Daily Kos to sue Research 2000 over polling fraud

Many people have commented on the lack of accuracy coming from the Research 2000 polls commissioned by the Daily Kos, an effort to elevate the Kos community site from a blog to a news site.  Most of the blame for the outliers was placed on the site’s activist owner, but in an announcement today, Markos Moulitsas said that the polling firm had “defrauded” him, and that a lawsuit will follow in a couple of days:

I have just published a report by three statistics wizards showing, quite convincingly, that the weekly Research 2000 State of the Nation poll we ran the past year and a half was likely bunk. …

We contracted with Research 2000 to conduct polling and to provide us with the results of their surveys. Based on the report of the statisticians, it’s clear that we did not get what we paid for. We were defrauded by Research 2000, and while we don’t know if some or all of the data was fabricated or manipulated beyond recognition, we know we can’t trust it. Meanwhile, Research 2000 has refused to offer any explanation. Early in this process, I asked for and they offered to provide us with their raw data for independent analysis — which could potentially exculpate them. That was two weeks ago, and despite repeated promises to provide us that data, Research 2000 ultimately refused to do so. At one point, they claimed they couldn’t deliver them because their computers were down and they had to work out of a Kinkos office. Research 2000 was delivered a copy of the report early Monday morning, and though they quickly responded and promised a full response, once again the authors of the report heard nothing more. …

I want to feel stupid for being defrauded, but fact is Research 2000 had a good reputation in political circles. Among its clients the last two years have been KCCI-TV in Iowa, WCAX-TV in Vermont, WISC-TV in Wisconsin, WKYT-TV in Kentucky, Lee Enterprises, the Concord Monitor, The Florida Times-Union, WSBT-TV/WISH-TV/WANE-TV in Indiana, the St. Louis Post-Dispatch, the Bergen Record, and the Reno Gazette-Journal. In fact, just last week, in an email debate about robo-pollsters, I had a senior editor at a top DC-based political publication tell me that he’d “obviously” trust Research 2000 more than any automated pollsters, such as SurveyUSA. I didn’t trust Research 2000 more than I trusted SUSA (given their solid track record), but I did trust them. I got burned, and got burned bad.

Give Markos Moulitsas some credit for full disclosure, at least.  It would have been very easy for dKos to quietly drop Research 2000 as their pollster and put their resources into a more worthy vendor without ever explaining why.  That would have certainly cost them less than hiring attorneys to sue the pollster.  Given the fact that the firm claims to be operating “out of a Kinko’s office,” it seems less than certain that Markos will ever see much of his money returned to him, assuming he can prove fraud, which is not an easy task.

I’m also not inclined to crow over the failure of dKos polling.  That ship had sailed long ago anyway, and Markos knew it, which is why he launched an independent study of the data.  Political campaigns commission their own polls and so do traditional media outlets.  If Markos had the resources to do the same, why not?  It allowed him to play with the bigger outlets, although in the end the task proved beyond his ability to manage it.  Still, one never knows until one tries.

He also makes another good point:

Sure, our friends on the Right will get to take some cheap shots, and they should take advantage of the opportunity. But ultimately, this episode validates the reason why we released the internal numbers from Research 2000 — and why every media outlet should do the same from their pollster; without full transparency of results, this fraud would not have been uncovered. As difficult as it has been to learn that we were victims of that fraud, our commitment to accuracy and the truth is far more important than shielding ourselves from cheap shots from the Right.

Again, I’m disinclined to take cheap shots, mainly because Research 200o did have an existing clientele that lent respectability to their product.  It’s also important to note that this is Markos’ take, and that the firm itself will probably have a very different position on the end of their relationship.  But Markos is right when he warns that pollsters should provide full transparency for their surveys so that people can assess performance properly, such as sample size, question formulation, demographics, and so on.  Without that information, polls can easily manipulate both respondents and readers alike.

The only criticism that comes to mind is the lawsuit itself.  Why bother?  Markos would be better advised to cut his losses.

Update: Research 2000 denies all of the allegations:

R2K president Del Ali tells TPMmuckraker in an email, “I have much to say, however, I am following my attorney Richard Beckler’ ESQ’s counsel and referring all questions to him. I will tell you unequivocally that we conducted EVERY poll properly for the Daily Kos.”

Update (AP): I’ve linked Kos’s R2000 polls on HA before so I owe our readers a mea culpa for having passed along (possibly) bad info. Mea culpa!

That book of his is going to be rather highly nuanced indeed, huh?

