Abortionist faces eight counts of murder in Philadelphia; Update: How did he escape notice so long? “By design

posted at 2:55 pm on January 19, 2011 by Ed Morrissey

This may be as ghastly a story outside of the Tucson massacre as we’ll see all year … I hope.  An abortionist arrested in Philadelphia faces eight counts of murder, one for the death of a patient, and the other seven for killing babies who survived his botched abortions.  The district attorney alleges that Kermit Gosnell used a pair of scissors to sever their spinal cords:

A West Philadelphia abortion doctor, his wife and eight other suspects are now under arrest following a grand jury investigation.

Dr. Kermit Gosnell, 69, faces eight counts of murder in the deaths of a woman following a botched abortion at his office, along with the deaths of seven other babies who, prosecutors allege, were born alive following illegal late-term abortions and then were killed by severing their spinal cords with a pair of scissors. …

Gosnell is facing Murder in the 3rd Degree for the death of 41-year-old Karnamaya Mongar. Mrs. Mongar died on November 20, 2009 when she was overdosed with anesthetics prescribed by Gosnell. He is also facing seven Murder charges for the deaths of infants who were killed after being born viable and alive during the 6th, 7th and 8th month of pregnancy. Gosnell is also facing numerous other charges.

Gosnell is suspected of killing hundreds of living babies over the course of his 30 year practice. However, he is not charged because the records do not exist.

What a shock it must be to find that Gosnell didn’t keep records of his illegal abortions and outright murders.  This was no fly-by-night operation, either.  Gosnell made over $1.8 million in one year, the CBS affiliate in Philadelphia reports.  Also, Gosnell is reportedly the target of a federal probe into illegal prescriptions.

The district attorney felt the need to defend his prosecution to the media, for some reason:

“I am aware that abortion is a hot-button topic,” said District Attorney Seth Williams. “But as District Attorney, my job is to carry out the law. A doctor who knowingly and systematically mistreats female patients, to the point that one of them dies in his so-called care, commits murder under the law. A doctor who cuts into the necks severing the spinal cords of living, breathing babies, who would survive with proper medical attention, is committing murder under the law.”

Indeed.  And it says something about the current debate over abortion that Williams even had to explain this.  This is worse than the controversy in the 2008 presidential election about Barack Obama’s successful action to block a bill requiring doctors to provide care to babies born alive during abortion procedures.  This “doctor” allegedly went out of his way to kill them after the birth through a brutal and heartless procedure, not just neglect.  And he made a fortune from doing so.

My guess is that few people will rush to defend Gosnell’s alleged actions, apart from the fringe like Peter Singer who argue that parents should have the option of terminating an infant’s life past a live birth.  But this revelation will certainly linger in the minds of everyone else, and have people asking how many more Gosnells may be making their own fortunes through similar means.

Update: I’ve just started reading the grand jury report, which is sickening, but raises an important question — how did Gosnell get away with it for so long?  Forget about the murders of live babies for a moment and read this description of Gosnell’s work from the section titled “Butcher of women”:

One woman, for example, was left lying in place for hours after Gosnell tore her cervix and colon while trying, unsuccessfully, to extract the fetus. Relatives who came to pick her up were refused entry into the building; they had to threaten to call the police. They eventually found her inside, bleeding and incoherent, and transported her to the hospital, where doctors had to remove almost half a foot of her intestines.

On another occasion, Gosnell simply sent a patient home, after keeping her mother waiting for hours, without telling either of them that she still had fetal parts inside her. Gosnell insisted she was fine, even after signs of serious infection set in over the next several days. By the time her mother got her to the emergency room, she was unconscious and near death.

A nineteen-year-old girl was held for several hours after Gosnell punctured her uterus.  As a result of the delay, she fell into shock from blood loss, and had to undergo a hysterectomy.

One patient went into convulsions during an abortion, fell off the procedure table,  and hit her head on the floor.  Gosnell wouldn’t call an ambulance, and wouldn’t let the woman’s companion leave the building so that he could call an ambulance.

