Bradley-Prosser confrontation gets even sillier

Christian Schneider brings us the latest news from the scuffle between Wisconsin state Supreme Court justices David Prosser and Ann Walsh Bradley, which has taken on more of the characteristics of a Jerry Springer episode than a First Monday in October vibe. According to more sources, Chief Justice Shirley Abrahamson involved law enforcement, which got uninvolved as soon as possible in the claims and counterclaims, a path open to them since Bradley didn’t choose to file charges. Instead, Schneider reports that sources believe Bradley and Abrahamson chose to leak the story to a left-wing website in order to embarrass Prosser in retaliation:
On Monday night, Bradley called Capitol Police Chief Charles Tubbs to talk to him about the incident. On the morning of Wednesday, June 15, Tubbs joined the justices in a closed-door meeting, where he discussed “issues relating to workplace violence.”
During the meeting, Chief Justice Abrahamson actually reenacted the incident on Chief Tubbs — no doubt an amusing sight, as the diminutive Abrahamson mimicked choking the tall, portly police chief. During her demonstration, Abrahamson emphasized that Prosser had exerted “pressure” on Bradley’s throat.
“There was no pressure,” interrupted the justice who had initially broken up the incident between Bradley and Prosser. “That’s only because you broke us apart,” shot back Bradley. This exchange led several meeting attendees to believe Bradley was making up the charge, as they took her rejoinder as an admission that there was no pressure applied to her neck.
Bradley and Abrahamson wanted to force Prosser into taking anger-management training. However, they failed to convince their fellow jurists, who wondered how they would go about forcing any colleague to attend any kind of remedial counseling, regardless of the circumstances. Some considered it a “demeaning” demand, considering that Prosser didn’t do anything wrong in the first place.
Bradley could have filed a criminal complaint. To date, she has not chosen to do so, but that may be because a criminal complaint could open up a bigger can of worms. Prosser would have his due-process rights, including taking depositions, evidentiary hearings, and the like. That might get rather strange, since those activities would have to take place in the same Wisconsin courts that these justices oversee. Who gets to determine whether the court handles the case properly?

Schneider posits that Bradley and Abrahamson didn’t think they could win in a criminal complaint or a demand for a restraining order (which would make Supreme Court sessions rather difficult), and so chose to leak the story to political allies in order to pay back Prosser:
Instead, the story was leaked to the George Soros–funded Wisconsin Center for Investigative Journalism, who used three anonymous sources to back up Bradley’s story. There were six justices present at the time of the incident, four of whom would be more likely to back Prosser’s version of the story. That leaves Abrahamson and Bradley as the only two remaining justices present. One source present speculated the third source may have been Bradley’s law clerk, who likely didn’t actually see the confrontation but may have head Bradley shout “I was choked.” …
Furthermore, sources unanimously believed that it was Shirley Abrahamson who has been the impetus behind the story, managing the press operation from behind the scenes. Justices had been working together regularly since the incident without any signs of rancor until Abrahamson decided to make this an issue, sources believe.
Sounds like Wisconsin needs to clean house in its Supreme Court. Rather than have the courts get involved, the state legislature should start probing this case to determine exactly what happened, and whether the Chief Justice has conducted a leak campaign against Prosser as payback. I’d say at least one resignation is due in this case — and maybe a few of them, whatever happened. It’s doubtful that Wisconsin’s citizens can put much confidence in a court that can’t behave itself in a mature and professional manner, and especially one where such poisonous partisan and personal politics are in play.
Otherwise, we can look forward to even more updates from the Wisconsin Supreme Court, where in place of decisions and precedents, we can find out who won’t stop looking at whom, the compliance status of Exies-No-Erasies, and who ate the last Ding Dong in the cupboard.

The Wisconsin Judicial Commission is also investigating for possible judicial ethics violations, and a commenter on LI said that it was Prosser who filed the complaint there.
While Bradley and Abrahamson might tell their tale to fellow Dems in Dane County, one wonders what they’d dare say to a commission that presumably draw a state-wide membership. Dissembling in an ethics investigation is itself an ethics violation.

Bad news – we’re going to see even more of this because the Republicans don’t have, and thanks to a major screw-up (see the post below this one), threw away the slimmest chance of having, the 2/3rds majority in the Senate necessary (actually 2/3rds of those present) to convict on an impeachment charge.
Unless the people invoke a recall of one or more justices, the absolute earliest this wholly-disfunctional court might become moderately-functional is 2015 when Bradley is up for re-election.

