Wow: Obama issues “signing statement” rejecting budget cuts to White House “czars”

You didn’t seriously think he was going to abide by the will of Congress, did you? Such is The One’s personal awesomeness that he can order the bombing of Libya without so much as a heads up to the legislature in advance. Surely he wasn’t about to be tripped up by a duly enacted bill that dares to cut off the money he uses for his auxiliary cabinet.

I have to say, of all the Bush policies recycled by Obama, this one’s my favorite just because it’s such a gratuitous offense to his base. You can spin many of the others on expediency grounds — he had to ramp up the drone strikes in Pakistan to crack down on terrorists, he had to keep Gitmo military tribunals going because the Republicans tied his hands — but this one’s pretty much a pure no-apologies betrayal. The bad news: Legally, it’s highly dubious. The good news: It should provoke another classic what-happened-to-the-Barack-I-knew Andrew Sullivan lament.

One rider – Section 2262 — de-funds certain White House adviser positions – or “czars.” The president in his signing statement declares that he will not abide by it.

“The President has well-established authority to supervise and oversee the executive branch, and to obtain advice in furtherance of this supervisory authority,” he wrote. “The President also has the prerogative to obtain advice that will assist him in carrying out his constitutional responsibilities, and do so not only from executive branch officials and employees outside the White House, but also from advisers within it. Legislative efforts that significantly impede the President’s ability to exercise his supervisory and coordinating authorities or to obtain the views of the appropriate senior advisers violate the separation of powers by undermining the President’s ability to exercise his constitutional responsibilities and take care that the laws be faithfully executed.”…

In other words: we know what you wanted that provision to do, but we don’t think it’s constitutional, so we will interpret it differently than the way you meant it.

Remember, one of the big advantages of using “czars” is that they perform cabinet-type functions without being subjected to cabinet-type confirmation hearings. Which means, in this case, not only is he reserving his right to skirt congressional scrutiny of important appointees, he’s reserving his right to force Congress to pay for it by ignoring their own funding strictures. He’s been using signing statements for a long time now, but I’m not sure there’s ever been an example this egregious.

Here’s your must-watch video of the day, from the thick of the campaign in May 2008. I’m going to call it, “Just Words.” Man, that Sullivan post is going to be epic. Exit question: If Congress sends him a bill funding the mission in Libya but demanding that he seek authorization within 60 days, is there any reason at this point to think he wouldn’t issue a signing statement accepting the money but rejecting the authorization requirement?

IN response, the next thing passed by the House should be Articles of Impeachment. I didn’t agree with “Signing Statements when Bush did and I sure don’t agree with these. If Barry doesn’t think the provision is Constitutional let him test the idea in court. This is the sad result of years of Congressional delgation of their authority to the executive. Congress is always up for re-election, and they figured out how to punt on all the messy details of their prize legislation. Administrative agencies, tangled byzantine webs of regulation, all of it, ceeded to the Executive branch agencies so that Congress wouldn’t have to make tough decisions.

And so now, Obama can sit and say that he will employ whom he wishes, spending restrictions be damned! There are slush funds aplenty to prevent the requirement of new appropriations.

Congress needs to take back what is truly theirs, start abolishing Executive branch agencies, and make the hard decisions themselves.

I doubt Obama is going to listen to much of anything congress does to him. Why should he? In order to stop him, congress would actually have to confront him somehow. Challenge him. The Republicans are way too nice for that. They’ll huff a little. Come out and give a low key speech about how disappointed they are, hold a hearing maybe, but other than that?

2012 is going to be very interesting. How will he handle defeat? Maybe he’ll just interpret the election results a little differently than everyone else as well.

Because Obama both loves the sound of his own voice, and is an unscrupulous bullshitter, the 2012 election season is going to be a banner year for Republican campaign commercial producers.

There’s literally miles of video of Obama speaking like a smug, arrogant know-it-all, yet within two years he has proven to be someone you cannot trust because he’s gone back on his word so many times.

Someone with zero talent could make Obama look foolish using these videos. It’s going to be fun watching what the pros do with them.

A great strategy would be having numerous special interest groups each producing a half dozen of these ads and saturation bombing every swing state market with them. One commercial being played every ten minutes for 18 months. There’ll be nothing left of Obama. And on the days when Obama appears in a swing state, double the amount of the commercials making him look like a dishonest ass using his own words, and then bury the dagger by ending each commercial by playing Obama saying “words, just words” then follow that with the announcer saying “Obama thinks you’re stupid”.

Even putting aside the dubious constitutionality of this action, has anyone stopped to address the extreme bad faith the President must have been negotiating with.

This is not a element that Congress passed over White House objections. This an aspect that the White House and the Congress negotiated as part of the Budget agreement. Obama knew this element was in there, he lead the Congress to believe he would accept this limitation, and now he suddenly says “just kidding.”

Tell me why should the Republicans trust him on anything again?

That is the big line Republicans in Congress should be pushing.

We need an ad like this:

President Obama lied to Congress.

Congress and the President agreed that X, Y, and Z would be cut. Then after we passed the budget saying that funding for X, Y, and Z were cut, Obama spent the money anyway.

President Obama lied so he could get his way, when he didn’t have the votes.

Is that the kind of President you want?

Obama made an elegant, convincing and passionate legal case against signing statements. He defended that principle right up until it became inconvenient… two years and some change later.

Obama says and does whatever is necessary to advance his radical agenda. He doesn’t subscribe to middle-class morality; honesty and scruples are for bitter clingers. All those niceties are just tools to control the rubes.

The big difference here is that Obama has announced specific intent to ignore a provision of the budget that prohibits the spending of any funds on those positions. That’s not “well, this is ambiguous so I’ll interpret it this way.” Instead, it is “screw Congress, we’re spending the money despite a ban in the appropriations bill”. That flies in the face of Constitution itself on a really fundamental level.
