Via Mediaite, a longstanding mystery solved: Yes, things can get worse without Gibbs at the press briefings. There were three possible ways to answer this question. One: Burton could have taken the Jon Chait line and asked people to lay off Tony Hayward already. Hayward, after all, had a pretty busy few days last week too, no? But Burton can’t do that because Rahm Emanuel already demagogued Hayward for attending a yacht race over the weekend — on the very day, mind you, that Obama and Biden hit the links for a few hours — and besides, they need Hayward as their Snidely Whiplash to keep the public focused on blaming someone other than Obama for the spill.
Two: Burton could have insisted that Hayward deserves every bit of grief he gets but thrown conservatives a bone by admitting that the left’s criticism of Bush for spending time in Crawford or playing golf during the early days of the war was also overblown and unfair. The problem? Bush is an even bigger, more useful villain in the Hopenchange pageant than Hayward is, sort of an Emperor Palpatine to BP’s Darth Vader. Can’t go defending him, especially if it means knocking lefties who are already peeved with The One for not quite being the socialist of their dreams.
Three: Burton could have dodged the question and then said something smug and tin-eared about how much better off we all are when Obama gets to practice his putting. Any guesses which option he chose? Click play and watch this drive.

The main question is what kind of job is POTUS?
I was a surgical resident and am now a surgeon. My job requires me to be “at work” more often than say a bank teller or an accountant (80-100 hours/week, minimal vacation). High end lawyers spend 80+ hours a week “at work” and take very little vacation depending on the case load.
So does Obama have a large “case load”? Do his “patients” need his attention? Or when the doors close on the day, can he go home and relax with his family? I wish I could golf as much as he does. I wish I could travel as much as he does…I can’t.
When I used to daydream about being POTUS (sick) I always thought it would be 4 years of constant hard work…guess I got it wrong.

Time for Obama To Take Charge of Gulf Disaster

The Obama Administration has claimed that BP – a company under criminal probation at the time of the disaster – must continue to be in charge of managing the oil gusher despite the fact that BP has continuously prioritized its own self-interest ahead of relief efforts. BP has a financial incentive to underestimate the rate of the oil gusher, as the company’s liability is directly tied to the volume of oil released into the Gulf (hence the company’s role in denying scientists access to study the rate of the leak. BP continues to use the controversial chemical dispersant Corexit despite scientific warnings that Corexit is designed to be used on the ocean’s surface (not at 5,000 ft) so it can be broken down by sunlight – the environmental damage of dumping millions of gallons of Corexit might be as bad as oil, but of course BP will probably not be liable for damages related to Corexit pollution because Obama’s EPA continues to approve its use – so from BP’s vantage point they prioritize actions that limit their liability, consequences be damned . . .
Which brings us to the need for Obama to take charge . . .
Section 4201(a) of the Oil Pollution Act, which is codified at Title 33 of the United States Code, Section 1321(c), reads in part:
(c) Federal removal authority.
(1) General removal requirement.
(A) The President shall, in accordance with the National Contingency Plan and any appropriate Area Contingency Plan, ensure effective and immediate removal of a discharge, and mitigation or prevention of a substantial threat of a discharge, of oil or a hazardous substance–
(i) into or on the navigable waters;
(ii) on the adjoining shorelines to the navigable waters;
(iii) into or on the waters of the exclusive economic zone;
or
(iv) that may affect natural resources belonging to, appertaining to, or under the exclusive management authority of the United States.
(B) In carrying out this paragraph, the President may–
(i) remove or arrange for the removal of a discharge, and mitigate or prevent a substantial threat of a discharge, at any time;
(ii) direct or monitor all Federal, State, and private actions to remove a discharge; and
(iii) remove and, if necessary, destroy a vessel discharging, or threatening to discharge, by whatever means are available.
(2) Discharge posing substantial threat to public health or welfare.
(A) If a discharge, or a substantial threat of a discharge, of oil or a hazardous substance from a vessel, offshore facility, or onshore facility is of such a size or character as to be a substantial threat to the public health or welfare of the United States (including but not limited to fish, shellfish, wildlife, other natural resources, and the public and private beaches and shorelines of the United States), the President shall direct all Federal, State, and private actions to remove the discharge or to mitigate or prevent the threat of the discharge.
(B) In carrying out this paragraph, the President may, without regard to any other provision of law governing contracting procedures or employment of personnel by the Federal Government–
(i) remove or arrange for the removal of the discharge, or mitigate or prevent the substantial threat of the discharge; and
(ii) remove and, if necessary, destroy a vessel discharging, or threatening to discharge, by whatever means are available.
This appears to allow the President to generally direct oil spill cleanup efforts, and requires the President to direct oil spill cleanup efforts where there is a substantial threat to the public health or welfare.

Our soundbite culture will fall for this though because most will a) not know that in addition to his golfing Obama went to the Nationals/White Sox game on Friday, b) that he spent FIVE hours on the golf course (hey, were the girls with their dad on these outings?, c) he has done plenty of partaying and yucking it up on the tax payer dime since Day 1 of the oil spill. This is not a bug but a feature in the Obama presidency.
But we did learn something. Burton’s performance is like Obama’s ineffectual thuggery as described by Barone today; at least Gibbs passes the test on being an awful press secretary yet being able to artfully dodge probing questions (yeah right, like he gets many probing questions).

Tony Hayward deserves every bit of the criticism heaped on his head. He is the responsible CEO at the helm of this debacle. By the same token, ObaMao deserves the criticism for not immediately suspending the Jones Act and allowing international help in mitigating this disaster. He also deserves disdain for reneging on his responsibilities in not initiating the protocols spelled out by law regarding environmental disasters caused by oil spills. We are a nation of laws, and ObaMao is breaking them right and left.
