Video: Rangel fighting for politics or for a criminal defense?

Why won’t Charlie Rangel take a plea bargain to shut down the House ethics probe that threatens to do serious damage to the midterm efforts of Democrats? A panel on Fox News offers a couple of intriguing possibilities, including the idea that a plea bargain may leave Rangel open to criminal prosecution. Two attorneys, one of whom worked for Rangel years ago, chew over the implications of the upcoming trial:
While the saying that Arthur Aidala quotes is applicable in the normal justice system, it’s hardly true that in Congress one can “indict a ham sandwich.” If that were true in any objective sense, we would have seen a lot more “indictments” from the Ethics Committee than we have over the last two years, or even twenty years. Let’s not forget that Rangel’s trial will be the first in eight years in the House, and the last time a member got punished in any way (aside from the reprimand given Joe Wilson for “you lie!”) was James Traficant in 2002, who got expelled after being convicted of corruption in office in criminal court. Before that, Newt Gingrich got reprimanded for ethics violations in 1997.
It seems very doubtful that Rangel will face any criminal charges, and certainly a plea deal could be created that offers no admission of criminal guilt anyway. If Rangel wanted to avoid getting on law enforcement’s radar screen, the worst thing he could do would be to choose to pursue a defense under oath in the House that would set him up for perjury traps. He’d be cutting deals rather than grandstanding if that was really the concern — and Rangel is most likely bluffing anyway to force Democrats to give him the best possible deal to salvage his re-election chances.

When you get down to it, Rangel owes allegiance to no one in the current Dem Congress. Nor, for that matter, the current Administration. He was playing a game of chicken right up till he was informed that his case would be adjudicated by the Ethics Committee…and the reality set in that he might indeed face criminal charges unless he is given immunity by Congress or has some sort of immunity attached to any determination made by Congress.
But, he is not out of the game…yet. He can take down a good number of currently powerful folks on the Hill, should he decide to go all scorched earth when the end of the day arrives.

The truth is too simple. Rangel is accused of being crooked. He can quit.
His defense is trying to shift this to being accused of being black.
Resigning because you are black is admitting defeat for the cause.
Rangel knows he can hang in there and play the race card.

Just an observation. The standard for a Congressional ethics finding is “clear and convincing evidence.” Federal prosecutors deal in the realm of “probable cause.” Also, remember the Federal sentencing guidelines. Mr. Rangel may want a deal with the Feds about prison time before he cops to anything his House colleagues may lay on him.

Until the dems prosecute “white” politicians at the same rate as African American, he has a case.
Feinstein, Reid, Dodd, Frank, and many others (all white) have not been prosecuted, yet it seems only blacks are chosen to be the ones.

Could someone tell me if Charlie raises a couple million in campaign funds, doe’s he get to keep it if he decide’s to retire at a latter date or doe’s it go to some type of general fund? Because if he get’s to keep it you can bet Charlies packing it in for the little people. Remember the best way to help the poor is not to be one of them.
