Surprise: Jared Loughner found incompetent to stand trial

He couldn’t even hold it together for an hour in court.

At least one of the doctors testifying to his competency described Jared Lee Loughner as a paranoid schizophrenic, a courtroom source told CBS News…

Loughner, dressed in a khaki prison suit and sporting bushy, reddish sideburns, was removed from the hearing after an outburst and had to watch part of the proceeding on a TV screen in another room. Burns had Loughner escorted from the courtroom after Loughner lowered his head and said what sounded like: “Thank you for the freak show. She died in front of me.” His head was inches from the table in front of him…

Loughner will be sent to a federal facility for a maximum of four months to see if his competency can be restored. If he’s later determined to be competent, the case against him will resume.

If he isn’t deemed competent at the end of his treatment, his stay at the facility can be extended. There are no limits on the number of times such extensions can be granted.

If doctors conclude they can’t restore his mental competency, the judge would have to decide whether the suspect can be restored. If the judge decides there’s no likelihood of restoration, the judge can dismiss the charges against him. In that case, state and federal authorities can petition to have him civilly committed and could seek to extend that commitment repeatedly, said Heather Williams, a federal public defender in Tucson who isn’t involved in the Loughner case.

Given the prominence of the case, I can’t believe a judge would ever agree to dismiss the charges outright, even with involuntary commitment a foregone conclusion afterward. If they can institutionalize him indefinitely in four-month increments with an eye to improving him until he’s trial-ready, they’ll do that — at least for a few years, until the public’s lost some interest. Also, that’s only the federal side of the case; Arizona’s planning to try him on state charges after the federal trial is over, but since that might now take years, maybe they’ll rethink that and get things going. If you’re anticipating a Hinckley-esque acquittal on insanity grounds, the federal standard is whether “the defendant, as a result of a severe mental disease or defect, was unable to appreciate the nature and quality or the wrongfulness of his acts.” As Ace noted earlier, Loughner’s got a big problem there per his alleged use of the word “assassinate” in his writings about Giffords. And in any event, Arizona doesn’t allow for acquittals on insanity grounds; their standard is “guilty but insane,” which means the defendant is sent to a hospital after being convicted for treatment and, if he regains his sanity, is then sent to prison to serve his sentence. Long story short: No, this guy’s not getting out.

Two clips for you here, the second of which has Patrick Kennedy evincing some sympathy for Loughner a few days ago on grounds that he is, after all, a very sick man. The first is a CNN reporter describing the outburst in the courtroom today and the reaction from Loughner’s parents. The creepiest thing about it? The courtroom sketches, one of which clearly shows him grinning nuttily next to his lawyer.

I don’t know why anybody who wasn’t actually crazy would want to plead insanity. I mean, if you win you get locked up with a bunch of guys who are violent and dangerous but crazy to boot. I’d rather take my chance with regular prison.

Loughner is evil and this works out great for Sherrif Dupnik now none of his involvement with Loughner’s parents will be brought out in court. There is a dead Iraq War Veteran 26 years old killed by the PIMA swat team. There is this shooting spree by Loughner. There is the Ward Churchill ginning anti American sentiment in Tuscon high school. Oh and Tuscon wants PIMA county to secede and become Baja something or another.

Why isn’t the DOJ and FBI investigating whats going on in PIMA county Arizona? They think they are keeping a lid on it? The Democrats think this is all political? They want it to blow up in their faces later? In the run up to the 2012? Something smells in PIMA county Arizona.

I am gonna write this: He said he’s not guilty but he’s insane in order to stand trial? Give me a break. If someone perforated Mr. PPF’s skull and then claim innocence, I’d raise heck to the media about the slim chance of Loughner never get put away forever, or put down for a nice eternal nap.

The question is, should the dysfunctional mentally ill be on the same level as sex offenders? In my eyes maybe some people believe “they can be fixed” but I don’t.

Well in my thinken this slug will use the courts to the max to see to it he is a ding bat! And the courts will see to it he gets his wish. Act wormy, shake and rattle roll in court, WELL this is not a normal human? You can watch any number of tv programs where some have done the same thing jared is doing. This man killed American’s he needs to get a trial or spend the rest of his life in a mental cell or some doctor needs to say he is as normal as bho. Not gonna happen here in America!

Just witnessed Elizabeth Smart’s big day in court where that wacko sung his way into lifetime prison. Courageous girl looked at him in the eye, grabbed the mike and told him “You won’t affect me anymore” or something of the sort.

Like Kennedy I have a “thing” for the mentally ill. PDS is another acronym for it/

Some of them do very well on medication. Others deny the illness and keep going off the medication. Still others never get a good response from the meds. The side effects can be horrid, the new meds are fabulously expensive.

Also please consider that most people with this diagnosis are not dangerous at all.

Or are you a mental health professional with different experiences?

Should Loughner end up anywhere near an actual hard-time prison then prison justice will probably be meted out in remembrance of the 9-year-old killed and perhaps also in remembrance of Judge Roll who died shielding others from Loughner’s bullets.

It’s a sad time in the nation’s history when I have more faith in prisoners to uphold justice than The System which kept Loughner out on the streets even after the community college problems which preceded the shootings.

Yep; they call it ‘housecleaning’. It’s why some prisoners have to be sheltered from general population…their deeds are seen as so horrific that even other convicted murderers will gang up to do what society won’t.

It doesn’t matter one iota what conditions he has or thinks he has, or what conditions that you think he has. You can’t worm out of a conviction because you weren’t thinking straight due to drugs or booze, and it shouldn’t matter if you’re a headcase when sober. Mental health PATIENT. For more than 10 years. So yeah I know all about anti-depressants; one of them triggered epilepsy. About the side effects? Absolutelyfriggin’ right. What’s worse, I can’t seem to get off of them no matter how hard I try-there’s no issue that causes me to be depressed.
