Abortionist faces eight counts of murder in Philadelphia; Update: How did he escape notice so long? “By design

posted at 2:55 pm on January 19, 2011 by Ed Morrissey

This may be as ghastly a story outside of the Tucson massacre as we’ll see all year … I hope.  An abortionist arrested in Philadelphia faces eight counts of murder, one for the death of a patient, and the other seven for killing babies who survived his botched abortions.  The district attorney alleges that Kermit Gosnell used a pair of scissors to sever their spinal cords:

A West Philadelphia abortion doctor, his wife and eight other suspects are now under arrest following a grand jury investigation.

Dr. Kermit Gosnell, 69, faces eight counts of murder in the deaths of a woman following a botched abortion at his office, along with the deaths of seven other babies who, prosecutors allege, were born alive following illegal late-term abortions and then were killed by severing their spinal cords with a pair of scissors. …

Gosnell is facing Murder in the 3rd Degree for the death of 41-year-old Karnamaya Mongar. Mrs. Mongar died on November 20, 2009 when she was overdosed with anesthetics prescribed by Gosnell. He is also facing seven Murder charges for the deaths of infants who were killed after being born viable and alive during the 6th, 7th and 8th month of pregnancy. Gosnell is also facing numerous other charges.

Gosnell is suspected of killing hundreds of living babies over the course of his 30 year practice. However, he is not charged because the records do not exist.

What a shock it must be to find that Gosnell didn’t keep records of his illegal abortions and outright murders.  This was no fly-by-night operation, either.  Gosnell made over $1.8 million in one year, the CBS affiliate in Philadelphia reports.  Also, Gosnell is reportedly the target of a federal probe into illegal prescriptions.

The district attorney felt the need to defend his prosecution to the media, for some reason:

“I am aware that abortion is a hot-button topic,” said District Attorney Seth Williams. “But as District Attorney, my job is to carry out the law. A doctor who knowingly and systematically mistreats female patients, to the point that one of them dies in his so-called care, commits murder under the law. A doctor who cuts into the necks severing the spinal cords of living, breathing babies, who would survive with proper medical attention, is committing murder under the law.”

Indeed.  And it says something about the current debate over abortion that Williams even had to explain this.  This is worse than the controversy in the 2008 presidential election about Barack Obama’s successful action to block a bill requiring doctors to provide care to babies born alive during abortion procedures.  This “doctor” allegedly went out of his way to kill them after the birth through a brutal and heartless procedure, not just neglect.  And he made a fortune from doing so.

My guess is that few people will rush to defend Gosnell’s alleged actions, apart from the fringe like Peter Singer who argue that parents should have the option of terminating an infant’s life past a live birth.  But this revelation will certainly linger in the minds of everyone else, and have people asking how many more Gosnells may be making their own fortunes through similar means.

Update: I’ve just started reading the grand jury report, which is sickening, but raises an important question — how did Gosnell get away with it for so long?  Forget about the murders of live babies for a moment and read this description of Gosnell’s work from the section titled “Butcher of women”:

One woman, for example, was left lying in place for hours after Gosnell tore her cervix and colon while trying, unsuccessfully, to extract the fetus. Relatives who came to pick her up were refused entry into the building; they had to threaten to call the police. They eventually found her inside, bleeding and incoherent, and transported her to the hospital, where doctors had to remove almost half a foot of her intestines.

On another occasion, Gosnell simply sent a patient home, after keeping her mother waiting for hours, without telling either of them that she still had fetal parts inside her. Gosnell insisted she was fine, even after signs of serious infection set in over the next several days. By the time her mother got her to the emergency room, she was unconscious and near death.

A nineteen-year-old girl was held for several hours after Gosnell punctured her uterus.  As a result of the delay, she fell into shock from blood loss, and had to undergo a hysterectomy.

One patient went into convulsions during an abortion, fell off the procedure table,  and hit her head on the floor.  Gosnell wouldn’t call an ambulance, and wouldn’t let the woman’s companion leave the building so that he could call an ambulance.

That’s at least three incidents where a hospital should have reported Gosnell’s butchery.  Why wasn’t he stopped then?  The politics of abortion (emphasis in the original):

We discovered that Pennsylvania’s Department of Health has deliberately chosen not to enforce laws that should afford patients at abortion clinics the same safeguards and assurances of quality health care as patients of other medical service providers. Even nail salons in Pennsylvania are monitored more closely for client safety.