That’s at least three incidents where a hospital should have reported Gosnell’s butchery.  Why wasn’t he stopped then?  The politics of abortion (emphasis in the original):

We discovered that Pennsylvania’s Department of Health has deliberately chosen not to enforce laws that should afford patients at abortion clinics the same safeguards and assurances of quality health care as patients of other medical service providers. Even nail salons in Pennsylvania are monitored more closely for client safety.

The State Legislature has charged the Department of Health (DOH) with responsibility for writing and enforcing regulations to protect health and safety in abortion clinics as well as in hospitals and other health care facilities. Yet a significant difference exists between how DOH monitors abortion clinics and how it monitors facilities where other medical procedures are performed.

Indeed, the department has shown an utter disregard both for the safety of women who seek treatment at abortion clinics and for the health of fetuses after they have become viable. State health officials have also shown a disregard for the laws the department is supposed to enforce. Most appalling of all, the Department of Health’s neglect of abortion patients’ safety and of Pennsylvania laws is clearly not inadvertent: It is by design. …

State health officials knew that Gosnell and his clinic were offering unacceptable medical care to women and girls, yet DOH failed to take any action to stop the atrocities documented by this Grand Jury. These officials were far more protective of themselves when they testified before the Grand Jury. Even DOH lawyers, including the chief counsel, brought private attorneys with them – presumably at government expense.

Ghastly doesn’t begin to describe this.  Read the report at your own risk.

Actually, most Americans just don’t want the govt to be in charge of pregnancy. We don’t need or want a Department of Pregnancy. It’s pretty simple.

Not simple enough for those that want to shove their values down everyone’s throat via govt, but you can always can always go liberal. You’re halfway there.

Trying to use something ghastly to forward a political agenda is disgusting behavior, just like liberals are using Gabrielle Giffords.

Now seriously, sparky, people are aghast that little babies are being diced up on the surgical table, and sold off as rubbish.

Do I want government to step in when there’s fifty million dead babies? You’re damn right I do.

I find it fascinating that, in a world convinced of the existence of shades of moral gray, there are people who stick to their talking points like they’re damned black and white.

Yes, I’d like to gather enough people who feel as I do to force a turnaround on legalized murder so that it isn’t legal anymore.

Got a problem with that? Then you’re part of the problem. More’s the pity… another ‘conservative’ or ‘independent’ who can’t find it in his stone-cold heart to give a damn about a baby that isn’t his.

Go directly to hell, jackass, do not pass “Go”, and do not collect $200.00 USD. Currency’s worthless, anyhow.

…this case involves abortion and race…if we find that the doctor is also gay, we’ll have a trifecta…and the drive-by media’ll never let this see the light of day….

…in fact, I’m surprised that it’s come to light at all….

Puritan1648 on January 19, 2011 at 7:16 PM

So he killed a baby outside of the womb instead of inside, or partially inside. This is worse . . . why? Does the location of the fetus/baby determine its humanity? Does the right of the would-be mother to terminate her offspring end just because the baby is fully outside the birth canal?

Infanticide is a perfectly logical extension of abortion.

If it is not the role of government to protect an unborn child from murder at the hands of its own mother, government has no role.

The instructive part here, Moesart, is that I, unlike you, apparently, am not a damn anarchist.

Government has a role: protecting its citizens from acts of violence. In this case, babies from their mothers.

What a world, where we have to worry about that.

I don’t flipping hate government, it has its place, and that is: national defense, law enforcement, punishing murder, that kind of thing. Romans 13:4 tells us that government out to be there to do good by us, but also, to execute evildoers among the populace.

This is such a time. Take your V for Vendetta crap and shove it.

The activities of Obama’s HHS Secretary Kathleen Sebelius(D) top campaign contributor Dr. Tiller and this man were different how? So if Kermit Gosnell slaughtered tens of thousands, instead of just hundreds he would be a hero instead of a zero? Obama’s HHS Secretary Kathleen Sebelius(D) kept Tiller out of jail but this man deserves jail?

I’m not saying Tiller got what he deserved, I’m not saying Kermit Gosnell is getting what he deserves. I am saying that when you make excuses for state sanctioned and subsidized butchery then hypocrisy is the least concern.

