Obama Administration Passes DREAM ACT by Executive Memo

“A new enforcement memo handed down by the director of U.S. Immigration and Customs Enforcement last week has some accusing the White House of running around Congress to implement the DREAM Act – and consequent amnesty for some illegal immigrants – by executive fiat.
The new memo, penned by ICE Director John Morton, directs ICE agents, attorneys and directors to exercise “prosecutorial discretion” – meaning less likelihood of deportation – for illegal aliens who have been students in the U.S., who have been in the country since childhood or who have served in the American military.”  LINK
Morton’s excuse for the memo—”not enough resources”:
Specifically, the memo argues, “Because the agency is confronted with more violations than its resources can address, the agency must regularly exercise prosecutorial discretion.”
Syndicated columnist Charles Krauthammer calls this maneuver a Constitutional breech pointing out that it is Congress’s responsibility to enact laws:
“This is outright lawlessness on the part of the administration,” argued syndicated columnist Charles Krauthammer on a discussion panel with Fox News’ anchor Chris Wallace. “Whatever the politics of this, we do have a Constitution. And under it, the Legislature, the Congress enacts the laws and the executive executes them. It doesn’t make them up.
“The DREAM Act was rejected by Congress,” Krauthammer continued. “It is now being enacted by the executive, despite the express will of the Congress. That is lawless. It may not be an explicit executive order; it’s an implicit one.”
The Obama administration IS explicitly running an end-run around the will of people and their representative government.  First Libya and now this.  What’s next Mr. President?
Update: It appears John Ransom at Townhall saw this coming.  John posted this on May 12th titled “Crass and Cynical on Illegal Immigration”
“The guy who rushed out to get trillions for banks, big pharmaceuticals and unions, practically ignored the topic of immigration reform when his guys ran Congress for two years and could have written their own version.
Indeed one of his wise-guys from Chicago, Rep Luis Gutierrez recently noted “[Obama] has the power to make things better right now without the Congress having to pass any new laws.”
Yeah, he can just do what he did for gays, unions, Chicago and all of his other cronies: He can ignore enforcing the old laws he doesn’t like. Or maybe he can grant every illegal immigrant a waiver, like he did for his favorites under healthcare “reform.”

That would never work, because the courts would reverse that in a heartbeat.

You cannot invite people to live in your country the rest of their lives, work for you at low wages and deny them self-determination and access to politics.

You can’t. We tried this in 1787 with the 3/5ths compromise, it proved untenable (as they knew it would) and let to war.

The guest workers are millions. They will not tolerate it either. They will agitate and organize, and sue, and they will get their path to cit from a court, like Mass got ordered to legalize gay marriage by their SC.

It will not work.

It is VERY VERY dangerous to imagine it would work.

We have the current laws all set up to go, they are legal, they are tested, they are in place.

Amnesty is setting aside the law in favor or something else.

I could not agree with you more BP. But seriously, without a massive uprising from millions, (and full support from our military) your synopsis falls a bit short of reality. Might I ask if you could direct the “immediate action” towards ANY of our representatives sent to Washington to do the will of the people? This President has been “pushing my buttons” since the day he was elected to the office, which is in part the reason I’ve been allowed/privileged to provide this information. Believe it or not, I still think our system of government, and the electoral process is the best in the world. And the “immediate action” is to inform first, respect our laws, and replace those who choose to ignore them through the Constitutional process of elections. With out a sufficient amount of millions, your suggestion of taking immediate action would be nothing short of anarchy. While I admire your disgust for this current government, (which most of us do here), I’d suggest you muster your anger in the right direction by getting your friends and family to register, vote, and change these “tyrants” back into representatives.

Amnesty, shamnesty. The DREAM Act, Obama’s memo, McCain-Kennedy Z Visa, and any accommodation or consideration for illegal aliens is NOT amnesty, where amnesty is defined as no fine and no jail time.

All of these accommodations are much worse — they are REWARDS – rewards of the ill-gotten goods to the criminals.

To an illegal alien, residency is the ill-gotten good.

If the illegal alien is rewarded with residency, no matter what fines they have to pay, it is a REWARD of the ill-gotten goods.

Anyone proposing any form of accommodation for illegal aliens should try this same policy with their own neighborhood burglars, report back, and we’ll see if burglaries are increasing or decreasing.

THIS is what Americans want – attrition through enforcement.

And THIS is how it is working at the state level.

No rewards — just go home when you can’t get a job or a driver’s license. Real amnesty would be no jail time, no fine — but you HAVE TO LEAVE!

Our nightmare with little Bammie has made me see that simply having a nice constitution doesn’t guarantee that we will have men in positions of power that respect that constitution. Until now our national leaders have observed the boundaries demanded by that document, but only because they have a moral and ethical grounding. We thought it was because of the integrity of the constitution, but it was only because they were good men.

The Soviet Union had a fairly nice constitution too, only it was treated as a joke. Little Bammie and his evil prog cabal have put us on that same road.

Actually, this has already happened. Arizona just defended its own law requiring e-verify in front of the SCOTUS. Thankfully the Arizona law was upheld, but the Obama administration did file a brief against it on the grounds that it “went too far.

In addition, the adminstration is still suing Arizona over SB-1070 and doing whatever it can to prevent the state from cracking down on illegal immigrants. They’ve recently filed a brief in a different lawsuit against Arizona’s requirement for voter id. The suit is currently at the ninth circuit.

The current laws require them to leave, anything with allows them to stay, is amnesty. PERIOD.

