Does Durbin need a refresher course on the Constitution?

posted at 10:05 am on June 30, 2011 by Ed Morrissey

I never thought I’d long for the days of Robert Byrd and his “pocket Constitution,” but alas, Dick Durbin has managed to eke out that much nostalgia after his DREAM Act gaffe yesterday. Real Clear Politics and Doug Powers at the Boss Emeritus’ site caught this tender moment from Durbin as he addressed school-age “undocumented” aliens and promised that his DREAM Act would allow them to become tomorrow’s Congressmen, Senators, and … Presidents?

“When I look around this room, I see America’s future. Our doctors, our teachers, our nurses, our engineers, our scientists, our soldiers, our Congressman, our Senators and maybe our President.”

I know that reading the Constitution has fallen out of fashion on Capitol Hill; Democrats pitched a fit when the new Republican majority in the House wanted to start the 112th Session by reading it aloud. But Durbin might want to read Article II, Section 1 of the founding document, as it’s pretty clear on eligibility for the nation’s top executive position:

“No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.”

Durbin’s Constitutional illiteracy explains a lot, including his DREAM Act.

What’s a constitution?

txag92 on June 30, 2011 at 10:07 AM

Honestly Ed, all Liberals want us all to believe the Constitution is an out dated piece of paper with no purpose in our world today. This is why I believe Liberals are anti-American and therefore the enemy of a free people.

Durbin needs a jail cell. Between him and his corrupt buddies they’ve stolen billions from the taxpayer and laundered it through unions and various leftwing radical organizations to stuff their pockets and war chests.

darwin on June 30, 2011 at 10:11 AM

Durbin probably got his expertise from Time magazine’s managing editor, who wrote a cover story on the Constitution and claimed that it’s not law, and that it contains no limits on the power of the federal government.

This is the kind of mind-blowing ignorance and idiocy that passes for “progressive” intellectualism today.

SDarchitect on June 30, 2011 at 10:14 AM

Maybe Dick Durbin is actually inadvertently letting it be known he is behind a plan to help Mexico overthrow the United States. So it isn’t that he is constitutionally clueless, but that he is traitorous Dick instead.

thuja on June 30, 2011 at 10:24 AM

Speaking as a resident of the presently less-than-great state of Illinois, Dick Durbin is the ABSOLUTE WORST SENATOR WE HAVE EVER HAD!!!!!

This certified card-carrying assclown maroon has been a consistent bad joke since he has been in the Senate and he has been a continual source of embarrassment and ridicule for this state for a long time!

The problem is that each and every time this goof is up for re-election, people for whatever reason (most likely temporary insanity) vote him back into office like he is the greatest thing to hit the Senate since the invention of sliced bread!

I am sincerely hoping this latest bozo-bucket gaffe he made here comes back to haunt him the next time he is up for re-election, and maybe this time, people will have wised up to the fact that they’ve been taken for a ride by Durbin for far too long and they finally throw his rear end out of office!

Until then, mark what he said here as a true blue Face-Palm moment of epic proportion!

pilamaye on June 30, 2011 at 10:24 AM

Ugh – I don’t want to defend this idiot – but I suppose if he were referring to children of illegal aliens then perhaps they were born here thus making them anchor babies… and sadly US citizens. Or is the point of the Dream Act that the kids themselves are illegal aliens as well that “need help?” I am not familiar with the particulars of the legislation.

Warmongerer on June 30, 2011 at 10:28 AM

This man swore an oath to “uphold the Constitution” – and he doesn’t even know what it says. Let alone the Bill of Rights. Or the rest of the amendments to the Constitution.

He should be censured, if not asked to resign. But with King “Dirty” Harry Reid reigning over the Senate, fat chance.

Pathetic. Ignorant. Pandering. Leftist Democrat.

Durbin is absolutely correct. Indications are that people of Hispanic descent will be the majority in this country by 2050. Thereafter or before, enough people in the U.S. will be willing to amend the Constitution to allow for anyone to run for president and hold the office, regardless of where they were born. I don’t like it, but facts are facts.

Warmongerer on June 30, 2011 at 10:28 AM

The misnamed DREAM Act doesn’t apply to anchor babies, who are the American-born children of illegal aliens. It would apply to the foreign-born “children” (up to age 30, IIRC) who were brought into the U.S. illegally. (IOW, illegal alien kids and adults, not “natural born citizens” of the U.S. by any definition). The DREAM Act would allow these illegal alien “children” to obtain legal status and eventually citizenship, and it would also allow them to sponsor the illegal alien parents who knowingly broke the law when they brought them here, along with an unlimited number of other family members, in a never-ending chain migration. The DREAM Act rewards foreigners for flagrantly violating our immigration laws, and in doing so, the Act incentivizes more foreigners to do the same in the future.
