Wisconsin GOP senate leader to Dems: You’re in contempt, so you can’t vote anymore

This is the guy who not only held his caucus together under tremendous pressure, who not only signed the orders of contempt dispatching state police to hunt down the Fleebagger 14, but who greeted them with a rhetorical MOAB when they finally returned to Madison this weekend. Now this.

I bet the death threats he’s getting these days are exquisite.

In a sign that Republicans are still smarting from the exodus of Democrats during deliberations on the budget, Senate Majority Leader Scott Fitzgerald (R-Juneau) told his caucus on Monday that Democrats remain in contempt of the Senate.

That means, he said, that Democrats can’t vote on bills or amendments.

Fitzgerald wrote:

“When taking roll call votes on amendments and bills during executive sessions, Senate Democrats’ votes will not be reflected in the Records of Committee Proceedings or the Senate Journal. They are free to attend hearings, listen to testimony, debate legislation, introduce amendments, and cast votes to signal their support/opposition, but those votes will not count, and will not be recorded.”

One of the fleebaggers called the move “mean-spirited,” which is a nice big red bow on three weeks of Republicans needing police protection inside the Capitol.

I guess I’m not quite understanding the contempt order. Since they returned, why are they still in contempt? For not paying back expenses related to their vacation?

Usually when someone is in contempt, there is a very specific action that needs to be taken to not be considered in contempt any longer. (Which I thought was returning to work)

I’m assuming the specific contempt order he signed spelled out that one of the sanctions was a loss of their voting privileges in the chamber until they met whatever specific conditions they needed to.

Anyone know why they’re still in contempt?

They haven’t appeared in open session of the Senate yet. If memory serves, they’re not going to be in session until Tuesday.

I think they are getting some pretty good head way on 2 of them Holperin, and Hansen. Haven’t heard much more than they are active. The dems are literally trying to recall ALL the republicans I heard on local fox tonight. That is a ton of work. But they are motivated. LOL And will be even more so after this piece of news.

They just need to do it for one vote, to enact the original budget bill, so that the Democrats won’t be on record as opposing it. That way, the legality of the Republicans end round is a moot point.

Daniels is no Walker. But having said so, I think he has his own style and he will win in the end. It might be by end runs, or back door strategies but he’s smart, cool and clever. I’m going to wait and see on this guy. He’s pretty flinty too I suspect but quieter about it.

Not sure of the process in WI but here they would need to verify each and every signature and ,usually, about a third of those have something wrong with them and be disqualfied. They would then have to go out and do it again.

We are like the nice guys who never say ‘no’ when the neighbor wants to borrow a cup of sugar, the lawnmower, the BBQ, the boom box, etc. etc. After while we feel guilty to go ask if we can use our own hedge shears and borrow back our tennis racket.

What we need to do is go get all our stuff back from the neighbor, and tell him the borrowing is over, and charge him for damage to the BBQ.

For some of our guys to stand firm and just say NO will motivate our side tremendously.

I’d like to clarify my post. I agree that the fleebaggers deserve to be stripped of their offices and their seats declared vacant.

Sedition is defined as follows:

1. speech or behavior directed against the peace of a state
2. an offense that tends to undermine the authority of a state
3. an incitement to public disorder

These people, and their supporters, who did all they could to prevent the government from operating are all guilty of sedition, by this definition.

The Wisconsin State Code section 946.03 defines the crime of sedition as a Class F felony.

However, I doubt that the courts would apply it to these actions, since we give so much latitude to freedom of speech, and I imagine that there is some other charge like contempt that covers the conduct aimed at blocking the operations of the Senate.

This is just to say that I consider this behavior by elected senators disgusting, deplorable and contemptible. But I believe that the general media will play it as legitimate protest and attack the Republicans for playing hardball. From the standpoint of political strategy, therefore, the GOP should do all they can to allow reconciliation, as Lincoln proposed in his Second Inaugural Address, but never let these jerks win another vote. They don’t deserve it, and if the situation were reversed, we all know how the press and the Dems would be treating it.

The state in on a tipping point between sound democratic government and mobocracy and bullying. The GOP must be as wise as the serpents they face but as innocent as doves.

I could perhaps be induced to feel a spot of sympathy for the protesters, were it not for signs like that. The unmitigated gall of those who cast their self-interest as “it’s for the children” has become intolerable beyond belief. It singles out particular protesters for “no sense having a conversation with you, obviously.” It’s absolutely declaring “I’m not an honest interlocutor, you can ignore me.”

