What you want has a name for those who do this sort of thing: Privateers.

Congress can authorize individuals to do that sort of thing.

You want a guy taken out, or taken in (you might not get to stipulate that, BTW) then Congress can duly find people to do it, hand them Letters, put them under military law but without the overhead of the US military, and you can send them on their merry way. Authorize them to grab everything that isn’t nailed down so they can pay for the excursion, OK?

“and others to the Prosecutor unknown“

They need to clarify that indictment subject to newly cited Libyan documents.

theCork: Perhaps the Senator should simply pronounce Gaddafi as under arrest, try him in absentia, declare him guilty, and sentence him to parole. Objective achieved!

That’s how the French handled Kaddafi’s brother-in-law and his henchman for the UTA772 bombing. Because Kaddafi wouldn’t allow their extradition to France, the six were tried in absentia and were convicted.

Again, if Libyan officials confirm that Kaddafi personally ordered UTA772 bombing (as they have PA103), then America has yet another legitimate ‘casus belli’ to attack Kaddafi.
