Breaking: WH will sue Arizona over SB1070

posted at 2:05 pm on June 18, 2010 by Ed Morrissey

CBS News reports that a “senior administration official” has confirmed to them that Hillary Clinton was telling the truth in the interview with an Ecuadorian media outlet.  The Obama administration will file a lawsuit in federal court to block Arizona’s new law requiring law-enforcement personnel to check immigration status while processing suspicious people already in custody:

It was unclear yesterday whether Clinton’s comments were simply a prediction or mistake or whether instead she was getting ahead of a planned announcement by the administration.

Now a senior administration official tells CBS News that the federal government will indeed formally challenge the law when Justice Department lawyers are finished building the case. The official said Justice is still working on building the case.

Wow … just wow.  What a tremendously incompetent manner in which to announce the decision.  The Obama administration informed the Ecuadorian people of this decision before the White House informed Americans.  I’m not sure if that’s Hope and Change, the New Transparency, or Smart Power.

Governor Jan Brewer blasted Obama and his administration for their handling of this policy direction.  I agree, but perhaps she can take comfort in it.  After all, an administration this inept is unlikely to successfully walk and chew gum at the same time, let alone challenge the validity of their new immigration-enforcement law.  Meanwhile, Obama will continue to pursue a policy that is even less popular than his ObamaCare bill, just in time for the midterm referendum on his first two years in office.

What happens when the administration loses that lawsuit? They really bank on winning more the Mexivote with this act? Their desperate schemes are so transparent it makes me sick.

My daily prayer is for God to reveal the ignorance and blatant stupidity of this nation by making an object lesson of their adored Obama. Looks like some prayers do get answered.

Keemo on June 18, 2010 at 2:56 PM

Look, Folks…

the fact is that there is nothing whatsoever wrong with the Arizona law. It is common for the Feds and states to have overlapping law, even in areas that are universally considered to be under a constitutional mandate. There are ample cases on this.

Ragspierre on June 18, 2010 at 2:56 PM

I thought the American government was supposed to work on belf of the American people. Silly me.

kingsjester on June 18, 2010 at 2:56 PM

There is no case to be made which would not be laughed out of court. Their only hope is to cherry-pick a judge, one of those wacky Clinton, Carter, or Obama appointees, to see a shadow of an umbrella somewhere and give them a hollow victory before the case is eventually thrown out. The Arizona statute was specifically and carefully drafted so as not to run afoul of federal jurisdiction.

All it will take for a loose confederation of Minuteman types to finally take a stand in Arizona and get in a shooting conflict with the Mexican police on U.S. soil.

As soon as a Mexican cop dies Obama will send in the Feds to protect the border jumpers. Other Minuteman types will go to Arizona, like jihadis to Iraq. When the Feds inevitably shoot down one of the Minuteman types, this will spiral out of control. It will make Waco and Ruby Ridge look like play. No question, in my mind, the resulting upheaval will then either bring down the Obama presidency OR result in declaration of martial law.

Either way, this lawsuit against Arizona likely is bringing on the endgame. Conflict is being forced by the president.

Enemy of the state.

Those signs were shocking considering some are located on US land over 100 miles north of the Mexico border! I’m a proud, ARMED Arizonan. The money this despicable administration will spend to sue our state could’ve been used to build the “damned” fence. They probably think that by putting up the warning signs it gives them cover from blame when Mexican drug-runners gun down another American citizen. Maybe Obama should put up the same sign before entering Chicago. They’ll say, “Hey, we warned you that you’d be entering at your own risk. We’re not responsible!” Convenient.

After drinking a potion of Saul Alinsky’s, Jeremiah Wright’s, Rahm Emanuel’s, David Axelrod’s, Bill Ayers’, Adolf Hitler’s, King George III, King Louis XVI and his own creation, Barack is transformed into the cruel, remorseless, pathological, misanthropic, pyromaniac (reference note #1) Herr Hussein, representing the hidden side of Obama’s dual nature brought to the fore. Barack has many friends and has a pleasing personality, but as Herr Hussein he becomes more and more dictatorial, more and more scape goating, makes ever longer enemies lists, encourages demonization and dehumanizing of political opponents and becomes ever more fascist like as time goes by as Herr Hussein grows in dominance. After taking this potion repetitively, he no longer needs to rely upon it to unleash his inner fascist demons.

