NJ Supreme Court to Christie: Spend more money

The New Jersey Supreme Court today decided Gov. Chris Christie and state legislators must spend more money — specifically, $500 million more — to meet a constitutional obligation to provide a “thorough and efficient” system of free education for elementary through high school students in the state.
The case was the 21st in a series of cases about school funding in the state of New Jersey. With this decision, the court continued the pattern it set in previous cases — a pattern of prescribing the amount of education funding the state owes students.
As Judicial Crisis Network’s Carrie Severino explains, “This is just another hit in a long string of cases wherein New Jersey’s highest court has taken on the role of judiciary, appropriator and chief executive.” She continues:
In the Abbott v. Burke line of cases, the New Jersey Supreme Court decided that it has the authority to determine what level of funding satisfies the constitution’s requirement of a thorough and efficient system and to order the state to spend more if the court is not satisfied. One would have to re-read Justice Blackmun’s opinion in Roe v. Wade to find a greater example of incoherence and willful judging masked as legal analysis.
Severino is right. The court’s decision makes no sense. As the New Jersey administration argued in the case, appropriations power — including the power to establish school funding levels — actually belongs to the legislature.
But the state Supreme Court dismissed that argument:
The State seeks, through the legislative power over appropriations, to diminish the Abbott districts’ pupils’ right to funding required for their receipt of a thorough and efficient education. … In such cases, the State may not use the appropriations power as a shield to its responsibility.
It’s fine for the court to affirm students’ right to an effective education. The New Jersey constitution provides for that. But the court says students have a “right to funding” — and not just funding, but a specific dollar amount. Essentially, the court equates a certain amount of funding with a quality education.
But that disregards an important reality. The facts show more money doesn’t necessarily mean a higher quality education. The Heritage Foundation’s Lindsey Burke explains:
Unfortunately, no correlation has been found between [government spending] growth and increases in academic achievement. While the federal role in education has ballooned over the decades—and federal per-pupil expenditures have tripled—academic achievement, graduation rates, and our international competitiveness have languished.
New Jersey is no exception. The state spends more education dollars per pupil than any other state in the country, but is far from the top in academic achievement, Burke said.
According to Fred Giordano, a partner at K & L Gates in New Jersey, 20 years of court rulings in earlier Abbott cases have led to increased funding for the so-called Abbott districts — but achievement has not kept pace. The performance discrepancy remains between Abbott districts and other school districts in the state — suggesting its cause might be something other than funding.
“If we really wanted to help the students in the Abbott districts, we would give them more flexibility to take their money where they see fit,” Burke says. “We’re seeing all of this exciting movement toward school choice throughout the country, but then, in New Jersey, you have a Supreme Court saying, ‘Let’s continue in the status quo by throwing more money at the problem.’ It’s frustrating.”
Meanwhile, the state of New Jersey simply can’t afford this decision. Complying with earlier Abbott court rulings cost New Jersey taxpayers more than $37 billion between 1998 and 2008 alone, according to a Federalist Society white paper.
The decision is fishy for another reason, as well. The Court’s decision came on the strength of a swing vote of a justice temporarily assigned to the Court with neither the governor’s approval nor the advice and consent of the state senate, Giordano said.
Giordano sums it all up:
The decision is not surprising given the long line of Abbott cases, but disregards the state’s fiscal problems and the substantial evidence that the increased spending the Court had mandated in its Abbott decisions have failed to produce results commensurate with these expenditures.

The only way I see Christie getting the nomination is if the votes are split and he weasels in. We are gonna have Rand, Rubio, maybe Cruz, Walker, Jindal, Perry (if he runs again), Jeb Bush, Paul Ryan…who else? It prob gonna be a huge field again. Heres to hoping a moderate doesnt get it!

Well, I’m glad to see more people jumping off the Christie bandwagon (I’m on record with not wanting to see him in national politics from back in early 2012). I think the vitriol directed at him is a little harsh and undeserved. Perhaps people are just angry at him because they thought he was more than he is, and now they feel betrayed. I don’t know.
He’s always been a bit of a social squish. If he wasn’t he couldn’t get elected governor in NJ. Even without his squishiness, I don’t think his brusqueness plays well in Peoria. They may like that in NJ, but not in flyover country.
Anyway, I won’t say that he’ll never get my vote. I’m getting rather good at holding my nose and pulling the lever. But he won’t be my first choice, or my second, or even my 15th.

Christie needs open primaries and the conservatives to split their vote. That’s how McCain and Romney won the nomination.
IMO this is a real possibility sadly.
I would love to see a primary debate between Christie/Cruz/Paul/Jindal/Walker/Ryan/Rubio. That’s an impressive group. Throw in Martinez for some token diversity (I like her but don’t know much about her).

Giuliani was dead last in the primaries(behind Ron Paul) after being the front runner for most of the year leading up to it and getting and spending more then anyone. AND Giuliani took on the dems and was A+ on 2 legs of the R stool.
There is NO PATH to the WH for NE Christie as an R. He KNOWS that. He’s fat not dumb.

