Judge scoffs at pre-emption argument in AZ lawsuit

It didn’t take long for federal judge Susan Bolton to zero in on the holes in the Obama administration’s argument in their lawsuit against Arizona and its new must-enforce policy on immigration violations. Bolton, a Democratic appointee, shot holes in the Department of Justice’s pre-emption argument immediately, and in a broader sense wondered why the federal government concerned itself at all over Arizona’s get-tough policy on illegal immigration:
“Why can’t Arizona be as inhospitable as they wish to people who have entered or remained in the United States?” U.S. District Judge Susan Bolton asked in a pointed exchange with Deputy Solicitor General Edwin S. Kneedler. Her comment came during a rare federal court hearing in the Justice Department’s lawsuit against Arizona and Gov. Jan Brewer (R).
Bolton, a Democratic appointee, also questioned a core part of the Justice Department’s argument that she should declare the law unconstitutional: that it is “preempted” by federal law because immigration enforcement is an exclusive federal prerogative.
“How is there a preemption issue?” the judge asked. “I understand there may be other issues, but you’re arguing preemption. Where is the preemption if everybody who is arrested for some crime has their immigration status checked?”
Answer: there is none. Even the DoJ recognizes that. They have a BIET program that is designed to help local law enforcement personnel do exactly what the White House complains Arizona is doing. Checking people who are arrested or detained for valid ID, and probing their status if they fail to have it, is so basic to law enforcement that Bolton must feel as though she’s slipped into the Twilight Zone.
The answer to her first question will undoubtedly be that Arizona can’t discriminate against people in their desire to be inhospitable. But SB1070 contains language specifically prohibiting discrimination, and sets objective measures on identification that will constitute a positive assumption of legal status. If the DoJ wants to argue that Arizona is applying the law in an unconstitutional manner, then they would have reason to take Arizona to court — but not before the law goes into effect.
Based on the initial reactions of Bolton, the White House may get laughed out of court more quickly than first thought.

I live in San Clemente, CA, more than 70 miles from the Mexican border. Every time I drive to my home from the south, I drive through an immigration checkpoint on I-5. Sometimes it is wide open, and sometimes traffic is slowed to 10 MPH so that Border Patrol agents can look into cars. They stop people based solely on a five second visual inspection. No lawful contact requirement, no probable cause requirement, just appearance.
But it is the Arizona law that is draconian racism.

This is all a distraction from the transformation of this country… Obama and and Holder are basically saying that AZ can’t defend itself from the onslaught of illegal immigrants and the problems they bring and we don’t want to protect them from the onslaught of illegal immigrants and the problems they bring. So why not? Because they are future Democrat voters!
There have been article after article in the L A Times about central American illegal aliens self deporting because the work is drying up mostly because of the recession. If Aruzonans really want to end their illegal immigration problem then they should make sure that they aren’t hiring illegal immigrants… That is the first place to start!

Ah, for the good old days..remember when the last administration was in trouble for firing David Iglesias? For, as I recall, not going after a voter fraud case?
And there was a charge that they were recruiting dumb but conservative attorneys? One lefty blog called it affirmative action for Hitler youth. The liberal grapevine was sure that the DOJ would make fools of themselves with the idiot right wing zealots they had from top to bottom.
Quietly, they crept back to sniping about the war and the surge as performance of the DOJ was fine. But for months they had the talking points provided to the faithful.
The same goal they have here — just a different gambit.

I don’t understand why Mr. President thinks this is such a bad law. It should be the state’s business to handle illegal immigrants and laws should be made according to how big the problem is. Wyoming probably has nowhere near the problems that the southern border states have so they may not need stronger law enforcement, yet it sounds to me like that’s exactly what Arizona needs.

Well, you never know. I don’t trust Ruth Buzzi on SCOTUS, but some of the lower ones do have some integrity.
Gor example, Clintoon appointed Harold Baer to the Federal Court in Manhattan (the same Court where Holder wants to try KSM). In 2003, Baer ruled in a lawsuit brought by 9/11 family members that Iraq did play a role in the 9/11 attacks.
Of course the Left totally ignores that ruling, because it doesn’t fit their fantasy agenda. Just like they totally ignore Clinton’s Justice Department indictment directly linking Iraq to al Qaeda in 1998 when they indicted bin Laden.
And I’m pretty sure some of the Democrat Federal Judges Clinton appointed also ruled against Algore in Florida in November of 2000 when Al tried to steal a Presidential election. Can’t remember their names, but they were all Dem Judges.

Last time, Heritage Foundation (HotAir’s new owners) hired research to explicate ObamaCare prior to the Congressional vote that never happened.
Perhaps the mute button is on until the research is assembled on economic law.
But being so far behind Obama’s Curve on this new Marxist American Economy may be due to neoconservative spite to suffocate knowledge leading to support the Austrian School of Economy. Anything to smear Libertarian enlightenment. So much for being transformed by the Tea Party. Republicans fail to prevent Obama.

I realize Kneedler must have said a lot more than was reported in the article, but his reported responses to her questions, and his weak side arguments sure don’t impress.
He apparently wasn’t able to give a compelling explanation for how this law violates the preemption doctrine, so he threw in how ICE wouldn’t be able to handle the increased workload (totally lame argument), and then cited ‘serious’ foreign policy issues. Mexico completely disregards our immigration laws and encourages their citizens to break them. We’ve got foreign policy problems, all right, but Arizona isn’t creating them.

Sorry, Dear, but your side owns impeached Federal Judges in the modern era. Of the 5 Federal Judges impeached in the past 25 years, 4 were Democrat appointees. That’s not a record I would be proud of.
Of the Federal Judges impeached since 1986, Kent is the only one appointed by a Republican. And he resigned before he was removed.

