Feinstein: Let’s “go in and arrest” Gaddafi

Jim Vicevich catches this suggestion from Senator Dianne Feinstein (D-CA), usually considered one of the clearer Democratic thinkers on national security and the military in Congress. Air strikes haven’t forced Moammar Gaddafi to flee Libya, she told Andrea Mitchell at MSNBC yesterday, but you know what would work?  A warrant for his arrest, courtesy of the International Criminal Court.  All we need to do is to, er, “go in and arrest him”:

Pray tell, Senator, just how does one execute an arrest warrant without “putting boots on the ground”?  Mitchell makes the same point after Feinstein suggests that the third option would be to handle Gaddafi the same way we handled Saddam Hussein, which would be a massive ground war and occupation.  Of course, Feinstein doesn’t actually put it that way, but smirks when Mitchell points it out.

So can we consider Feinstein a neo-con now?  At least in Iraq, we invaded after Hussein repeatedly violated the cease-fire that ended operations in the first Gulf War and ignored seventeen UN resolutions demanding his compliance.  Suddenly, Democrats seem awfully comfortable with the idea of ground forces, invasions, and regime change through military means in Arab nations, with much lower thresholds for action.  Unless, of course, Feinstein is so delusional to think that the US can send an envoy with an ICC summons and believe that (a) the envoy could locate Gaddafi, (b) the envoy would survive long enough to deliver it, and (c) Gaddafi would flee Libya out of fear of the ICC after standing up to two weeks of air strikes from NATO.  Hell, maybe he’d laugh so hard that he asphyxiates.

Perhaps Feinstein should avail herself of the right to remain silent.

Perhaps Feinstein should avail herself of the right to remain silent.

I’m reminded of when the Roman Emperor Caligula declared victory over the sea and commanded his troops to collect sea-shells as “spoils of the sea”.

Perhaps the Senator should simply pronounce Gaddafi as under arrest, try him in absentia, declare him guilty, and sentence him to parole. Objective achieved!

America has a sacred obligation to bring Kaddafi to justice– or justice to Kaddafi.

Certainly.

This “civil war” is a side show. If the rebels wear down Kaddafi’s assets (both political and military), then that is to our advantage.

But the issue for Americans remains whether we NOW exercise the will and moral courage to address Kaddafi’s ‘casus belli‘ against the families (orphans, widows, aging parents) of innocent American victims.

Libyan officials have now confirmed that Kaddafi (personally) masterminded the Lockerbie massacre.

The orders were given by Gaddafi himself… This evidence is in our hands and we have documents that prove what I have said and we are ready to hand them over to the international criminal court.“

The fig leaf has been stripped away. America has NO excuse for continued inaction.

In what alternate universe is the failed Christmas panty-bomber mastermind (al-Awlaki) a legitimate target; while the successful mastermind (Kaddafi) of TWA840, PA73, PA103, UTA772, etc. is (somehow) NOT an imminent threat?

That’s how the French handled Kaddafi’s brother-in-law and his henchman for the UTA772 bombing. Because Kaddafi wouldn’t allow their extradition to France, the six were tried in absentia and were convicted.

Again, if Libyan officials confirm that Kaddafi personally ordered UTA772 bombing (as they have PA103), then America has yet another legitimate ‘casus belli’ to attack Kaddafi.

The wife of US Ambassador to Chad, Bonnie Pugh, was murder by Kaddafi’s henchmen aboard UTA772 along with other innocents.

The FBI indictment for Lockerbie was filed in 2001. Kaddafi is indicated under the term;

and others to the Prosecutor unknown

They need to clarify that indictment subject to newly cited Libyan documents.

Dear Sen. Feinstein,

What you want has a name for those who do this sort of thing: Privateers.

Congress can authorize individuals to do that sort of thing.

You want a guy taken out, or taken in (you might not get to stipulate that, BTW) then Congress can duly find people to do it, hand them Letters, put them under military law but without the overhead of the US military, and you can send them on their merry way. Authorize them to grab everything that isn’t nailed down so they can pay for the excursion, OK?