It was no coincidence this transcript appeared at Mother jones on a day PPP had an impeccably timed poll and Majority PAC revealed a site targeting McConnell as chief GOP obstructionist. They didn’t have all that much so perhaps they figured they’d make a mountain out of a molehill. It totally backfired. As Rick Wilson said so eloquently:

“McConnell took their faux-drama and busted a cap in their a$$. He turned it within minutes into a legal, political and fundraising attack on MoJo, the DSCC, American Bridge and the rest,” said Rick Wilson, a GOP consultant based in Florida. “Really, quite impressive. Don’t let that softspoken thing fool you. He’ll cut a b*tch.”

I remember seeing a clip of him (years later) on MSNBC during the Lewinsky scandal where he said that, if Kathleen Willey had stayed home with her (on-the-verge-of-financial-ruin) husband instead of going to see President Bill Clinton for a job, her husband would still be alive.

IIRC, the husband committed suicide in a rural area in Virginia, not at home, and was gone from the residence when she left for Washington.

One sympathizes with people who suffer from mental illness. If you have ever been around somebody with psychological problems of the sort that necessitate hospitalization, you appreciate what a grim business that is.

The media has generated plenty of outrage about far lamer things. So, assuming you have no morals, it was a perfectly reasonable move.

McConnell more than the tactics involved hurt the left. They’re accusing him, essentially, of … campaigning.

The thing to note Allahpundit is that this is one of many looks into the professional left. They are drunk on the notion they can gain power by smearing and have no one to tell them they have EVER gone to far. They are justified in WHATEVER they do. This is the corruption the MSM has brought us to and theoretically what the First Amendment was suppose to save us from. The fact they can illegally obtain a conversation is irrelevant to their cult members as long as they have SOME screed about Republicans to add to the situation.

How else would you expect a group of people who could survive Benghazi without even a did in poll numbers and a solid re-election on its heels? Add in the opposition’s Presidential candidate worried about the trouble HE WILL BE IN if he talks about it!

Since McConnell did call this “Nixonian,” I’m obliged to say, “Follow the money.” The article you linked on how this turned into a victory for McConnell also admitted that it might turn into a financial windfall for Mother Jones, which is using this for fundraising. MoJo has experienced some financial difficulties recently, and so maybe it was money, not glory, which provided the operative(s) with the motivating incentive. And perhaps they think whatever method they used was justified in the case of “journalism.” Money motivates, and excuses excuse.

Because of course the enemy isn’t so desperate that they wouldn’t resort to bugging strategy meetings. Sorry but the private meeting was apparently small with long-time staffers. The enemy bugging the place is far more believable than somebody turning Judas.

There is a completely different set of rules for the left and for the right. You see, the right has abnormal or deviant thinking according to the left’s ideology. Their foundational axiom is that their view is the natural and normal view, and all deviations from it are abhorent. There is no rule or law that should stand in their way when they attempt to eradicate either thru censure or thru slaughter all those who hold the abherent view. Their entire worldview is irrational at its core. They understand neither cause nor effect. They do not understand simple syllogism. Their framework is not based on reason or truth but on the ever changing chemical reactions in their substantia nigra. They FEEL. The end.

It explains their childishness, their prolonged adolescence, their greed, their envy, their never ending fight for “fairness.” It also explains their viscousness, their dishonesty, their insincerity, and their constant focus on eroticism and violence.

I think that under the current circumstances, generally complete information, the revelation related in the recording is of no particular import, even nonsensical.

What might be good to remember is that nobody knows what kind of circumstances may arise during a campaign. Maybe something will happen or maybe not. Nothing to lose by making it a part of the public record.

For instance, there is concern about low-information voters. Think about it. Say something comes up during McConnell’s campaign, what, I have no idea, but something. Low-information voters would be told how McConnell’s campaign strategized how to “beat up” on some female opponent who had mental problems or something.

Imagine a twitter campaign that remembers bits and pieces of this. Even a fast response by McConnell might be effective, but then it would be a distraction, a source of diversion, and even if it does not work, it would be viewed as a potential assist to unseating McConnell.

Can someone explain to me why a McConnell staffer would run to mother Jones with this “tape” of ordinary campaign strategy meeting? For revenge? because the are and always have been a secret Democrat but became a Republican staffer years ago just for this occasion? How about the more likely explanation. Someone with access to this room wanting to be the next person with the “47 percent” tape recorded the meeting. I find it A LOT more likely much like the bartender of the Romney tape this is a Democrat working as office staff or something else.
