Dem congressman: Hey, let’s impeach John Roberts

Via the Blaze, the logical conclusion to weeks of Democratic demagoguery aimed at the Supremes’ decision in the Citizens United case, which of course made it safe for swarthy foreigners to buy the election this year by donating to the Chamber of Commerce or something. This is almost too stupid to dignify with a response, but content is content. Essentially this tool wants you to believe that Roberts committed perjury during his confirmation hearings when he said he’d be an impartial “umpire” on the bench, which DeFazio took to be some sort of guarantee that Roberts would never overrule a precedent. That’s simply insane; no would-be judge, especially a Supreme Court nominee, would ever pledge to be bound by precedent under any and all circumstances. And no Democratic caucus would ever vote to impeach a conservative judge on these grounds for the simple reason that they want liberal judges to be free to overrule “problematic” precedents too when they’re back in the majority. In fact, here’s a choice excerpt from Kagan’s opening statement at her confirmation hearings. If Roberts got booted, bet your bottom dollar that the GOP would repay the favor vis-a-vis her promises of judicial “modesty.”
[T]he time I spent in the other branches of government remind me that it must also be a modest one – properly deferential to the decisions of the American people and their elected representatives.
What I most took away from those experiences was simple admiration for the democratic process. That process is often messy and frustrating, but the people of this country have great wisdom, and their representatives work hard to protect their interests. The Supreme Court, of course, has the responsibility of ensuring that our government never oversteps its proper bounds or violates the rights of individuals. But the Court must also recognize the limits on itself and respect the choices made by the American people…
I will make no pledges this week other than this one – that if confirmed, I will remember and abide by all these lessons. I will listen hard, to every party before the Court and to each of my colleagues. I will work hard. And I will do my best to consider every case impartially, modestly, with commitment to principle, and in accordance with law.
So there you have it: If Kagan starts voting to strike down statutes, out she goes. (In fact, there are already concrete examples of Obama appointees contradicting themselves at their confirmation hearings.) Not surprisingly, a legal scholar who spoke to the Journal basically rolled his eyes at DeFazio’s plan; by some measures, in fact, the Roberts Court is actually the most restrained in decades. But then, the point of DeFazio’s shpiel isn’t to actually stir up interest in impeaching Roberts, it’s to reinforce the Democrats’ scapegoating of outside money as the cause of all their midterm problems. The average liberal base voter hears this and thinks, “Wow! Not only is Citizens United ruining democracy, but Roberts is so corrupt that he’d actually perjure himself to serve his corporate masters!” A good smear is bound to help a bit with turnout, no? No wonder Alito doesn’t want to bother with the State of the Union this year.

Honestly, I’ve thought about impeaching judges as well. How do 4 judges find the 2nd amendment unconstitutional? Sotomayor should also face perjury charges.

Yeah, that was a pretty dumb thing to say. Partially because nominees can’t perjure themselves just by lying during the confirmation process, and partially because nothing Roberts said could possibly constitute perjury anyway. It was so dumb, in fact, that I don’t think anything said in the comments here could top it.

Congresscritters can’t be impeached. They can be censured and they can be voted out of office. Don’t let him get to you. He’s just trying to shake something loose to feel relevant and to irritate you.
Roberts was confirmed for the Chief Justice spot by a vote of 78-22 (Clarence Thomas was 52-48). So many voted for him because Americans look at him and listen to him and say “That’s what a chief justice should look and sound like”. Few want to go on record saying that he isn’t qualified.
The public breaks against Citizens United, but I don’t think it is an issue than any but a vanishing small segment of the population has any emotional attachment to. Heller, OTOH, big time enthusiasm and the public is very much in favor.

Look at the RCP link above and hone in on deFazio. In 2008 he won over 80% of the vote. The only poll done (300 LV) was three weeks ago and he was still under 50% and only 6 points up.
I sent his opponent, Art Robinson a little bit. Long shot, but what the heck.

Nah. If Roberts had even the slightest chance of being booted for this, it would mean we were living in some kind of (even more) socialist distopia – conservatives would probably all be in jail, RINOs would be ostracized from polite society, the Blue Dogs would represent the far right, Nancy Pelosi and Obama would be center-right, Michael Moore would be our centrist president, with Alan Grayson as his VP, Kucinich would be heading the Department of Peace, and the mainstream left would include Cindy Sheehan, Bill Ayers, and other charming folks.
Honestly, it wouldn’t be so bad. Granted, we’d have 100% Funemplyment, death panels, and re-education camps, but it would only be for a little while – just until the nukes went off.
And anyone left after that gets to live in a radioactive wasteland and observe evolution firsthand (take that, creationists!) as we devolve into a species of mutants.

I agree. Roberts especially. Whenever I have the chance to listen to him speak I am struck by what a colossal intellect he has yet there is no trace of hubris or arrogance. During his confirmation hearings he sat at the table by himself, no notes or anything of the type, and deftly hit every ball thrown to him into the upper deck.
Impeach, indeed.
This is a perfect example of why the founders constructed the judiciary in the way they did, to protect them from the petty passions of the legislature.
Is there someone in Texas that we can contact to manufacture a special cow branding iron that says “CONGRESS SHALL MAKE NO LAW…” such when someone like DeFazio makes a breathtakingly stupid statement like this, especially when the majority opinion of the court was so well written, we can brand his @ss?
On second thought, that would never work. If we branded every Congressman that defied the Constitution, the iron would melt.

You can not perjure yourself before the fact. If you give testimony that you intend or do not intend to do something in the future, and then do it/don’t, you have only changed your mind. At the time of testimony, your statement was true and can not be proved otherwise.
Perjury is lying about past facts.