There’s been a lot of objectionable stuff going down lately, but this particular sort of thing is way further than a bridge too far for the unions. An intelligent public sees this kind of thing and spits in contempt.

What I don’t understand is this: what kind of people don’t understand that? And are willing to tote such signage regardless?

Even better is that you only need to have them present to be counted for a quorum! A simple head count and vote, and the requirements are met for full legislation. It is what TN did with their fleebaggers, back in the day, save they used the Pinkertons to drag them back to TN.

If you run for office don’t hide from your responsibilities.

If you hide from them, then don’t complain about the spanking you get when you come back: you deserve it.

No, it’s the childish game of Lucy and the Football they played while out of state. No less than three times did they privately let the Republicans believe they were coming back after negotiations, and every time they went to the public and said no – pushing the idea that there were no negotiations and letting the Rs take the hit. After the last one (and after one of the Senators said she wanted her April 5 ballot mailed to her in Illinios), realize they were being played and stopped it in its tracks.

Fitzgerald is righteously (and rightly) pi$$ed off, and largely holds the entire caucus the contempt you would hold a pile of dog poo.

I would like to see the Wisconsin legislators pass rules in the House and Senate that officials who clearly abandon their seats by leaving the state have 5 working days to return, lest a simple majority of the remaining legislators pass a resolution declaring that seat to be empty, in which case the Governor mat appoint a replacement to represent the district until the next scheduled election.

This is how Democracy works.

Elections have consequences.

Abandoning a public office has consequences.

Isn’t the suggestion that following the rules of the Senate “motivates the opposition” the same as the suggestion that we created the terrorists by being pro-Israel, pro-liberty or non-Muslim?
My guess is that the rules were probably written by Democrats in bygone days. Let them lie in the bed that they made.

The Law takes effect when the Sec of State publishes it. date of effect 3/25/11.
No it was a special session (to deal with the budget)Regular session starts on 4/5/11.

Fitzgerald should offer a trade. If Douglas “No Space” LaFollette publishes the bill on the normal timetable, meaning now instead of in 10 days, the Dems can have their votes back. After they’ve paid their fines and made formal apologies to everyone involved, of course.

Exit question: As sweet as this feels, is it smart to further motivate the opposition when they’re scrambling to meet petition deadlines for recall elections?

I really don’t believe that it would change a thing if the Republicans backed off, except possibly disenfranchising the GOP base. The Dems are already fired up…the key to survivng these recall efforts though will be motivating and energizing the GOP base. They will need to turn out to vote in high numbers for their representatives.

I took it as naked sarcasm, but I’m not intimately familiar with the general tone of the poster’s prior comments, so it can be difficult to know if sarcasm was actually intended or if the poster is batsh!t crazy. I’m going with sarcastic until it’s proven otherwise. Usually, the batsh!t crazy reveal themselves and invariably rant themselves under the banhammer.

I am from Wisconsin and am very proud of how Walker and the Republicans have handled this situation. They have put everything on the line for their convictions, as have the Democrats…difference being the Republicans, as usual, have worked within the framework of the constitution. The Democrats and unions have behaved like petulant children.

State Senators running awau from homes…sounds like a very naughty children to me, and they need to be treated as such.

My husband works for union – there are 3 main problems and if we don’t get a handle on this we are DOOMED:

1. the “senior” people (ya know – the ones that are going to make the awesome benes when they retire?) DON’T WORK? Why? Because there is no accountability – nobody makes ‘em and you can’t touch ‘em.
2. the other “senior” people (the ones you can’t lay off) who WANT to work, see their counterparts not working and say “why should I bust tail when they aren’t working so I’m not working either”
3. The less senior people – the ones whose jobs are on the line because of layoffs, are stuck – if they work hard (to cover for #1s and #2s) they get NOTHING except a layoff notice. Yeah, they may have their self-respect but the #1s and #2s are sucking the life out of whatever work ethic (??) is left.

Repeat 1 – 3 with county, state, city workers all over this country. PEUs MUST GO!!

Commercial unions negotiate for a greater percentage of the profits created by the workers. Public service unions fight for a greater percentage of the taxes collected by the government.

For too long, Democrats have seen higher taxes as increased profit.

When they get their vote back, the first item on the agenda must be deciding which programs or jobs must be cut to pay for the damages. The State is already bust.

It is important they have a full debate, including photos and charts with cost estimates from contractors, and any historical significance of items damaged

If there are videos of damage in progress, they must be shown. There should be security cameras

No matter the eventual out come—we have a hero! Who would have thought it would be a mild looking guy(like Clark Kent lol) from Wisconsin. Walker, our man of steel!!
