Felony charges filed against teacher in WI e-mail death threats; Update: Track record?

posted at 9:35 am on April 1, 2011 by Ed Morrissey

Charges have been filed in an investigation of e-mailed death threats to Republican state Senators last month during the budget-repair debate — but oddly, no arrest has taken place. Prosecutors filed two felony counts and two misdemeanor counts against 26-year-old Katherine Windels of Cross Plains, Wisconsin, but only after the Wisconsin Department of Justice sent the district attorney a sharply-worded memo of its own, wondering why prosecutors hadn’t done anything with the referral. It turns out that the woman who sent death threats to sixteen Senators and their families and claimed to have already built the bombs to kill them had never been arrested despite admitting to the charges:

Investigators visited Windels at her home the next day. According to the complaint, she told them she had sent the emails, and did so because she was very angry about what the senators had done. She also said she didn’t intend to carry out the threats, and was not arrested.

Dane County District Attorney Ismael Ozanne filed the charges Thursday. He says “it’s odd” law enforcement never took Windels into custody.

“The reality is, the person was not placed into custody, so at some point, law enforcement didn’t see the person as an imminent threat,” Ozanne said. “It’s not that the case was not serious or taken seriously by law enforcement or by this office.”

This morning, the Justice Department sent a letter to the media, saying it was concerned about the “lack of action” on the case by the D.A.’s office. The Justice Department had referred the case to Ozanne two weeks prior.

I’d say it demonstrates precisely that the case hadn’t been taken seriously by law enforcement or the prosecutors. Why would a terrorist suspect not be arrested in a felony case?  Do police really think that someone unstable enough to send death threats doesn’t represent a threat to her community, at least enough to book her? I wonder how her victims feel about that — and I wonder how the DA’s office and police department would handle Windels if she turned out to be a deranged Tea Party supporter rather than a deranged lefty.

Perhaps the letters were ambiguous enough to make police unsure of the case. You be the judge, but the “deranged lefty” description isn’t an exaggeration:

Please put your things in order because you will be killed and your familes will also be killed due to your actions in the last 8 weeks. Please explain to them that this is because if we get rid of you and your families then it will save the rights of 300,000 people and also be able to close the deficit that you have created. I hope you have a good time in hell. Read below for more information on possible scenarios in which you will die.

WE want to make this perfectly clear. Because of your actions today and in the past couple of weeks I and the group of people that are working with me have decided that we’ve had enough. We feel that you and the people that support the dictator have to die. We have tried many other ways of dealing with your corruption but you have taken things too far and we will not stand for it any longer. So, this is how it’s going to happen: I as well as many others know where you and your family live, it’s a matter of public records.

We have all planned to assult you by arriving at your house and putting a nice little bullet in your head. However, we decided that we wouldn’t leave it there. We also have decided that this may not be enough to send the message to you since you are so “high” on Koch and have decided that you are now going to single handedly make this a dictatorship instead of a demorcratic process. So we have also built several bombs that we have placed in various locations around the areas in which we know that you frequent.

This includes, your house, your car, the state capitol, and well I won’t tell you all of them because that’s just no fun. Since we know that you are not smart enough to figure out why this is happening to you we have decided to make it perfectly clear to you. If you and your goonies feel that it’s necessary to strip the rights of 300,000 people and ruin their lives, making them unable to feed, clothe, and provide the necessities to their families and themselves then We Will “get rid of” (in which I mean kill) you.

The misspellings are all in the original, which brings us to the suspect herself. News reports identify her as Katherine Windels of Cross Plains, Wisconsin, but don’t say too much else about her. James Simpson’s piece linked above notes that Jim Hoft and Underground Conservative did a little digging and discovered a Katherine Windels of Cross Plains of the same age (26) who teaches children in pre-school and kindergarten. The picture in her MySpace and Peek profiles looks remarkably similar to the WKOW mugshot (from 2004) used in the story, and it would be a very strange coincidence indeed to find two women of the same exact name, age, and appearance in a town of less than 4,000 people.

Hopefully, Windels isn’t teaching English. More importantly, the parents of children at the school might want to know that someone unstable (and stupid) enough to send terrorist death threats to politicians from her home computer is being entrusted with the students.

Update: If police want to argue that Windels doesn’t pose a threat, a new report from WKOW suggests that she has a track record in potentially threatening behavior:

A Cross Plains woman charged with felony crimes for allegedly threatening state senators over the budget repair bill was investigated by Madison police officers last fall over text messages.

Police reports released to WKOW27 News show a Madison woman contacted police over concerning text messages from Katherine Windels. …

In the reports, an officer stated he tried to contact Windels,  but was unsuccessful,  and ultimately left a voice mail message telling her to cease any contact with Patterson.

Apparently Windels set up the e-mail account from which she sent the threats under Patterson’s name.  She sounds like a seriously disturbed individual, and police should be answering why they have yet to take her into custody.  They’d better hope Windels doesn’t attack someone before the courts deal with these charges.

Excuse me? She threatened 16 senators with bombs and with getting shot in the head and she is not in jail? Did she use the “I was really mad and I was doing it for the children” defense or something? What in the name of all that is cheese is going on here?