Reference note #1: Such individuals who lack ulterior motive have traditionally been referred to in layman’s terms simply as a variation of a pyromaniac. Most such maniacs lack conscious motivation although they are fully aware of the acts they are failing to stop or they themselves are committing. Typically they will feel intense pleasure, gratification, or relief when causing destruction or when witnessing or participating in the aftermath. Motivation is also classified as pathological and non-pathological. Some research suggests that feeling such joy at horrific situation is pathological. Other research suggests that some motivation for this comes from rational thought. Taking joy in horrific situations for envisioned gains in political power and/or the concealment of the imposition of devious plans are examples of supposed rational decision making.

Excellent analogy…

The oil spill is our open borders. The oil is illegal aliens.

All along the coast, people are screaming for the resources to stop the oil. All along the border, people have been screaming to stop the illegal aliens.

In the Gulf, the Administration and countless bureaucracies have dragged their feet and have erected enough red tape to choke a goat, and as a result, the oil has reached the shore and thousands of lives have been impacted.

Along the border, this and past Administrations and countless bureaucracies have allowed millions of illegal aliens to enter our country, and as a result the lives of millions, along with our schools, hospitals, social welfare structures, and voting demographics have been impacted.

In the Gulf, Obowma has sent in the lawyers.

In Arizona, Obowma will send in the lawyers.

I just think it is so awesome that our Sec of State goes out of the country to announce that they are going to take to court a state, airing our grievance with each other on foreign soil.
I remember Churchill going over to France to complain about his parliament…Remember when Reagan went to Russia and whined about the dems who controlled congress?
Yeah that’s what real leaders do, they go out of the U.S. to whine about their country…I guess that is why we are doing so well, our leaders have so much pride, and they are so supportive of each other.
Here is a little analogy we all understand, and take it nationally and it still works…or used to.
My siblings,we can verbally fight, argue, harass, physically fight, throw things, destroy things, as we were growing up, brutal towards each other…but an outsider takes on one of us, that outsider is going down, nobody breaks up the “clan”…so it used to be in the U.S.
But now, with this administration, we don’t have that honor, that Esprit de Corps…America is just a place to try to get elected and have a lifetime of power…

You have no chance any more GRINGOS. None at all. Jan Brewer is alone at her own Alamo and your el Presidente is the commander of your armed forces and my leader Vincente Fox now owns him. He had to pay him muchos dolares as he is very greedy man and does not seem to think that he can ever have too much money. You are now tostada quemada.

Your Grandfathers kept you from having to learn German or Japanese or be lamp shades. But YOU ARE NOT the men or women that they were, not even close. What on Earth were you thinking when you elected a traidor as your el Presidente? Were you all completely drunk? Way too much Tequila on election day? Oh well, your loss, my gain.

Once we get our amnesty, we will all come to your country. We will all have at least 10 ninos and in a generation we will overwhelm and deport most of you Gringos! We will start with Arizona after your el Presidente moves federal troops there to arrest their governor and hand the deed over to us and then we will move rapido from there all across the rest of your 57 states to take them over too. Some of you, if you learn Spanish real well, we might let you stay to pick our lettuce or mow our lawns or take care of OUR children in what used to be your houses.

Those who don’t learn Spanish will be deported to Alaska. That is until Al Gore’s global warming heats things up and we want Alaska too, then we will deport you all to New Orleans. It will probably all be under water by then anyway. I hope you Gringos can swim, he, he, he. My bad!!!

So give it up and LEARN SPANISH! You should probably all buy Mexican flags too and fly them in your front yard and on your pickup trucks. If you already have an American flag there it is alright if you keep it, as long as you fly it upside down and below our great Mexican flag.

Now repeat after me – I pledge allegiance to the flag of the Estados Unidos del Mucho Grande Mexico, and to the Republic for which it use to stand, one nation under Vincente Fox, with everything for us, and nothing anymore for you except to pay mucho mucho more taxes and wait in line for years for your Obamacare.

And remember Gringos,

APRENDER EL ESPANOL!!!

He Knows, He Just Doesn’t Care

The most damning thing about Obama’s response to the Gulf Crisis (the other Gulf Crisis) is not what it reveals about his lack of competence, but what it reveals about his lack of interest. And it has forced many liberals to recognize, what so many conservatives knew all along. That Obama just doesn’t care.