Fines plus staying = amnesty
registration plus staying = amnesty
staying = amnesty
staying plus citizenship = amnesty
citizenship = amnesty
touchback = amnesty
fines plus touchback = amnesty
fines plus path = amnesty

The only thing that is not amnesty, is the illegals return home in accordance with current law, and apply from the back of the line, in accordance with current law.

So, yeah, current laws.

Simply make hiring an illegal alien untenable for legitimate business owners and empower law enforcement to enforce.

Without work, most will self-deport. They made their way here, they can make their way home.

We CAN deport those we catch through traditional law enforcement activity, and we can fast-track it. After the first few thousand, the self-deportation rate will rapidly increase.

We have to secure the border first, now.

Get caught twice here illegally and expect to be in a Joe Arpaio type jail for quite some time.

This was at the f-ing ROSE BOWL in Pasadena, California. A stadium filled with hispanics BOOING the national anthem. Many (most?) hispanics in LA have allegiance to ANOTHER COUNTRY.

I pray to God that the rest of the country looks at this with open eyes. It’s doubtful they’ll hear about it, though, because the press won’t report it outside of a small local article in one or two papers.

On a balmy early Saturday summer evening, the U.S soccer team played for a prestigious championship in a U.S. stadium … and was smothered in boos.

Its fans were vastly outnumbered. Its goalkeeper was bathed in a chanted obscenity. Even its national anthem was filled with the blowing of air horns and bouncing of beach balls.

America, you are being consumed by hostile, foreign invaders. Do you have the ability to even recognize it? Do you have the guts to do anything at all about it besides grow fat on the couch? It’s gut check time, folks, even though we may wish it wasn’t. We may wish we could continue to drift along and stick to our mundane routines but we can’t unless we want to be destroyed.

I find it a little hard to be outraged by this. It’s rather obvious that we simply have not dedicated the resources that would be required to actually police the border and remove all illegal aliens from the country. I also have serious doubts about the willingness of the general public to actually pay the true price tag for those things. (It will be expensive in more ways than just the cash paid.) I believe that there would have to be a lot of discretion used no matter who was in office. The educated and the English speaking cause fewer waves and are less likely to cause other problems so it makes sense to make them the lowest priority.

As a SoCal resident I can confirm the invasion here is in full force, reconquista is happeneing unopposed. And yes, except for the most die hard fans many whites here avoid these events like the plague. What I was explaining is that what Palin described, and what many who voice similar policies propose, is not “amnesty” in a purely legal sense because they have to pay a fine. I agree on legal terms. What they propose is much WORSE than amnesty — it is a REWARD – a freekin’ REWARD of the ill-gotten goods, for Pete’s sake!!!

As long as anti-illegal proponents call the McCain-Kennedy Z Visa and similar proposals “amnesty”, they get to argue correctly that it is not “amnesty” because they impose a fine.

The sooner we start calling it a REWARD of the ILL-GOTTEN GOODS, the semantic battle on “amnesty” will be avoided.

Let’s call a REWARD to CRIMINALS what it is — a freekin’ REWARD.

I sat down with a frosty beer last night ready to enjoy a soccer match that I knew the U.S. would probably lose, but a fun game nevertheless. Within minutes of the start of the game, I was burning up with fury over the behavior of the fans at this game. Their sportsmanship was appalling no matter how much their “heart” was with their “mother” country. Give me a freakin’ break. This is what sportsmanship means to them:

1. Booing the national anthem of the country that they willingly came to for a better life (supposedly);
2. Chanting slurs at our goalkeeper (Tim Howard) every time he took a goal kick;
3. Throwing beer at the American fans;
4. Spitting on the American flag in the stands;

There was one very telling moment in the game that showed all the venom Mexico has for this country. At one point, right after a goal from Mexico, one of our defenders (can’t remember his name) went into our net to get the ball to put it back into play. The Mexican who scored (I think his name was Barroso) raced up to him in the net and ripped the ball out of his hands with utter hate in his eyes as though the mere touching of the ball by us defiled it! Our defender was absolutely dumbfounded by this behavior, but it was very telling to me. I am beginning to, dare I say it, “hate” the mexican illegals in this country. There is no doubt what their agenda is.

As an aside, my son played a soccer tournament in Birmingham, Alabama this weekend and one of the opposing teams names was “La Raza of Fultondale.” Talk about in your face. I was livid. Yet, most of the group I was with did not even have a clue what the name mean’t. This is what we are up against. We simply must wake up and pay attention!

People are oblivious. Partly because it’s an issue the media run from or cover up as much as possible. Nobody wants to look like they’re not on board with “diversity.”

Wealthy politicians from unaffected states, both Republican and Democrat, make weaselly PC statements about poor, poor “undocumented workers living in the shadows” and then go back to their all-white, gated communities and hope they didn’t say anything politically incorrect.

Large parts of the US have been invaded and the government doesn’t even give a sh*t. Illegals are pandered to and have more power in the US than American citizens.

At some point, the solid waste is really going to hit the room ventilation system and the media and the politicians won’t be able to just issue nitwit platitudes about fairness and diversity as a substitute for addressing the problem anymore.

When I swore that oath as a 17-year-old recruit, all those years back, I don’t remember anyone telling me there was a time limit on that promise to protect and defend the Constitution. I haven’t worn the uniform in decades, but I haven’t forgotten the promise. I’m still hopeful that I can fulfill that promise at the ballot box, but hopes fades.