The State Legislature has charged the Department of Health (DOH) with responsibility for writing and enforcing regulations to protect health and safety in abortion clinics as well as in hospitals and other health care facilities. Yet a significant difference exists between how DOH monitors abortion clinics and how it monitors facilities where other medical procedures are performed.

Indeed, the department has shown an utter disregard both for the safety of women who seek treatment at abortion clinics and for the health of fetuses after they have become viable. State health officials have also shown a disregard for the laws the department is supposed to enforce. Most appalling of all, the Department of Health’s neglect of abortion patients’ safety and of Pennsylvania laws is clearly not inadvertent: It is by design. …

State health officials knew that Gosnell and his clinic were offering unacceptable medical care to women and girls, yet DOH failed to take any action to stop the atrocities documented by this Grand Jury. These officials were far more protective of themselves when they testified before the Grand Jury. Even DOH lawyers, including the chief counsel, brought private attorneys with them – presumably at government expense.

Ghastly doesn’t begin to describe this.  Read the report at your own risk.

I am neither a particularly religious man nor much of a praying man (which I’m working on … have patience with us old agnostics) … but after reading this, I got right down on my knees and prayed for forgiveness for our whole stupid species.

We all need it. All of us. That we let this go on is … unspeakable. An abomination, in the ancient and biblical sense of the word.

If there is a God up there, He is not impressed.

I hope he’s a whole lot more merciful than we are.

This is the worst thing I’ve ever read.

The history books may well look at us in much the same way we look at late-1930′s Germany.

As I said elsewhere, this period in history – our enshrining abortion as not only legal but a protected Constitutional right – will be viewed as having a place along side slavery, communism, fascism, and totalitarianism.

Even the arguments for abortion are the same: read the discussions of the left on this topic – then compare to 1840s debates over abolition or 1930s debates in Germany over the coming “final solution.” The arguments are, almost word for word, identical. The denial of humanity; the preservation of property rights over human rights; the elevation of evil to the sanctified and the debasement of the sacred until it is viewed as meaningless.

This is evil. And to whoever said there are no shade of evil, you could not be more wrong. There are countless degrees of evil, and this … this may mark the greatest height to which evil can aspire.

God forgive us.

Everyone agrees that what Loughner did was evil. And there is one factor in his defense: he is utterly, unquestionably insane. Crazy as an outhouse rat.

By comparison, this guy will be called a hero by some. In this case, the district attorney – who really is a hero, by the way – actually has to DEFEND his decision to prosecute this murdering sub-human scum. People will actually argue that most of what this guy did is protected constitutionally – when we should ALL be repulsed and horrified by every thing he stands for.

And while Loughner was motivated by a whole boatload of crazy, this guy was motivated by money. By profit.

Loughner isn’t even in this guy’s league. This is old school Evil with a capital E.

On March 30, 2001, Obama was the only Illinois senator who rose to speak against a bill that would have protected babies who survived late term labor-induced abortion. Obama rose to object that if the bill passed, and a nine-month-old fetus survived a late-term labor-induced abortion was deemed to be a person who had a right to live, then the law would “forbid abortions to take place.” Obama further explained the equal protection clause of the Fourteenth Amendment does not allow somebody to kill a child, so if the law deemed a child who survived a late-term labor-induced abortion had a right to live, “then this would be an anti-abortion statute.”

This “doctor” allegedly went out of his way to kill them after the birth through a brutal and heartless procedure, not just neglect. And he made a fortune from doing so.

He only had to go ‘out of his way’ because he screwed up the abortion in the first place.

Partial-birth abortion is legal in Pennsylvania.

With this type of abortion you deliver the baby enough to expose the neck (but not fully so it doesn’t count as a live birth yet) and then you cut the spinal cord, vacuum out the brains, crush the skull, etc in order to ‘terminate the pregnancy’ before you finish delivering the infant.

The ONLY reason he’s getting charged with murder in these cases is because he didn’t manage to cut the spinal cords before the infant was completely delivered.

If this is enough to horrify people in PA, perhaps they should consider banning abortion of viable fetuses.

hillbillyjim on January 19, 2011 at 3:17 PM

Obama fully supports killing babies who survive an abortion.

““We don’t want to burden the original decision of the woman and the physician to induce labor and perform an abortion”

Michelle fully supports this exact manner of killing.

“This cynical ploy is designed to intimidate a group of physicians and force them to drop their lawsuit seeking to have the so-called partial birth abortion ban ruled unconstitutional.

The fact remains, with no provision to protect the health of the mother, this ban on a legitimate medical procedure is clearly unconstitutional and must be overturned.”