Dane County District Attorney Ismael Ozanne isn’t twiddling this thumbs, however. In fact he has been quite busy lately.

He’s leading the charge to block the implementation of Wisconsin’s new labor law which limits the collective bargaining powers of Wisconsin government unions. The very same law which prompted the occupation of the Wisconsin State Capitol and the myriad of threats to Republican officials.

Wisconcin’s Dane Co, District Attorney, Ismael Ozanne, didn’t move on any of the hundreds of death threats to Republicans until he was under intense pressure to explain the failure to act, pressure from both the right, the media, and the Wisconsin state Department of Justice.

Now he has filed one case. He pretty much had to file this one, since it was a slam dunk. The evidence was clear, and he has a confession.

But no arrest?

Anyone else getting the idea that DA Ozanne is going to let this woman’s attorney delay the case into oblivion, and then give her a deal with for community service and a clean record if she doesn’t violate the deal? Anyone getting the idea that this will be the only prosecution, unless someone else was stupid enough to make threats using their own personal e-mail from their home computer, and then confesses?

Wisconsin is a cesspool of Democrat corruption and depravity. Starting to look like the cheeseheads like it that way.

JellyToast on April 1, 2011 at 10:02 AM

But you see,in liberal land, this is justifiable and she will be seen as a hero because it is for a “righteous cause”…..

Liberals make the criminal elements in their movement “heroes” so that they can’t be hurt by them.

Bill Clinton is still treated like a shining beacon of truth even though he has humiliated his wife on the world’s stage and been caught lying to the American public and a Federal grand jury…..

……….Bill Ayers is responsible for many acts of domestic terrorism and his group was responsible for the murder of a police officer.Liberals regard him as some rebel speaking truth to power that was guilty of some acts of “vandalism” while fighting the good fight against the Vietnam war.

…democratic lawmakers in Wisconsin run from their responsibilities and hijack the democratic process.they come home to a heroes welcome from the same liberals screaming “we want democracy..”

You could fill this thread up for days listing corrupt, hateful, and violent liberals that are treated like
“heroes” in their self righteous, ideological liberal crusade.

All she has to do is throw on a Che shirt and flash the peace sign on her way to court and she will be well on her way to liberal martyrdom.

Remember, we have already seen mobs of union goons descending on people’s homes, threatening and intimidating people’s families and children.

some kid at a school texts the word ‘gun’ and he’d have a SWAT Team at his house. A teacher emails 16 senators and tells them all that she’ll shoot them in the head and blow them up and ….crickets chirping….?

Wisconsin is a cesspool of Democrat corruption and depravity. Starting to look like the cheeseheads like it that way.

Wisconsin = California on Lake Michigan.

novaculus on April 1, 2011 at 9:57 AM

Yes, there is no escaping the fact that not only WI, but in the country as a whole, we have the government we deserve as a population. Even if there is cheating and corruption, we obviously put up with it. It really should be an extremely remote chance of a Democrat being elected in this country, yet even after all that has happened in WI it appears the liberals are going to come ahead in this whole fiasco. This says a lot about the people who vote, those who do not vote and who is really committed to active participation in the process.

I assume that the greedy union Wisconsin police simply refused to arrest her. They consider her a hero for the cause.

slickwillie2001 on April 1, 2011 at 10:33 AM

I think it is clear that the police (union) have chosen sides. Very disturbing! I’ll never look at police the same way agian. In a few short weeks they’ve destroyed the “good-guy” image it took generations to build.

No offense, but unless your post should have read:

“I’d hit it with a Louisville Slugger or a 2 x 4.”,

I’m going to have to refer you for therapy.

It’s all about the children! How will they ever learn to threaten the Right if they aren’t taught by some lunatic? The old fart that sent the email to Bart Stupak by way of this son in Colorado was arrested and in Federal Court, before they did the final investigation. Of course Stupid was a Democrat….never mind.

A commenter at Althouse makes the most important point:

OF COURSE Ozanne was dragging his ffet on the case. Filing charges related to actual recent death threats against the lawmakers substantiates any claims that 24 hour notice of hearings was a Bad Idea. Which undermines his suit.

awesome. My 8 yo daughter is doing her Memory Master test right now. My 12 yo will do it this afternoon. We saw a newsclip on some local public HS students who were ‘valiantly’ trying to learn all of the presidents, in order, and were doing….’well?’…with it, and my kids laughed as they banged all 44 of them out in ~15 seconds without missing a beat.

I’ve seen your posts before, ted, and I knew there was a reason I liked you! Carry on with those brilliant children of yours!

Because there isn’t enough jail space in the world to put all of the deranged lefties in.

you mean all the posts that didn’t hit the memory hole/ :)

thanks, and you do likewise!

Is this what leftist trash being in control of DA offices means, in the 21st century? Terroristic threats OK now, if committed against the other party?

MNHawk on April 1, 2011 at 10:41 AM

They’d better hope Windels doesn’t attack someone before the courts deal with these charges.

Let’s see. Two previous cases where EVERYONE knew the suspects were crazy – ended up in shootings and multiple deaths because no one did anything. This woman sends out death threats – a real loon – and the cops perform their own psych eval.

Yeah, that’s real good police work.