My daughter gave birth to my grandchild Feb 28 2009.
So my little sweetie will be 1 yo here soon.
My husband & I were extremely disappointed in her bcs she & the father were not married & not even ‘together’ when she found out she was pregnant.
The 1st words out of the father’s mouth when my daughter told him she was pregnant was ‘abortion’.
Now this stupid young man, who is now an RN, truly loves his daughter & sees her when he can & pay child support etc.
He & my daughter are ‘dating’ & while I believe it probably will not end with them together, I pray this man has learned the error of that initial thought.
Bcs now a little angel is in this world whom my husband & I absolutely adore.
And to some women she would have been considered a ‘mistake’.

It is much worse than that “news video”…

from page eight of the Grand Jury report:

Over the years, there were hundreds of “snippings.” Sometimes, if Gosnell was
unavailable, the “snipping” was done by one of his fake doctors, or even by one of the
administrative staff. But all the employees of the Women’s Medical Society knew.
Everyone there acted as if it wasn’t murder at all.
Most of these acts cannot be prosecuted, because Gosnell destroyed the files.

He killed hundreds of babies, not seven.

But they are delusional unaware and will never accept that it was the dream of Margaret Sanger to have this man operated like he did. Frequent, often and mandatory for non-whites.

tjexcite on January 19, 2011 at 7:54 PM

I am horrified and saddened by the story. One important aspect that had not be mentioned at all, are the personal responsibility of the men and women for getting into a situation where they are faced with an “unwanted” pregnancy. Rape, incest, mother’s life or severe birth defects probaly represent a small number of these abortions.

On the one hand, many of those women who continue with the pregnancies, and had the children, will become welfare dependent. They often fail to raise their children properly, and many of those families would mire in generations of poverty, crimes and other social pathologies. How many posts, including myself, had decried the welfare queens and generations of dependence at other people’s expense. The truth is that there are not enough adoptive families, especially for black kids. So just saying let them have the babies and give them up for adoption will work as well as Barry’s green job projects.

On the other hand, if they chose to terminate the pregnancy, they have to live with making that ethical and moral dubious choice of abortion. They subject themselves to those medical risks. AND made possible for scum monsters like this Gosnell to continue to exist.

It is a no win situation for those women and society. How about some self discipline, moral and preventive birth control. The best way is NOT to get into those situation where there everyone, including the fetus, loses. The only ones who benefit are the amoral and criminal blood merchants.

I just spent the last 2 and a half hours reading the entire 281 page report. I couldn’t stop reading it, even though it evoked some powerful emotions in me (especially the pictures).

What pisses me off the most, if you’ll forgive the language, is the absolutely disgraceful way the DOH acted in this whole matter – that they couldn’t inspect abortion providers because they could be perceived as barring access to abortions. What a crock of fecal matter. Gosnell and his ‘staff’ certainly are to blame for all the deaths, but there are many more with blood on their hands. It struck me that if white women had been complaining, or showing up in the hospitals with perforated bowels/uteruses/etc, that the authorities would have been all over this years ago. But it was poor minority women, and Gosnell ran his chop shop in a bad part of town, so everybody looked the other way.

I’m not the praying sort, but I just got hit with another wave of emotion, and I think I need to pray tonight. My husband and I have just recently decided to try for a fourth and final child, and I’m finding myself angry at women I’ll never know for keeping this monster in business. I just don’t get it.

It’s nothing compared to the actual report. Gosnell decided it was easier and faster to perform abortions by having his untrained staff drug the patients, give them drugs to induce labor, and let the women deliver the babies. Then, sometimes hours later, he would show up to the clinic. The babies were dropped in toilets, on the floor, wherever the mothers were at the time. If Gosnell was there, and the babies were born alive, he killed them. He PREFERRED to induce labor and have the women deliver the babies, because it was easier and faster (for him), and allowed him to make more money.
Everyone who allowed this to continue should be in jail.