Can we confirm that Prosser has indeed filed an ethics complain, with whatever judicial review type panel?
Other than a commenter as some message board saying so? It would make sense that he has, and is just sitting back waiting for the proper review to come down the pike.

The recommendations of the Wisconsin Judicial Commission would need to be acted upon by the Supreme Court. It is more likely that, if they recommend sanctions against Bradley, the Court would act upon them than if they recommend sanctions against Prosser as once both parties recuse themselves, the pro-Bradley wing would shrink to 2, while the pro-Prosser wing would shrink to 3.
Indeed, it was the attempt by the liberal wing, led by Abrahamson and Bradley, to go well beyond the lack of recommendation by the Commission in the matter of a Michael Gabelman ad in his successful run for Supreme Court, that became the genesis of a Bradley/Abrahamson-engineered “leak” of the behind-the-scenes actions of the Court.

What about Sheriff Tubbs, who is now investigating the case? He should recuse himself from investigating this, as he’s not unbiased. He appeared twice in a reelection ad on Chief Justice Abrahamson’s behalf.

They should have someone outside of the state, with no political ties, interest, or even personal knowledge of all the parties involved…someone who has no dog in this fight and can conduct a fair and judicious investigation. I think Walker should recommend an investigator from the FBI (outside of WI, someone from another state) to collect the facts and present their findings. Based on the findings, either one or both or more justices need to resign.

No doubt Abrahamson got even more spiteful when Prosser beat her old friend and former employer Kloppenburg for Supreme Court. No doubt Abrahamson envisioned a nice coven of the three feminists on the Court, along with Crooks to make up a liberal majority.
Though Prosser had nothing to do with it, Kloppy first declared victory, and then had to do the embaressing concession after a state-wide recount that only gave her a few hundred votes. That had to sting.

As for voluntary retirements, that’s also not happening. Governor Walker gets to appoint (no Senate confirmation needed) any replacements, with each replacement serving until the next April that does not already have a Supreme Court election.
In this case, the next 2 open years would be 2012 and 2014 as the next Justice up for re-election would be Pat Roggensack in 2013. Of note, Bradley’s term ends in 2015, so if 3 justices go and she’s one of them, the third replacement would be up for election in 2015.

From all I’ve heard, Bradley sounds like the aggressor.
If you remember the Amtrak video a few weeks ago where a loud intern/NYU girl/lady got thrown off, she and an Amtrak employee kind of bumped arms in an innocent exchange. But the Amtrak employee went off on this “don’t put your hands on me” thing.
But it this case, in appears Prosser was just sitting there and Bradley got up and approached him and he just put up his hands and she bumped into his hands. She and the Chief Justice Abrahamson were both pissed because Prosser had said he lacked confidence in the Chief Justice. I can’t think of a scenario where Prosser would have been the aggressor. Bradley was clearly the one who was upset.

I still say the dog that didn’t bark, in this case, is the Bradley family’s silence, not the fact that she didn’t file charges. She and her collaborators already filed those in the court of public opinion, so we’re talking about trial by Blood Libel Media here.
Someone needs to ask Mr. Bradley (and, if they’re adults, the Bradley kids) the following question: “Your wife (mother) claims a man put her a ‘chokehold’ in her office. Why haven’t you confronted her alleged attacker or taken other action to hold him responsible for his alleged crime, like any normal person would?”

FYI as I mentioned in the thread from a few days ago, Mr. Bradley’s father was one of the guys who raised the flag on Iwo Jima in WW 2. Even though he’s now been dead for 17 or so years, Justice Bradley has still in the recent past name-dropped him to imply that her relationship with him (by marriage) magically made her “more qualified” to understand Veterans affairs.

They need to learn you are playing with fire by falsely accusing someone like this and that their explicit or tactic support of her actions won’t be allowed to slide, either. Just like Weiner’s #Hacked! claim, Bradley’s #Choked! accusation is meant to cover up her own very bad behavior. And like Weiner, she’s breaking the first rule of holes: When you find yourself in one, stop digging. Prosser is right to stand back and let her dig, rather than make a counter accusation of #Rushed!. You’ll note this is getting very little attention in the MSM. That means they know the score.
