Sebelius: insurers who criticize ObamaCare may get locked out of system

posted at 11:36 am on September 10, 2010 by Ed Morrissey

Does ObamaCare trump the First Amendment?  HHS Secretary Kathleen Sebelius must think so.  Yesterday, after apparently tiring of criticism of the new law from the companies it will eventually put out of business, Sebelius offered to expedite that process for those who don’t take an opportunity to shut their mouths:

President Barack Obama’s top health official on Thursday warned the insurance industry that the administration won’t tolerate blaming premium hikes on the new health overhaul law.

“There will be zero tolerance for this type of misinformation and unjustified rate increases,” Health and Human Services Secretary Kathleen Sebelius said in a letter to the insurance lobby.

“Simply stated, we will not stand idly by as insurers blame their premium hikes and increased profits on the requirement that they provide consumers with basic protections,” Sebelius said. She warned that bad actors may be excluded from new health insurance markets that will open in 2014 under the law. They’d lose out on a big pool of customers, as many as 30 million people nationwide.

By those standards, Sebelius would have to exclude Medicare as well.  Four months ago, Medicare — which is under Sebelius’ authority — released a highly misleading brochure about the impact ObamaCare has on its consumers.  It stated that Medicare Advantage patients would “still receive guaranteed Medicare benefits,” which was never in question, but made it sound as though they would suffer no reduction in services or benefits from the $500 billion in cuts to the program.  It also bragged about changes in ObamaCare that had nothing to do with Medicare, including the mandate that insurers keep “children” on family policies until age 26 — a provision that does not include Medicare, for obvious reasons.

Rarely have we heard a Cabinet official tell Americans to stay out of political debates at the risk of losing their businesses.  It points out the danger in having government run industries and holding a position where politicians can actually destroy a business out of spite.  It also demonstrates the thin skin of our current administration, where Hope and Change means keeping your mouth shut and pretending that everyone is happy while businesses slowly circle the drain.

Of course, maybe Sebelius won’t go as far as to lock them out of the state exchanges for disputing the Official Smiley-Face Rhetoric Enforcement Squad at HHS.  Perhaps she’ll just send them to a re-education facility instead.

But not against Kathleen the Great’s Kansas City Royals. Come to think of it, the team was well-named, since Sebelius is acting like a queen instead of an elected official.

Let ‘em eat cake, and blue pain-killers if they get a heart attack.

Hey, Kathleen – my insurer is hiking my small business premiums by 64%-69% in January, in part (as they so stated) due to all the glorious “benefit enhancements” mandated by BarryCare… whether I want them or not. I think it’s time for you to STFU; at least the insurers are telling it like it is.

The agent/broker told the companies that BCBS told them it has to do with mandates/changes to policies (and provisions that the carriers have to make) for OBAMACARE.

The clients have already said they are going to have to LAY OFF EMPLOYEES to absorb the costs.

How many other companies are finding this out right now, or as renewals start in October?

I would really like to see people like Sebelius actually engage in a debate. If she is so sure of herself, let’s just put her on a stage along with an insurance company who claims the health care legislation is forcing a price increase and we will let them debate it. The insurance company can point to the legislative provisions they are accounting for and Sebelius can correct them where they are wrong. Surely, Sebelius could win that debate.

The health insurance companies will have to employ a code. They should send their customers data that shows a breakdown showing what each % of increase is due to, and if it’s Bammie say “by direction of the Department of Health and Human Services we cannot provide the reason for this increase”.

If Obama can shut down cardealers because he doesn’t like their politics, why not insurance companies? Never let a manufactured crisis go to waste?

clnurnberg on September 10, 2010 at 11:48 AM

Yes. There was an auto dealer on one of the Fox talk shows who said their dealership had been shut down and given to someone else. We all remember when dealerships were shut down, with little rhyme or reason.

Unfortunately, I can’t remember what kind of cars they sold, or where it was located (Detroit, maybe?) but they were the only such dealership in town, and had been there for years and years, and had done excellent business.

They were also Republicans. They were shut down, and their dealership given to someone else. They had to sell their inventory quickly, at a loss.

Hers was a voice crying in the wilderness, basically. I guess maybe people simply couldn’t believe such a thing would happen, so they just don’t believe it, unless it happens to them personally.

In this case, it seems to me any fool can tell that with all the new mandates, insurance companies simply must raise their rates. That should have been apparent to everyone from the beginning.

Yet now Sebelius is threatening any company who tells the truth of it with not allowing them into the exchange? (I hate the idea of an “exchange” so much, I hate to even type the word.)

I fear it is going to be like those dealerships. Just cries in the wilderness, while most Americans go about their business thinking everything is just fine.

Alana on September 10, 2010 at 9:55 PM

“Simply stated, we will not stand idly by as insurers blame their premium hikes and increased profits on the requirement that they provide consumers with basic protections,”

ObamaCare forces insurance companies to cover Pre-existing conditions for children (Sept. 2010) and adults (Jan 2011) and they have to provide free preventive care. Since the hospitals, doctors, nurses, medical equipment, lab tests aren’t free, our health insurance premiums will increase.

Then along came The Pale Rider…

Yoop on September 10, 2010 at 2:40 PM

Prophetic at all? You presumably quote a Eastwood movie of the same name. Remember that movies starts out with a reading from the Bible:

Revelation 6:8
And I looked, and behold a pale horse: and his name that sat on him was Death, and Hell followed with him. And power was given unto them over the fourth part of the earth, to kill with sword, and with hunger, and with death, and with the beasts of the earth.

Alana preceeds me with another prophetic statement. This too will be ignored except by a few like us, who read and study and try. But its like holding back a flood with a bucket. The ignorant a$$es all around us love this crap. They love their stupid jobs and stupid SUVs, and whatever handout they can get today, and their meth, and beer, and their cellphones.

It’s one thing for the govt to tell a business what to do when it’s a couple of car companies because we can just buy from the other guy, but when it gets to health care and the govt is the only guy in town, we’ll all be told to shut up. We already are since when you reach 65 years of age, you can no longer maintain the same level of coverage from your current insurance company.