You’re not paying attention. Read the comments on the Chronicle piece, and note that the immediate spin is that our abortion facilities are clean, well-lighted places with soothing colors and soft music. “Scientific,” y’know.

Unlike, of course, the foul, dank, ill-lighted and smelly conditions of the Philadelphia “doctor’s” outlet.

warbaby on January 19, 2011 at 9:47 PM

I was just reading the comments on the Philly site.
This is a huge problem for liberals. There is no difference between this guy’s practice of baby killing and abortion, good old pro choice baby killing.
He had horrendous practices as far as cleanliness and drugs but the babies are just as dead.
No amount of liberal mental gymnastics can disguise it.
Bring the abortion debate, I’m ready.

Exactly! Just cause no one is rushing to defend Gosnell doesn’t mean this is going to be viewed as a blight on the abortion industry as a whole.

hoosiermama on January 19, 2011 at 9:55 PM

I’m having a hard time losing the snark, because this story is simultaneously enraging and heart-breaking. No father of a daughter could be affected in any other way.

Here’s the deal, folks: Don’t back away from this horror. Read it all, digest it, and NEVER FORGET EVER. The next time you’re given the opportunity to respond to some cretin’s “Safe, Legal and Rare” cant (and you will be, I assure you,) throw this in their face hard enough to leave a mark. Point out that windchimes-pastel lighting-and aromatherapy in the “clinic” doesn’t alter the fact that it leads to the exact same conclusion as in this case.

And never, ever, forget to finish up with the fact that the only difference between this monster and Planned Parenthood is that he didn’t have as large an advertising budget.

Dear Lord, grant me patience and charity – and never let me forget that Evil is real.

warbaby on January 19, 2011 at 10:00 PM

Every pro-life American should spend time in prayer outside of an abortion mill.

What about our pro-life atheist friends? They exist, you know.
The pro-life movement needs more human philosophy and less evangelism. A discussion about the value of human life and the socially and personally destructive results that come from the trivial destruction of human life may have more sway than just saying, “God says so!”

Prayer is a shield for the soul, but wit, words, and demonstrable truths are the sword we need to slay this dragon.

If you believe, as many atheists seem to, that human beings are no more than animals, you don’t have any skin in the game to begin with. If you believe, as do I, that human beings are a special part of creation and set apart from the rest of it, then I suppose belief in God isn’t a strict necessisty for belief in the sanctity of life. I still don’t get it, though.

His victims had no choice. It was the mothers of his victims who came to him. And may God have mercy on those women’s souls.

hawkdriver on January 19, 2011 at 9:22 PM

Was thinking along those same lines about those here claiming to be pro-life and then saying we should let abortion go back to the states and let the states that want it have it.

I wonder if their eyes have been opened at all to the fact that this kind of butchery, that is not exclusive to Gosnell but is in fact the way every abortion mill operates, actual baby killing aside, should be forbidden everywhere?

Also, for wiw, I don’t think even a stellar person like Sarah Palin has a chance if this country remains entrenched in this kind of killing. It doesn’t make sense that we can turn the nation around and still allow this kind of barbarity. Abortion has hollowed and rotted the nation from within, to the point where an abortion monster like obama sits in the Oval Office.

As long as we allow it, abortion will empower our leftist enemies and continue to destroy our great nation, and no person can change that, nor even have a chance to do so, while abortion reigns supreme.

Instead of TEA meaning “taxed enough already”, why not “The End of Abortion”? Priorities. If we do right by our fellow human beings, the money part we can solve. The same thieves that are stealing from us are also, (what a coincidence!) abortion pushers. Get rid of them and we’re home free.
As Scripture says: “Seek ye first the kingdom of God, and all the rest will be given unto you”. Sounds just about right to me.

Gosnell is suspected of killing hundreds of living babies over the course of his 30 year practice. However, he is not charged because the records do not exist

Kansas Attorney General Kline was going after Tiller’s
records until he lost to his Sebelius-supported opponent.

