University of Wisconsin to investigate doctors who gave out fake sick notes to protesters

posted at 7:09 pm on February 21, 2011 by Allahpundit

Via Gateway Pundit, I’ve diagnosed the situation and can offer a prognosis: Wrist slaps for everyone.

These UW Health physicians were acting on their own and without the knowledge or approval of UW Health. These charges are very serious and in response, University of Wisconsin School of Medicine and Public Health and University of Wisconsin Medical Foundation, the UW Health entities that employ the physicians, have immediately launched an investigation of the reported behavior.

The investigation will identify which UW Health physicians were involved and whether their behavior constituted violations of medical ethics or University of Wisconsin and UW Health policies and work rules. The investigation and any potential future action will follow the established procedures of the University of Wisconsin. Any future disciplinary action taken will be considered a personnel matter and will be treated with the confidentiality required by University of Wisconsin policies.

At the Atlantic, Dr. Ford Vox is obviously sympathetic to the protests yet can’t quite believe his eyes as he watches one doctor after another write fake notes with lame excuses in full view of handheld cameras. He shared the various YouTube clips with a professor of bioethics at the Medical College of Wisconsin to get his take. Quote: “Holy mackerel!”

After viewing the videos at my request last night, Dr. Arthur Derse called me up exclaiming, “Holy mackerel! It’s much worse than it looked in the paper. I’m stunned, absolutely stunned.” Dr. Derse is the Director of Center for Bioethics and Medical Humanities a the Medical College of Wisconsin. “When all’s said and done, it’s really the profession of medicine that has the black eye in this case,” he says…

They’ve managed to belittle a public trust between physicians, employers and patients. A doctor’s sick note is a serious document. It represents an employer’s desire to verify through a respected, independent, medically qualified third party the fact of an illness and the true need for convalescence. In the videos now circulating online, we witness multiple members of a noted family medicine department trash one of the well-recognized rights and privileges of their profession, with little forethought as to the consequences…

I expect forthcoming complaints will center around this idea of fraudulent representation (and come from folks with obvious political agendas). Theoretically a school board official could make a complaint that their organization was financially harmed (many schools had to close due to the number of teachers at the protests, and some may have received pay on sick days). I’ll wager any complaining school board official will be a registered Republican.

He goes on to note, more in sorrow than in anger, that the explanations they gave on camera when confronted about doing this were, shall we say, pitiful. Ed posted one of the clips over the weekend (Vox has embedded several others at the end of his own post), but in case you missed it, here’s Andrew Breitbart himself politely requesting a sick note. As a gloss on all this, read Paul Hsieh at Pajamas Media wondering vis-a-vis ObamaCare how many others doctors out there are willing to flout ethical rules in the name of achieving “economic justice” or whatever. A little medical fraud for a “good cause” can surely be forgiven, no?

If my doc did this, I would find a new doc. It is unethical.

What a marvelous example for the children of Wisconsin, and indeed, the entire country.
Here teachers lie about being sick, while appearing openly and on camera waving signs claiming ridiculous absurdities at a political protest.
They do it with the cooperation of doctors, who also lie about the teachers being sick, openly and on camera.
There is a raging epidemic here alright. It’s a moral sickness.

Hope every one of these docs gets their licenses revoked. It’s nothing short of fraud.

And to the teachers who feel they must protest, have some cajones and ethics and take an unpaid personal day. The fact that they’re trying to get paid for not doing their jobs is precisely at the heart of why collective bargaining must go.

redfoxbluestate on February 21, 2011 at 8:27 PM

I’m a physician and I’m pretty sure if no insurance company was defrauded and it had nothing to do with prescribing that nothing will happen.

If a teacher were to be fired and used a “note” as a legal argument – then yes, a lot will happen. It’s nice it was out in the open.

Marcus, technically I imagine you’re right, though others will presumably be defrauded as a result of the notes (taxpayers who will be paying for these “sick days”). I would hope that there’s some penalty from the state medical licensing authority since any doctor writing notes to striking teachers is using the authority vested by the state to lie and, indirectly, to defraud.

We declare our right on this earth to be a man, to be a human being, to be respected as a human being, to be given the rights of a human being in this society, on this earth, in this day, which we intend to bring into existence by any means necessary. – Malcolm X

Malcolm X was just a thug and, therefore, likely too dim to understand that his ‘by any means necessary’ strategy was an affront to the very rights he sought to acquire. These doctors (and public employees) have no such excuse.

I have to question any doctor who is a liberal/supporter of nationalized healthcare. Who wants policies that will damage their own business? I’m not talking about profits, either. Liberalism is stupid/insane, therefore liberal doctors…well I don’t want them practicing medicine on me or my family.

The teachers providing the faux excuses are guilty of a committing the felony of filing false documents with a government agency (the school districts) in exchange for compensation and/or financial benefit.

The doctors who knowingly wrote the excuses are guilty of conspiracy to commit fraud against the government of Wisconsin, also a felony.

Walker should have his Attorney General file charges/seek indictment of every teacher who used the doctor excuse and the doctor issuing same, while terminating the teacher effective immediately.

Dunno about WI, but here in PA Mr. PPF had to pass the boards, get licensed, up to date with his career (which is incredibly complex in the med field) and that magic number called license IMHO is a stain on their career, wherever they decide to practice.

