Video: Former U.S. AG calls Holder’s prosecution of CIA agents “outrageous”

posted at 7:15 pm on May 25, 2011 by Tina Korbe

In an exclusive interview with The Heritage Foundation’s Robert Bluey, former U.S. Attorney General Michael Mukasey today criticized successor Eric Holder for pursuing criminal action against CIA employees who used enhanced interrogation techniques to gather intelligence from terrorists:

“I think both the fact and the way it was done are absolutely outrageous,” Mukasey said. “Those cases were investigated by career prosecutors [and] detailed memos were drafted describing why those prosecutions should not go forward and those people were told that no prosecution would go forward. The current attorney general, when he took office, without reading the memos, directed that those investigations be reopened. I think that was an unconscionable thing to do.”

Holder’s actions can’t help but have a negative effect on intelligence gathering in the future, Mukasey said.

Mukasey also explains why those portions of The PATRIOT Act that are up for renewal this week are more important than ever.

“The current plots that we’re encountering are very different than the ones we encountered before,” he said. “We’re getting a lot of much smaller plots because Al Qaeda’s ability to mount the larger ones has been degraded substantially, so we need things like the section 215 authority to obtain records, like roving wiretaps and other authorities that are up for renewal in order to investigate these smaller plots in a nimble fashion.”

Fortunately, Congress will likely vote this week to extend those provisions for the next four years.

What this also does is degrade current and future CIA from ever trusting their government to do right by them for protecting their country. Just one more example of how this current administration is going about destroying the very foundations of this once great nation.

What does anyone expect in the way of integrity from Holder. His past expertise was in getting pardons for convicted felons in exchange for donations.

Holder’s AG because of his skin tone-not because he’s competent.

CIA agents already cleared of charges: Must re-open investigation.

Black Panther voter intimidators already convicted: Must drop charges.

We’re beyond politicizing the Justice Department, we’re now into retroactively politicizing justice itself. The Obama regime is systematically destroying every principle of fair and equitable government that they can get away with, and Congress, the courts, and the press are letting them get away with anything.

I keep telling myself that someday this administration will be out of power and I can laugh about all this stuff. But it sure seems to be taking a long time.

Holder’s actions can’t help but have a negative effect on intelligence gathering in the future, Mukasey said.

Even Obama and Holder are smart enough to know this, so it must be intentional.

RJL on May 25, 2011 at 7:52 PM

It’s the Church Committee of the 1970s all over again. Deliberate attempts to cripple or even dismantle parts of the U.S. intelligence gathering ability, particularly the C.I.A.. What are these people thinking? If Obama’s family were kidnapped I’m sure he’d want the strongest intelligence available to protect them. When the U.S. is threatened … not so much.

Holder Is A Jackass – Destroying Careers For An Obsession
**********************************************************

Holder has done it again. He is re-investigating six CIA agents who used legal (at the time) enhanced interrogation to obtain information which helped lead to the capture of Osama bin Laden.
********************

These agents were cleared by an independent commission.
********************************************************

Eric Holder dropped the case prior to this but he can’t let it go. The careers of these men are destroyed but it’s not about them. It’s an effort to embarrass the former administration. It’s purely political.

Fox News Sunday interview with Dick Cheney and Chris Wallace: “Former Vice President Dick Cheney said Sunday it’s an “outrage” the Obama administration continues to investigate CIA agents who interrogated terror suspects, claiming they did nothing wrong and expressing concern about the precedent it sets.

Cheney weighed in on the probe after several Republicans and other ex-officials have renewed their call for the Justice Department to drop the investigation — launched nearly two years ago by Attorney General Eric Holder — in light of the killing of Usama bin Laden.

Though it’s unclear what role so-called enhanced interrogation played in finding bin Laden, Cheney told “Fox News Sunday” the techniques probably “contributed” and suggested the circumstances make the Justice probe all the more unsettling.

“It’s unfortunate,” Cheney said. “These men deserve to be decorated. They don’t deserve to be prosecuted.”

Cheney noted there was a “complete investigation” during the Bush administration that concluded the agents had not violated the law. He said the decision by Holder to reopen that case and hand it over to a special prosecutor sets a “terrible precedent.”

“These are government employees. They did nothing wrong, as best as any of us knows,” Cheney told “Fox News Sunday.” “It is an outrage that we would go after the people who deserve the credit for keeping us safe for seven and a half years.”