All these people that don’t like Christie, or claim he’s a RINO, can’t back their accusations with any legislation or anything else of substance.
Christie did a couple of photo Ops with the President so he could get funds for his state after a national disaster. He also called out Congressional Republicans for not releasing the necessary funds even though it was taking twice a long to provide relief as it took the Bush Republicans after Katrina. And for that, some idiot right wingers hate him for it.
Fact is that Christie has fought hard against the unions and got significant concessions in an overwhelming liberal legislature. He has not raised taxes one dime, even on millionaires, despite enormous pressure from the left, and he continues to oppose gay marriage. Yet idiot right wing extremists call him a RINO. Face it, Christie is by far the best chance we got in 2016. Time to get behind him.

I wouldn’t that’s how we ended up with McCain and Romney. The GOP doesn’t need to pit 20 different people against each other in the primaries and put on debate after debate. That’s only helping Democrats. Some of the rat-eared coward’s best material came from Newt’s attack on Romney.
Of the Republicans you listed I can only really get behind Cruz with any enthusiasm. Rubio blew it when he decided that amnesty and lying about what that immigration bill says was a good tactic.

One thing, he isn’t pro-gay. There was a fight in the legislature about gay marriage and he vetoed it and there wasn’t enough to override…it is going on the ballot in November and the people will decide, not the politicians. I’ll give him that much.
But here in Jersey, you can just bet they will vote for gay marriage and so VOILA!!! He is off the hook.

I would not have resented Christie’s gratitude towards Obama for hurricane relief – IF in fact such relief had been delivered. The FEMA response was worse than Katrina by far, a model of unpreparedness and incompetence. The promised help never arrived – and to some extent, still hasn’t.
INSTEAD, just like the media, Christie gave Obama full credit for his empty promises. Such a man is not to be trusted, his judgment is poor.

Chris Christie is done as a national figure for conservatives. He is despised here at HotAir by virtually every commenter I have read over the past … er … seven months.
Maybe Ed thinks Christie can compete for the Republican nomination without getting 5% of the conservatives, but I am not that good at math. Sure, he’ll have lots of liberal money, until he runs against another liberal, of course. Then he’ll need conservatives, and he will not get them.
After getting suckered into supporting stupid, cranky, open borders John McCain, and then The Father of ObamaCare, Mitt Romney, the great majority of conservatives have now been persuaded by those who said all along — Don’t do it. Don’t nominate a moderate … you’ll get killed. And we did, twice. We get it, and it won’t happen again.
Pro- gay marriage; tax and spend; pro- gun control; a fraud on abortion (he’ll probably “evolve” between now and 2016) … he’s no conservative. Have fun as Governor of Spew Jersey, the 2nd highest tax state in America.

Christy’s undeniable communication skill and charisma won’t translate well in a national campaign, i don’t think, where the pol can’t easily get touchy-feely with the crowds showing up at rallies. Nevertheless, it is very definitely also a set of attributes and political skill that shouldn’t be overlooked. Romney could have used some of that sort of warmth, for example.
I see Christy as a natural Veep candidate for someone more ideologically conservative though, rather than as yet another RINO presidential candidate.. He’s a tough debater and he has this great common touch, but these skills and attributes won’t translate well to the top of the ticket.

However, what I’d still love to see is Christie as press secretary for a president Rand Paul or Cruz. That way I could entirely overlook his liberal views while once again enjoying my daily Christie-porn as he bashes the liberal press corps.

If you believe any single candidate could create more disunity in the Republican Party than John McCain and Mitt Romney combined it would be Chris Christie.
Chris Christie is about where we’ve been as a party. It stunk, it’s empty and it’s very lonely. We need to advance, not regress.
I’m personally not about to sacrifice my children’s future to another candidate who throws principle to the wind when it’s politically convenient and then tell us we’re fools and partisans.
Chris Christie is probably one of several candidates who would make me drop my Republican Party affiliation. After him, what would it stand for?

I’m in the minority here in that I love Christie and think he would be a good President, but I don’t think he has much of a chance of winning the GOP nomination. Just can’t see him selling in Iowa or South Carolina, or even Ohio. But a lot depends on what the Party does in terms of rescheduling primaries and debates, and who else runs. He could dominate a bunch of debates like Romnmey did, and divide the others who will all be scrambling to be the not-Christie of choice.
Ordinarily I would support Christie for the same reason I supported Romney in 2012, because I thought independent voters would vote for him and win the swing states. But the last two elections have made me much less sure of that formula. I realize that conservatives now hate Christie and might stay home in enough numbers that he can’t win. I think this hurt Romney a great deal. I want a candidate that all conservatives can vote for.
I do think Democrats would have a very hard time “othering” Christie the way they did Romney in 2012. Christie comes from a middle class background, made his bones as a prosecutor, and is running for reelection and will likely win it, proving he can get a lot of Democrats and independents to vote for him. He is much better at articulating why he does not support things like abortion on demand and same sex marriage.
Y’all do need to get off his case about helping Obama win the election. Mitt Romney was never going to win that election.

Why on earth would you invite your enemy into your home to entertain you and call him “likeable?” He’s not likeable to me in the least. I view him with DISGUST and suspicion. He is all about Chris Christie, nothing else. He’ll say and do anything for his own political benefit. And, he’s every bit as PROGRESSIVE AS BLOOMBERG.