Kline’s opponent in next week’s election, Paul Morrison, “promised to drop the investigations of Tiller, who has dumped thousands of dollars into a stealth campaign against Kline through third part organizations.”http://www.wnd.com/?pageId=38711

Kline goes after Tiller’s records.
Tiller gives $100,000 to Dem Gov Assoc in the middle of Sebelius’s campaign.
Sebelius supports Morrison.
Morrison beats Kline.
Tiller investigation goes away.

Then some nutjob takes the law into his own hands and kills Tiller.

I’m glad Dr. Kermit Gosnell met justice in the correct manner.

WE NEED TO KEEP THE REQUESTS FOR RECORDS GOING, Y’ALL. These “doctors” are supporting the coersive rape of young girls in addition to killing children.

This is a losing social issue for the party. Don’t let the SOCONs suck you in to a tear-jerking loser issue like this. Our tents not big enough. Let’s concentrate on lowering our taxes. Moderates will never vote for people who don’t support women’s health rights. I don’t like the idea of abortion but I believe it’s a woman’s right to choose.

How’s that 10 year old doing with her “choice” moron? She is being raped by her dad or some other thug, and the abortionist is hiding the evidence to help her.

WWCathodeRay on January 19, 2011 at 11:11 PM

Woah, just found this in the grand jury’s report.

The abortionist recommended his patients be put to sleep (by a highschool student) if “Your decision has been forced by your parents or partner.”

Most people would help a woman who was being forced into abortion, but not this champ.

Perhaps one good thing which can come from this news is greater national attention this next Monday for the annual March for Life in DC? Maybe if Ed or AP sees this comment they might post something on the march. I might have missed it last year but coverage was lamentably sparse if I recall correctly.

I thought back alley butchery wouldn’t happen anymore once abortions were safe, legal and rare? Well, legal, anyway.

lperello on January 20, 2011 at 7:03 AM

What an animal…

Randy Hutchins testified that Gosnell told him about what has been called the “Mother’s Day Massacre.” According to a February 25, 2010, article in The Philadelphia Inquirer, Gosnell offered to perform abortions on 15 poor women who were bused to his clinic from Chicago on Mother’s Day 1972, in their second trimester of pregnancy.
Unbeknownst to the women, Gosnell planned to use an experimental device called a “super coil” developed by a California man named Harvey Karman, who had run an underground abortion service in the 1950s. Hutchins related what Gosnell explained to him: At the time that he agreed to do this, there was a device that he and a psychologist were working on that was supposed to be plastic – basically plastic razors that were formed into a ball. All right. They were coated into a gel, so that they would remain closed. These would be inserted into the woman’s uterus. And after several hours of body temperature, it would then – the gel would melt and these things would spring open, supposedly cutting up the fetus, and the fetus would be expelled. The problem was that they never tested it. They didn’t test it on any animals. They never did any – any – any other human trials. This was not something that was sanctioned by the FDA. This was just something that he decided – he and this guy decided they were going to use on these women.

DethMetalCookieMonst on January 20, 2011 at 8:42 AM

Find out if his mother “intended ” to abort him. Obama says that’s sufficient reason to murder a fully born son or daughter, but he cleverly neglected to tell us how long that intent clause lasted. Devious, those Harvard trained constitutional lawyers, but what does one expect from a place founded to educate men of God.

Don L on January 20, 2011 at 8:45 AM

Poor liitle kids, he had them right in his crosshairs.

Don L on January 20, 2011 at 8:46 AM

With abortions legal in the United States, I thought the horrors of back-alley abortions were supposed to be a thing of the past. Now we’re finding out differently.

Or maybe the real horror is…..this is what abortion clinics actually are like.

itsspideyman on January 20, 2011 at 9:06 AM

What is amazing is that this man has done exactly what Obama aggressively fought for, and tried to institute a new legal term to cover this undeniable murder “Intent” Obama didn’t say how many years after the baby survived the abortionist first attempt, that this “intent to abort” loophole lasted, nor did he say that scissors couldn’t be used. This man did the exact evil that Obama loves.

I would argue that this president was elected, in part, for the very same reason that this man will go to jail. That’s called Obamacide -soon to be the inner sould of Obamacare.

God help us from ourselves.
