Obama, EPA to expand regulatory regime for climate change

After initially appearing to retreat in the face of the midterm onslaught, Barack Obama and EPA Administrator Lisa Jackson have decided to pursue an end-run strategy to impose regulation on energy producers regarding greenhouse-gas emissions. The move sets up a confrontation between the White House and Congress, which has already signaled a willingness to play hardball with Obama on regulatory innovation:
The Obama administration is expected to roll out a major greenhouse gas policy for power plants and refineries as soon as Wednesday, signaling it won’t back off its push to fight climate change in the face of mounting opposition on Capitol Hill.
The Environmental Protection Agency has agreed to a schedule for setting greenhouse gas emission limits, known as “performance standards,” for the nation’s two biggest carbon-emitting industries, POLITICO has learned.
Under the schedule agreed to by EPA, states and environmental groups, the agency will issue a draft greenhouse gas performance standard for power plants by July 2011 and a final rule by May 2012. The agreement – which comes after states and environmentalists challenged the George W. Bush administration’s failure to set the standards – requires EPA to issue a draft limit for refineries by Dec. 2011 and a final rule by Nov. 2012.
The White House Office of Management and Budget has signed off on the schedule, according to a litigant in the legal fight.
Earlier, it appeared that the White House had backed away from the regulatory approach, at least for the next year or so. This change comes at an unusual moment when Obama had started to win some bipartisan cooperation from Congress on his other priorities, notably START and DADT. Whatever momentum and trust Obama built with that and the tax deal will rapidly dissipate if the EPA starts operating outside authority granted or desired by Congress.
The incoming Congress has many tools to block or slow the regulatory growth, one of which Harry Reid handed to Republicans this week. The GOP will have the ability to shape funding for the EPA for the final six months of this fiscal year. Congress can either mandate that no funds be spent from EPA’s budget for the purpose of creating or enforcing greenhouse-gas emissions, or they can defund the agency entirely after March 4th. The latter will almost certainly set up a government-shutdown confrontation, but the former probably wouldn’t, especially since a few red-state Senators would likely join the Republicans in reining in Jackson. Jay Rockefeller already proposed a two-year moratorium on EPA regulatory expansion to prevent just this scenario.
Alternately, Congress could undo the regulatory changes by using the Congressional Review Act. That law gives Congress the power to undo regulations by executive branch agencies, and more importantly, bypasses the filibuster in the Senate. However, that would require Barack Obama’s signature, which means that the GOP would have to garner two-thirds of each chamber to override a veto — not terribly likely. That would still be a worthwhile exercise, especially with a presidential election approaching, as a way to frame Obama as an out-of-control regulator. The House could also drag Jackson to the Hill as often as they want to demand explanations under oath, and to make the process as uncomfortable as possible for the White House.
If Obama wants to play hardball, Republicans have lots of options. They just need to play hardball as well. We’ll see if this inspires them to do so.

Obama really needs some ‘enabling’ legislation so he can more effectively deal with the problems the nation is facing. We need strong leadership at the top to mediate between hostile factions, lower the temperature of the current political debates, lower the belligerence between competing special interest groups, and the only why the President can succeed is by Congress authorizing Presidential intervention in these issues.
Congress is paralyzed and that will only become more obvious as time passes. We need to enable the executive branch to write desperately needed regulations to deal with these accelerating problems.

Fannie Mae already holds the patent on the power outlet device and controls about 95% of all mortgages. Things change in less than a month though.
McConnell and Boehner have performed admirably to hold the line as much as they’ve done, over the last 4 years. They were outnumbered, during the first two of those and faced overwhelming force in the latter two. Especially considering a few of the left leaning Pub Senators like Snowe & Collins.

Here is what Krauthammer doesn’t understand about Obama’s comeback. There are a series of things that will overshadow DADT and START?(Do regular Americans even care about nuclear disarmament anymore?) that will happen before 2012 and playing around with smelly policies like Climate Change and cap-and tax is MUCH more likely to effect 2012 voters than something that few swing voters REALLY care about squeezed out with the lame duck majority at the end of 2010.
Secondly since I am on the Krauthammer theories there will be no “stimulus” with keeping tax rates the same. Corporation financial decisions to hire aren’t going to increase on news of the status quo. They are already operating under the parameters of the current tax rates and the upcoming cost of ObamaCare and the more he opposes any changes to those the longer 9-10% unemployment continues. This excitment about taxes not going up means hiring can start doesn’t extend to the financial departments of corporate America.

I followed your link and couldn’t find any such device. The closest thing I could find was a patent for a tamper-resistant outlet cover.
However, there are already “smart appliances” that have network connections allowing power companies or the government to shut down your heater, AC, clothes dryer, etc. Coupled with “smart meters” that allow minute-by-minute monitoring of your energy use, it’s not hard to imagine some bureaucracy mandating their installation, turning off your stuff when you’ve used too much CO2, and making sure you didn’t bypass the controls by verifying your reduced energy consumption.

I don’t think it has anything to do with the “science” anymore. Academics are getting billions in research grants, big power companies see it as a way to increase government subsidies and their monopoly in the market, Wall Street is envisioning a huge new trading market they can make money off of, governments see it as a way to increase their power over voters and leverage that into bigger budgets and campaign contributions, socialists and third-worlders see it as a way to redistribute wealth, and lawyers are scheming to file lawsuits claiming impossible to disprove climate damage by anyone who uses energy, which is just about everyone.

While many/some have fallen for this “Obama Triangulation”, it seems quite obvious that our residential President has no intention of abandoning the radical government intrusion into the private sector. Catman’s question begs repeating: “Who won the election back in November?” Yesterday we had the FCC impart their “authority” and now the EPA plans to flex it’s muscles with IMO Obama’s blessing. January can’t come soon enough to put this administration in check and shut down these departments that insist on running like they are in a third world country.
Republicans in office that refuse to recognize that this assault is not only predictable and a fundamental directive from Obama, will be put on immediate notice. Stop this insanity or you will be replaced by someone who will.

You may be right; but this seems as good a starting point as any to find out which way the new Republicans will go once they’re seated.
I’m hoping it’s still close enough to the election for them to remember what happened and have that color their first decision; and maybe get them in some good habits for a change.
If they’d held off and let Congress play it usually game for 6-12 months before trying this, I think you’d have been correct… but this soon? I’m hopeful the outcome might be different.