Send them to Iraq and the ‘Stans, to see if those lil’ forms will work there. Miss PPF got chicken pox and I am still not 100% “there” but I feel comfortably good enough to post here but not to blog. At home it’s a different story with my brain dealing with years of mental stupidity on part of psychiatrists. I despise Big Pharma.

Liberal doctors willing to give out fake sick notes in quantity to suit political causes probably would be willing to write death warrants in quantity for ObamaCare death panels.

Any physician shown purposely to give a fraudulent diagnosis should have privileges to write prescriptions immediately revoked. One willing to diagnose an illness purely for deceptive purposes is likely as willing to write prescriptions for narcotics for illicit resale in total absence of any genuine medical need.

Part of the fun of dealing with certain newbies, particularly the enraged, rabid ones Axelrod or Soros sends over, is trying to guess what their old user name was before their most recent banishment.

Do you know something that we don’t? Otherwise, please don’t instigate trouble. There’s enough going around as it is. No apologies for underhanded doctors, mind you, but unsupported allegations help no one. Here’s hoping that the doctors who bastardized their profession in Wisconsin will pay the price before their peers. As I understand it, this is the best we can hope for, unless you want to hope for a stray D/A to press criminal charges. That might be a stretch, although the facts of the matter seem to indicate a deliberate breaking of Wisconsin law. Time will tell.

1. The public taxpayer is their employer. Why are they afraid of us? And..

2. Why is the MSM including Fox not bringing up the fact that this is ALL public sector workers and not just teachers?

I’m impressed that they even called the fraud, “serious,” given what we’ve seen with drug pusher docs and the latest Medicare fraud bust.

I really think the focus should be on the teachers, though. It shouldn’t be hard to name the docs handing these notes out, so anyone with one of those could be at least questioned.

Being called to explain should embarass a few “honest” teachers.

AnninCA on February 22, 2011 at 7:08 AM

I agree with AP. Wrist slaps all around by UW. Will the AMA or other medical institutions get involved in this matter? If so, can the Docs licences be suspended or revoked? Any one know how these matters are usually investigated or handled?

dddave on February 22, 2011 at 7:08 AM

I do not see the UW doingmuch more than wrist slapping or a stern talk. They have already said the complaints will not be private, setting up the excuse they use later to not tell anybody. Why are they the last to see this happening and why did they have to have their faces rubbed in it to react? I did not see the AMA doing anything in California about doctors who write fake ‘scipts for people who wanted to get high on ‘medical marijuana’. How many licenses were pulled when those clinics were shut down? And those doctors were doing that for pure profit, here they will have the excuse of doing it ‘for a good cause’.

SilntThnkr on February 22, 2011 at 7:32 AM

Here in Texas – any member of the public can report a physician to the State Medical Board for whatever reason and usually it will at least generate a headache for the physician.

University of Wisconsin School of Medicine and Public Health and University of Wisconsin Medical Foundation, the UW Health entities that employ the physicians

Believe me a doctor is not employed by the State Medical Board. They gave you the license and they can pull it. I don’t know if Wisconsin’s is as “strict” as Texas’ but it was a trade off for malpractice reform here.

We had docs in Montana handing out medical MJ scripts after ‘seeing’ patients in cyber space. Luckily, we have a judge here who didn’t buy it. Pot shops have sprung up like noxious weeds in this state. This is what liberalism will get you. Hope WI takes care of those docs.

I think if the U of W fails to fire these physicians for their gross and flagrant misconduct, Congress should direct NIH to withhold all grants from U of W as it would then be clear U of W does not follow the ethics necessary for medical research.

I did some digging and found this interesting tidbit…

“Moreover, the bill would repeal all bargaining rights for home health care workers, University of Wisconsin System faculty and academic staff, and employees of University of Wisconsin Hospitals and Clinics.”

Sounds like the Doc’s may have some skin in the issue and was not done out of their sense of generosity and compassion?

These “Docs” handing out notes to one and all must have one of two problems. Either they don’t understand good medicine or don’t understand professional ethics. Either way or both, they are wrong and should no longer be trusted by patients. The woman doc I watched on FOX last night seemed kind of embarrassed by her role. Maybe there’s hope for her.

Liberal journalists have destroyed the credibility of journalism. Liberal doctors are following suit.

1 judge + 1 video + 1 fraudlent note =

I’d say it = Jail time.

Conspiring to defraud the government. These doctors are knowingly conspiring with the teachers to defraud the schools.

Wrist slaps?!? That’s too harsh. Finger wags & “tsk-tsk”s for all.

The sad reality here is…this won’t punish these unethical doctors, who are obviously more then willing to do this, and more for their god Obama.

This is going to hurt legitimate, hard working, ethical doctors, who take their oath, and practice very seriously. They’ll be frowned apon, and looked at with suspicion here on out.

It’s just disgusting what Obama and his goons have done to this country. They’ve corrupted it to the point, I can’t see the light at the end of the tunnel anymore.

Are you coordinating a mass defection?

I’m ‘cubbiegal’ over there(been there for a while)-but don’t look for me much.
I prefer it here.

Agree with Annoying; prefer it here, but I signed up at MM yesterday as ConservativeMom.

Worth repeating.

MM registrations are now closed. Oh well, maybe next time.
