Swiss reject Polanski extradition request

The Swiss have rejected the American extradition request for Roman Polanski and have ended his house arrest.  The apparent reason?  They couldn’t be certain that there wasn’t a fault somewhere in the official request:

The 76-year-old French-Polish film director Roman Polanski will not be extradited to the USA. The freedom-restricting measures against him have been revoked. This announcement was made by Mrs Eveline Widmer-Schlumpf, head of the Swiss Federal Department of Justice and Police (FDJP), in Berne on Monday. The reason for the decision lies in the fact that it was not possible to exclude with the necessary certainty a fault in the US extradition request, although the issue was thoroughly examined. Moreover, also the principles of State action deriving from international public order were taken into account.

At the end of 2005 the US authorities issued an international search warrant against Roman Polanski due to sexual offence against a minor committed in 1977. On the basis of this international order of arrest, Roman Polanski was arrested on 26th September 2009 upon his arrival at the airport of Zürich and taken into provisional custody pending extradition. On 22nd October 2009 the US authorities filed a formal extradition request. On 4th December Roman Polanski was released from custody after depositing a 4.5 million franc bail and was granted house arrest under electronic monitoring in his chalet in Gstaad.

Let’s parse this a moment, shall we?  The Swiss point to no fault in the request.  In fact, they admit it was “thoroughly examined.”  Instead of acting on an extradition request that admittedly had no apparent fault, the Swiss refused because it might have a fault.  Somewhere.

What, are Swiss lawyers that incompetent?  Are their jurists that unintelligent?  By that standard, the entire legal system in Switzerland should be dismantled, its employees sent to remedial school, and perhaps the government should resign in favor of an absolute monarchy.  Assuming, of course, that anyone with an IQ above 70 can be found to hold the office.

Of course, this is not the case.  Switzerland just didn’t want to turn Polanski over to the US for fear of falling out of favor with the entertainment industry, and the EuroLeft that adores the child rapist Polanski.  When they couldn’t come up with a good reason, they had to claim that the lack of a good reason was reason enough to reject the request.

If Switzerland likes child rapists so much, perhaps we should send them more of ours.

Update: My friend Brant points out in the comments that “pederast” has a specific meaning regarding the victims; they’re boys, not girls.  I’ve changed the term out for “child rapist,” which is more accurate.

I think the Swiss bureaucrat(s) responsible for this ruling should be required to use Mr. Polanski for unmonitored chaperoning all future events involving their own preteen to mid-teenaged children.

The French had categorically refused to extradite him long before W took office. Polanski got arrested in Switzerland after Obama took office.

That being said, I don’t blame Obama for this. I blame the Swiss. The Obama administration did what it could do to get the extradition; the Swiss just love the EuroLeft and Hollywood more.

This whole Polanski obsession is a puzzlement to me. Usually Americans agree that when defendant rights are abused, the defendant goes free. Given that the State of California could not protect his pregnant wife from Charles Manson, it is not surprising that he fled when the State reneged on the plea arranged by the prosecutor, performed by the defense and accepted by the judge. And, given that the victim in the unlawful intercourse wants no further action, it becomes impossible to mete out the correct justice. The Polanski case is so unusual that leaving it to God’s justice seems far more appropriate.

Until September of 2009, Polanski was in a country (France) that outright refused to extradite him to the United State. When he travel out of France for a film festival the Swiss Government took him in to custody for extradition to the US. The Administration under Obama dragged its feet and lost. You can’t blame Bush for this. Well maybe you can, but it’s a very poorly thought out defense.

The Swiss do love Hollywood, and vice-versa. That’s proven fact. See “Charlie Chaplin”, who like Polanski also had a thing for teenaged girls. He moved to Switzerland at first to avoid the McCarthy hearings, but later stayed there after being charged under the Mann Act. Look it up some time.

By the way, the international arrest warrant for Polanski was issued on Bush’s watch. That doesn’t necessarily mean he had anything to do with it, but he didn’t stop it, either.

BTW, (Democrat) Bill Clinton had 8 years to get bin Laden, and did nothing. We all know how that turned out.

Ed, I think you need to do a bit more research before making such a pronouncement. From what I’ve read in the Polish press, the defense wanted a witness testimony from 2010, which would somehow show that the judge presiding over the original case was prejudice against Polanski. The American court refused to make that public, so the Swiss couldn’t determine whether extradition is justified or not.

The excuse is lame, but it’s there.

This is a pretext. The extradition request was proper so that should have been the end of it. But the Swiss were looking for an excuse. This is the rule of law in Switzerland: it is full of holes, just like their accursed (but delicious) cheese!

As infuriating as the Swiss action is, some good has come of this whole situation. Many people had forgotten the details about what Polanski did; the publicity around the extradition request reminded people once again what a sleazy dirtbag the guy really is. Also, Polanski himself had obviously become pretty complacent about the situation and apparently believed he could move around Europe freely and really had nothing to worry about from the U.S.; now he knows better.

It’s not justice, but it’s better than nothing.

That blows, but is anyone really surprised? I never thought in a million years that they would actually extradite him.
He’s guilty as sin, but the Swiss (or any Europeans, really) would have actually had the cojones to send him to face justice.

There really are two justice systems in the world. One for the regular people and one for the rich. and it’s a tragedy.

Somebody explain this to me: the glitterati have embraced Roman Polanski, who was convicted of drugging and raping a 13-year-old girl! Yet, they have blasted and plan on destroying Mel Gibson for being a mean drunk and saying hateful things.
