Justice Department directors or their representatives came from the Organized Crime Drug Enforcement Task Force (OCDETF), Bureau of Prisons (BOP), U.S. Marshals Service (USMS), and the Executive Office for United States Attorneys (EOUSA). The chair of the Attorney Generals Advisory Committee (AGAC) also attended the session. Their names were redacted in the released document. U.S. attorneys for all four southwest border states also attended.

The Daily Beast seems to have the inside track on more Executive Orders, however, claiming recent conversations with administration officials. TDB says the upcoming Executive Orders will have more impact than what Fox outlines above, including:

“A national electronic system designed to make background checks for handgun buyers simpler and faster, leaving an electronic paper trail. [And] Tougher sentencing guidelines for straw buyers that Holder’s department pushed through procedural hoops at the U.S. Sentencing Commission earlier this year.”
