Gloria Allred: I have the Social Security letter about Whitman’s maid — with her husband’s handwriting on it

Via the boss emeritus, who’s not happy.

The Whitman household, contrary to the candidate’s flat denials, did in fact receive the red-flag letter six years ago. Contrary to Whitman campaign supporters’ insinuations that the maid stole the letter, she was apparently in legal, legitimate possession of it. Whitman’s husband gave it to her and passed the buck.

Will the campaign deny that Whitman’s husband’s handwriting is the real deal? Will they absolve Whitman by putting sole responsibility for the matter in her husband’s hands? Will they continue to harp on the maid’s fraudulent representation of her status in 2000, instead of dealing with the red flags [not just the no-match letter(s), but also the fact that Diaz-Santillan was banned from traveling back to Mexico] from 2003 onward?

You’ll find a PDF of the letter here, along with Allred’s observation that Nicky Diaz is the Rosa Parks of Latinas or something. Obviously there’s a question of whether the handwriting really does belong to Whitman’s husband, and at her own presser today (video of which you’ll find below), Whitman said she’s willing to take a polygraph if necessary to prove that she knew nothing about Diaz’s status until last year. It could be true: It’s not hard to imagine her husband going through a stack of bills, letters, etc, and glancing at the Social Security letter before deciding to just let Diaz deal with it. If so, that was negligent and negligence is no excuse, but it does suggest that Whitman’s not quite as culpable as Allred would have people believe. And as Whitman herself noted today, she started running for governor all the way back in February 2009 — five months before she fired Diaz. To repeat a point I made yesterday, if she had really known that Diaz was here illegally, wouldn’t she have unloaded her before the campaign to limit the political damage?

As for why she didn’t try to have Diaz deported:

Once she fired Diaz Santillan, Whitman said she told her senior campaign advisors about the matter but did not disclose it publicly because she did not want to turn the spotlight on the woman, whom she repeatedly described as a member of her “extended family.”

“I was not going to make an example of Nicky,” Whitman said, adding that this situation shows why the United States needs a temporary guest worker program and a reliable electronic method for employers to check the status of employees.

Whitman repeatedly refused to say whether Diaz Santillan should be deported, saying that was a matter for federal immigration authorities, and she acknowledged checking with her attorney to see if there was anything she could do to help legalize the woman. The attorney said no, at which point Whitman fired the housekeeper.

She’s doing the best she can here, obviously, not to lose Latino votes over this. Exit question: Is she going to lose votes over this? She fired the maid when she (allegedly) found out about her status and has been careful not to disparage her personally in talking about this. An election’s not going to turn on the fact of her husband’s negligence, is it?

From what I’ve heard, Allred claims the handwriting says “Take care of it”, addressed to the maid.

$10 says the maid took the letter and then lied to him, saying she cleared it up.

OK, just saw the PDF. Since it says “Nicky, please check on this”, it sounds like Whitman’s husband bought the “It’s a mistake!” story, gave the letter to the maid to fix, then either never followed up on it or was told “I fixed things” if he asked.

Still don’t see how this is Whitman’s problem if the maid is the one who was lying.

It seems to me the reasoning for why Whitman acted wrongly keeps moving. Are they mad that she fired the woman for being illegal and didn’t deport her, or that she didn’t check the woman out sufficiently and hired her in the first place or that she’s being insensitive to a woman for being here illegally by firing her or that she’s a racist for hiring her in the first place or for letting her go…

I’m lost.

I actually witnessed a similar situation to this with my own mother and our family cook (who wasn’t an illegal) but it was dealing with the cook’s withholding, which was beyond the ken of my widowed mother.
I can fully believe that this happened:

Earlier today Whitman said she would take a polygraph test — but Gloria says Nicky doesn’t have to take a polygraph test because she has the letter as proof, and “the evidence speaks for itself.”

So hubby hands a letter to the maid 6 or 7 years ago and asks her to take care of it, and this means Whitman is lying?

When the SSA sent the letters in 2003, the employee received a copy first and the employer got one 2 weeks later. Diaz was watching for it and took it before Whitman or her husband saw it.

I read the red flag letter. Show me where it is incumbent upon them to report her to the SSA? If this was the only letter received, then it’s likely he thought it could be an error.

John and Ken here in LA had an immigration expert on. He said that the letter also says that this letter was not grounds to fire her, could not be grounds for firing her, was not a comment on her residence status, and that if the letter was used to fire her they could incur legal liability for doing so.

Also, there is no obligation to reply to the letter. The Bush administration wanted to make a process to follow to give a safe haven for the employer who received such letters, but that process was challenged by the open boarders advocates, declared unconstitutional by Breyer’s brother — a judge in San Fran, and dropped by the Obama DOJ.

So, the letter says it was not a comment on her status and created no obligation to follow up on it. It also prohibited using the letter as grounds for firing the employee. Sounds like an impossible position for an employer.

Since she came from an employment agency and had been working for the Whitman’s for a few years w/o incident, the Whitman’s assumed that Nicki Diaz was a legal employee and that the Social Security Administration had made a clerical error. They trusted Nicki Diaz to straighten it out as suggested by the hand written note.

Occam’s Razor also says:

Since Nicki Diaz had forged documents and is now known to be a liar and criminal (using a fake SSN) she continued to lie and told the Whitman’s she took care of the error with the Social Security Administration.

I used to get letters from Social Security on employees that said their ss number did not match their names. Each one, when confronted, said it was a mistake. I sent them to the ss offices to clear it up before they could work another shift. 99% never returned.

Whatever was going with the 2003 letter something else happened in 2009 when Diaz was fired. Meg Whitman did take action at that time. The 2003 letter itself said that you may be violation the law if you do fire someone merely on receipt of the letter.

Well, if Allred has the letter with Mr. Whitman’s handwriting on it, wouldn’t she know what year the letter was from?

Official government correspondence is more likey than not dated. So, Allred is either incompetent or fabricating evidence. Seriously, some people need to calm the hell down and think things through instead of jumping into hyper-reaction mode.