It’s not over till it’s over. I just sat through a local case where a guy with endless pockets brought trumped up charges against a group of people he knew couldn’t afford to fight his lies. Any thinking person who trusted our justice system (an oxymoron, but still…) knew for sure the case would be thrown out of court. The plaintiff had a weak case, presented in emotional whines. In his opening remarks, the judge ridiculed the plaintiff and his case. He heard the straightforward strong defense, backed up by unassailable case law. And then he found in favor of the whiner guy with the endless pockets.
I wouldn’t put anything past the power of the BO crowd.

We’ve passed several laws prohibiting the hiring of illegal aliens — and been sued on all of them by the usual suspects, and so far we’ve won all the lawsuits. We’re going to win this one as well (despite the prognostications of all the self-described legal “experts” who post here).
Ironic, isn’t it, that they never seem to make the connection. Their own cultures, and Socialist, statist governments, etc., are so vastly superior to ours — which is why they’re risking their lives to cross the desert and escape the corrupt $hitholes that are their own countries so they can set up residence in ours.

The entire “preemption” argument is absurd on its face. The Constitution declares that where Congress has the power to make a law, it takes precedence over any state laws [Art. VI, Clause 3]:

You mean to tell me that a Deputy Solicitor General (one of the highest-ranking members of the Justice Department, and someone who spends most of his time arguing in the U.S. Supreme Court) was personally present in the courtroom of a district judge in Arizona arguing a motion for preliminary injunction?
That’s almost unheard-of. The Justice Department doesn’t even have people that high up in the food chain appearing in the lawsuits trying to have ObamaCare declared unconstitutional, for pete’s sake!

No “constitutional” scholar would risk his career on taking this case, only a gov. bureaucrat would sue Arizona.
When Obama loses this, this will allow every one to attack just how poor of a legal mind this guy is.
I hope they bring a dozen more suits against Arizona, keep bringing them Obama, it is revealing what you really are. An affirmative action college graduate, with an affirmative action law degree, who worked in an affirmative action job all of his life…including this one….just another affirmative action government employee.

Good for her, on several levels. First, not all Dem appointments are awful in legal terms, and ditto for the other side.
Second, she kept the focus on preemption on this issue, which really helps in the next step. They’ll have to defend it on that basis. And we’ve seen plenty of precedents where preemption has been challenged and successfully.
Third, Jan Brewer has kept her head and continued to focus on the basic and core issue, which is the state’s right to protect itself if the Feds fail to do so.
That’s the core argument, not race, in my opinion.
States have the right to handle the issues that drive up state taxpayer costs.
End of story.

I wouldn’t be too quick to assign a lot of import to the judge’s question.
She may well rule in favor of the defendants, but f you look at oral arguments before the Supreme Court, you commonly find Justices testing the basis and the limits of the arguments they hear by querying lawyers with extreme propositions.
You might also want to make it clear that Judge Bolton is consider the injunction requested by the Feds, not hearing the actual US v AZ case.

People, people, people, you have this new illegal immigration law all wrong.
Our Arizona law enforcement officers are merely doing the job our federal goverment won’t do.
Here is the trap the Hah-vard schooled leaders have entered: If the law is deemed illegal, we simply sue the federal justice department FOR NOT FOLLOWING THE LAW. Keep in mind, their defense is “we can’t have 50(or was it 57?) seperate immigration policies while allowing known sanctuary cities in California and other states.
They want us to believe they are the smartest we have?
While Obowma allows some NE states to enforce the same immigration law, he assaults ALL red states with select car dealer closures, extremely slow oil spill cleanup efforts in LA and kills offshore drilling which attacks Texas, Oklahoma and Louisiana, Obowma visits Florida for the flip-flopper Crist, avoids the Tennessee flood, avoids the flooods in the midwest “R” states last spring, avoids Oklahoma tornadoes and floods, halts Az border wall…..
Any pattern here?

The WaPo article leaves out one very important point when describing the AZ law.
What’s missing? The part about police ONLY being able to question people who have already been stopped for some other infraction.

Opened a new joint savings account at a bank last week. Guess what? They demanded to sees my drivers license and also my wife’s. Is that racial profiling? We are both Caucasian and German descent, and on my side a lot of Scotch Irish, English mixed in.

This is indeed true of the entire 0bama administration, not just the DoJ.
And these people are all LAWYERS ?!?!?!? They do one heck of a sloppy job at everything they do. As you said, they are blinded by their own leftist ideology. I would not want any of them representing me in a lawsuit.

Unfortunately, Affirmative Action in most of the Ivy League schools allows some atrociously unqualified minorities to get into professional degrees. It does NOBODY any favors – the most highly qualified minorities who would have gotten into these programs regardless of the color of their skin are judged unfairly against those who are less qualified, yet still got in.
Obama’s administration is FILLED with people who I am convinced would not have made it past the first cut to get into professional programs were it NOT for the fact that they are minorities.
Anyone who thinks that THIS was Martin Luther King’s “Dream” is sadly mistaken – I am sure that he wanted minorities to have an equal OPPORTUNITY to compete, not special consideration and lowered standards based on their race. It’s really sad…..

This is the reason. IF the States would push back and Demand the rights that are theirs the Fed would be out in the street holdin a tin cup.
Exempt themselves from healthscam and its provisions, enforce their own immigration laws, reject fed Funds and influences on schools, demand Federal Taxes be paid to the States and then forward only those funds less mandates that they believe the feds deserve.
“All rights not specifically relegated to the federal Gov’t are reserved to the States”
If the States would DEMAND their rights people would be free to move to those States they prefer to live in and they would be truely Free and we would not all become a liberal mecca like San Francisco Californica, Detroit or Chicago!

You have to put the /fake but accurate tags on something like that. You had people searching for something that didn’t exist, and wasted their time and effort.