Vera on January 19, 2011 at 3:17 PM

Silly man, he’s supposed to leave part of the baby in the birth canal, then it’s legal. And the ridiculousness of that distinction will be used in his favor at his trial, I’d lay money on it.

Quisp on January 19, 2011 at 3:10 PM

And you know what? His attorney will be right: it actually IS a ridiculous distinction.

It’s just so horribly tragic that many people will try to resolve the distinction in favor of evil rather than in favor of common sense.

Logic is how I first began to understand the absolute ludicrous nature of pro-abortion arguments: it simply makes no sense to claim to defend life one day and then on some magical earlier day (which shifts and changes according to advances in technology, or differences in jurisdiction, or changes to prevailing statutes!) make it not only legal but a constitutional right?

Not just evil but absurd. In every way.

Logic is the first step in seeing the truth. The next step is research. The final step is emotional honesty about the whole thing … and that’s when it starts to hurt so much.

Most liberals are afraid to even ask the very first question, to even examine the faintest possibility that they might logically, factually, be wrong.

But this? This evil? This evil is so vast he even managed to eliminate that make-believe uncertainty.

I really look forward to seeing the response from the Left. I hope I am very wrong about their reaction. For some, I know I will be. I hope.

Why not wait another month or two and give your baby up for adoption so that it can be loved by people who desperately want to be parents?

Himmler would have found use for this “doctor” at Auschwitz.

sdd on January 19, 2011 at 3:23 PM

I’m sure the “doctor” just acted stupidly and all we need is another White House beer summit.

My guess is that few people will rush to defend Gosnell’s alleged actions

Ed, this man was providing healthcare. You might not like his means, but if we didn’t have men like Gosnell, who knows how many women would be forced back into the era of coat hangers!!! OMG!!! Ed wants to punish women!!!!

MeatHeadinCA on January 19, 2011 at 3:24 PM

This “doctor” allegedly went out of his way to kill them after the birth through a brutal and heartless procedure, not just neglect. And he made a fortune from doing so.

Money is usually what drives doctors that run abortion mills. Dr. George Tiller (RIH) also became very wealthy by killing babies.

slickwillie2001 on January 19, 2011 at 3:24 PM

The Obamassiah has more compassion that this so-called “Doctor”. Barry thinks you should just shove the newly aborted – that have the timidity to cling to life into a broom closet – for a couple of days if necessary.

Nuance.

GarandFan on January 19, 2011 at 3:24 PM

Even the arguments for abortion are the same: read the discussions of the left on this topic – then compare to 1840s debates over abolition or 1930s debates in Germany over the coming “final solution.” The arguments are, almost word for word, identical. The denial of humanity; the preservation of property rights over human rights; the elevation of evil to the sanctified and the debasement of the sacred until it is viewed as meaningless.

Why do you think the left loves to invoke “Godwin’s Law” as a means to snarkily end discussion? It’s much easier to hide behind a rhetorical crutch than to comprehend what you are actually defending.

Ghoulish with a capital G.

Geochelone on January 19, 2011 at 3:25 PM

Why not wait another month or two and give your baby up for adoption so that it can be loved by people who desperately want to be parents?

Common Sense on January 19, 2011 at 3:21 PM

This is one of the truly disgusting aspects of the abortion decision. So many of these women can kill their babies, but they can’t bear the thought of “giving them up”. That’s just sick.

Extrafishy on January 19, 2011 at 3:25 PM

once a society says that killing babies is A OK, what the hell difference does it make how the good doctor(sarc)kills?

ORconservative on January 19, 2011 at 3:19 PM

Exactly.

Missy on January 19, 2011 at 3:25 PM

A rich doctor performing unnecessary, dangerous and illegal procedures on women in the dead of night for profit being assisted by unlicensed “nurses.”

This has all the right words for the making of a major MSM story. The kind of story that they report on over and over and over again. The kind they obsess over and analyze with panels and experts ad nauseam. Maybe even the kind that gets made into a major motion picture or an Oprah special.

But because it has one other word: abortion, the MSM will cover it just long enough to inform everyone that this doctor is some kind of nut and not your normal humanity-loving abortionist. Then they’ll drop it like a hot rock.

29Victor on January 19, 2011 at 3:25 PM

Ghastly and utterly senseless. There are tens of thousands of parents waiting to adopt a newborn. They women had already carried them to almost full term. Why couldn’t they just give them away? Sickening.

*crickets chirping* from msdnc and cnn….just wanted to see if they actually give a darn…i didn’t get my hopes up…

cmsinaz on January 19, 2011 at 3:25 PM

Let’s not forget that the “good” method of killing babies at this age is to rip theim apart limb by limb inside the womb. Liberals defend this and say we’re the “American Taliban” for questioning this horror.