Former Defense Secretary Donald Rumsfeld also said Sunday that the Obama administration should set the CIA probe “aside” and move on, calling it a “most unfortunate thing.”

“These people were operating at the direction of the president. They were doing things that had been approved by the Department of Justice,” Rumsfeld said on CBS’ “Face the Nation.” “And it sends a chill throughout the government.”

The investigation has been kept under wraps since Holder first announced it, and it’s unclear how far along it’s come.

Asked about the investigation Sunday, National Security Adviser Tom Donilon told “Fox News Sunday” he could not comment on the probe itself. But he praised the work of the intelligence community in helping track bin Laden…” Read here; Eric Holder and his obsession with prosecuting the CIA

Debra Burlingame, sister of Flight 77 pilot, Charles “Chic” Burlingame, whose plane was flown into the Pentagon on 9/11, confronted President Obama at the 9/11 Memorial about investigating CIA agents under the Bush administration at a time when the CIA has benefitted from the intelligence these men gathered. President Obama turned his back on her. Read here: Turns back on Debra Burlingame

Holder is a perjurer and a corrupt political hack, not to mention incompetent. He is an absolute disgrace, and hands down the worst AG in the history of the country.

He should be impeached, convicted and removed, and disbarred. he should then be prosecuted for his multiple perjuries before Congress, and anything else a proper investigation uncovers, and I bet it would uncover much more.

novaculus on May 25, 2011 at 7:57 PM

Where are the calls for Holder’s resignation? I repeat, where are the calls for Holder’s resignation? Once more, where are the calls for Holder’s resignation?

It was a daily occurrence during the Bush years regarding Alberto Gonzalez, Cheney, Libby, etc. Why so quiet on the right?

glennbo on May 25, 2011 at 8:07 PM

detailed memos were drafted describing why those prosecutions should not go forward and those people were told that no prosecution would go forward. The current attorney general, when he took office, without reading the memos, directed that those investigations be reopened.

If Holder manages to bring those guys to trial, which would be a travesty, those memos need to be brought into evidence. No reasonable jury would convict.

greggriffith on May 25, 2011 at 8:38 PM

Fortunately, Congress will likely vote this week to extend those provisions for the next four years.

I don’t think that’s fortunate. I think it’s a travesty. The PATRIOT ACT violates the 4th, 5th, and 6th Amendments to the Constitution. The provisions deemed vital to national security are abused regularly for non national security reasons. We can’t regulate that, and we won’t throw out the investigations where those provisions are used in non terror related cases.

We should let the PATRIOT ACT expire, because we have sacrificed liberty for the illusion of security, and none of us are the better off because of it.

I think you are right though mobster Holder is probably banking that if Barbecue Reno could get away with a massacre as AG then he’s protected. Arthur Conan Doyle once paraphrased Proverbs through Sherlock Holmes in The Speckled Band:

“Violence does, in truth, recoil upon the violent and the schemer falls into the pit he digs for another.”

As long as the Democrats control the Senate, Holder is safe. Under current political “rules” the party in power that loses is given what amounts to a”get out of jail card” for their time in office. If the reports in the media(old and new) are even 25% correct, it will very hard for the current admiration not to face some kind of legal proceedings. We are entering very dangerous political(and moral) waters here.

Uncle Sams Nephew on May 25, 2011 at 9:51 PM

The only way this crap is ever going to stop is when leaders within the GOP begin to go after the corruption within the Democrat party. Libs have wanted to arrest and put Bush and Cheney on trial for war crimes. They want to bring charges against the CIA. The real criminals are within the Democrat party!
This has been going on for far too long. Republicans again and again, for the “good of America” or something, continue to ignore treasonous behavior and corruption within the Democrat party. Yeah, for the “good of America’ or whatever. Well, how good is it for America right now?! When you continue to overlook treason and corruption for the so called “good of America”.. what are you left with? Treason and corruption! It’s not going to go away. It will only get worse and worse.

The Democrats are showing us all what can be done with power against the innocent. Surely Republicans, once back in power can do as much with the truly criminal. Maybe if enough Democrats went to jail, for the good of America, our nation might actually get a fresh start. Maybe if enough corrupt Democrats went to jail, it might set an example and cause a few other wicked politicians to give pause before they over look their taxes, take a few bribes, engage in voter fraud or abuse their powers.