Vera on January 19, 2011 at 3:26 PM

This butcher is African-American, isn’t he? I wonder if he “served” a predominantly African-American clientele. Coming so close on the heels of MLK day, this story should continue the discussion on how abortionists target minority communities. I don’t know how black ministers, so many of whom I respect very much, having stood side-by-side with them to defend marriage, can remain silent (at best) while their flocks vote as a block for the baby-killing Democratic Party.

Exactly. I would argue that the good doc is more humane. It is quick.
I really hope this story is the catalyst for something good. Even pro abortion individuals have got to see the horror in this story.

ORconservative on January 19, 2011 at 3:26 PM

$1.8 million

While Obama is going after the greedy insurance companies and limb snatchers, this man is raking in the cash!

MeatHeadinCA on January 19, 2011 at 3:28 PM

This kind of horror is not uncommon in abortion mills. I had one abortion mill worker tell me that on particularly busy days, “you can smell the blood in the air”.

And please note: it is legal to sell body parts of aborted babies for “research” to anyone who comes into the abortion mill and pays a “fee” to use the room that they collect the parts in.

IOW, the money that changes hands is technically not for body parts, but for use of the abortion facility to collect the body parts. In this way, the body parts are never “sold” and the grisly trade continues. The mothers of these aborted children sign them away in the legalese small print and don’t even know it.

I have personally seen a list from a “broker” that sells these baby body parts to top university research labs. These children’s parts were listed like meat at the butcher’s shop: Lungs, Ears, Eyes, Intact brain, Legs and Arms intact or with feet and hands separately, Fingers, Testicles, Ovaries, Livers, Hearts, Kidneys, Intact Trunk, Intact Entire Body: ALL HAD THEIR PRICE and are being sold today as they were yesterday and will be tomorrow.

Ghoulish? No, just abortion; choice; Roe v Wade in all it’s glory; abortion protected in every way, in America. Let’s keep electing pro-aborts so this can continue, ok?

Please read the book, Lime 5 if you want to educate yourself on the Freddy Krueger-like horrors that are everyday occurances in our “safe”, legal abortion mills.

Sounds like this doctor just had an overstocked inventory. I say that so cavalierly because that is what we have allowed in our nation for 38 years! Why are we shocked at this? Why are we shocked that the nation’s Treasury has been looted by theives, when we have elected them as known murderers?

So, imo, because we continue to put the lives and rights of these tiny persons in the “doesn’t count” category, because our wallets are more important, we will continue to abet these horrors and will continue to elect degenerate monsters like obama who must be taking lessons from the abortionists, because I’ll be darned if obama isn’t about to sever the spinal cord of our nation.

And we’ll deserve it.

tigerlily on January 19, 2011 at 3:28 PM

Even pro abortion individuals have got to see the horror in this story.

ORconservative on January 19, 2011 at 3:26 PM

Yes, but they will convince themselves, with the help of the media, that this guy was an exception, that Planned Parenthood and the other enlightened reproductive health providers do abortion the “nice” way.

Missy on January 19, 2011 at 3:29 PM

I wonder … what percentage of pro-abortionists would be fine with this had the victims been the result of rape or incest?

MeatHeadinCA on January 19, 2011 at 3:29 PM

Dr. George Tiller (RIH) also became very wealthy by killing babies.

Yep. He donated tons of money to liberals all over Kansas, including our current HHS director. In fact, Ms. “I like killing babies” Sebelius actually hosted a fund raiser for Tiller inside the governors mansion during her time as governor.

Vera on January 19, 2011 at 3:29 PM

Ah, didn’t The One support a law in Illinois that supported this exact act in the event the doctor botched the abortion?

chickasaw42 on January 19, 2011 at 3:29 PM

So where did the money come from?
How much of the money he received was from tax payer dollars?
Will the media even investigate this?
*crickets*

Badger40 on January 19, 2011 at 3:30 PM

Even pro abortion individuals have got to see the horror in this story.

ORconservative on January 19, 2011 at 3:26 PM

Yes, they’ll see the “horror” of women being “forced” to go to a doctor like this and use it to argue for more lenient abortion laws and more funding for “education.”

29Victor on January 19, 2011 at 3:31 PM

I guess I wasn’t listening when Rush gave instructions for how to do this. And I must have also missed the how-to page on Sarah’s website. Because surely this kind of evil must have arisen from the strident voices of the right…