Politicians who don’t care what happens to the little people are nothing new. But Bill Clinton was a master at pretending to care. His performance in that infamous funeral clip testifies to a man who could turn on the facade of emotions in the blink of an eye. Obama isn’t very good at that. Where Clinton was a natural actor, Obama is an unnatural one. Unlike most politicians, he lacks that instinct, because he lacks any degree of empathy. And so Obama needs extensive prep time to get his show on the road. Without prep time and a teleprompter, the mask begins to slip and the man underneath is cold and distant delivering a mechanical performance.

Look at Obama and you see the mirror of liberal expectations. No sooner does Bill Maher deliver his black man line then Obama begins talking about kicking ass. As always Obama tries to manipulate people by becoming what they want him to be. But underneath it, the fate of Americans means nothing to him.

We’re proud and armed too. It’s just good common sense these days. I grew up in rural AZ, where they’re putting up these latest signs. I am beyond angry that Obama chooses to waste taxpayer money on a lawsuit instead of defending the damn border.

Can you imagine what if a tourist, driving on I-8 through AZ for the first time, stopped alongside the road to take a picture of a saguaro or something? They could very well walk into an ambush like the Pinal County Sheriff’s deputy did. It was right alongside I-8, south of Casa Grande.

I just don’t see how one branch of the federal govt can sue AZ while they have US Marshalls, US Border Patrol and ICE officers here in AZ defending the very same thing AZ is trying to defend.

GrannySunni on June 18, 2010 at 3:43 PM

It should be readily apparent by now what this current “government” and I use all due contempt with that term, is trying to do. Mark my words…regardless of how this lawsuit turns out, at some point within the next two years Obama will either have congress pass a full amnesty bill for illegals, or he will do so by executive order. For years the libs have continued to claim there are 12-15 million illegals in the US, I say that number is closer to 30-40 million. And there lies Obama’s only hope for reelection and permanent control by the commie/liberal sector of our country. Once this happens this country is OVER! Welcome to Tiajauna!!!

All this needs is to be steered into a friendly court with a leftarded judge; AZ can make the best case in the world, then the Obamatards can get up and say “yeah, those guys are wrong, and we won”, sit back down, and win.

The last year and a half has been filled with “they can’t possibly win, they can’t do that” instances that are promptly followed by the sound of jaws hitting the floor as they do in fact win, and do in fact do that.

Gov. Jan Brewer’s office said Friday that it had received confirmation that representatives from President Barack Obama’s administration will come to Arizona on Monday, June 28, to talk about border security and immigration-related issues.

Brewer spokesman Paul Senseman said he had no additional details about the visit, including who would be on the ground, how long they would be here, and what their itinerary might be.

PatriotRider on June 18, 2010 at 2:27 PM

For certain, but I hardly think she was fooled.

If Obama doesn’t do something to help AZ secure the border we’re going to see more and more of this:

PINAL COUNTY, AZ – This weekend, JT Ready and a group of armed men plan to take Arizona’s border battle into their own hands.

“This is the Minutemen project on steroids,” he said.

Ready is a member of the Nationalist Socialist Movement, and he and his citizen’s militia group are tired of waiting.

“We’re going to go all night and shut down the drug corridor that comes directly into Phoenix,” Ready said. “We have guys that are going to be doing some covert stuff and we have some snipers coming out.”

hmmmm so the Federal Gov’t itself wants to sue a state gov’t?

I would imagine this will be a very tricky thing to do since it may require a congressional abrogation of state sovereign immunity just to get the case into court. most of the consitutional challenges to laws come from an individual/group who must be directly effected by the infringement of rights.

Fighton03 on June 18, 2010 at 5:30 PM

Arizona Immigration Law = National ID for Arizonans

No patriot hands over the private data of law abiding citizens to the feds, such as you have done in SB1070.

Anyone who does betrays the hard work of conservative patriots who have been fighting national ids since before the Clinton administration and since.

Fix the law before July 1. Otherwise, welcome to the leftist globalist Clintonista agenda as implemented by the right.

Lastly, Ronald Reagan opposed national ids http://www.cato.org/pubs/pas/pa237.html

Gun Owners of America oppose national ids because they state that once the federal government has your drivers license data, they have enough information to track gun purchases…

“Since I need a driver’s license to purchase a gun from a dealer, BATFE would finally have its long-coveted tool to impose gun control on targeted groups — particularly under a liberal anti-gun administration. If you believe in the Second Amendment, please vote against this anti-gun monstrosity.” http://seclists.org/politech/2005/Feb/0016.html

Rae on June 18, 2010 at 5:36 PM

Perceptions, folks.. It’s just perceptions.

They don’t have to “win” this dog n’ pony show for it to have the desired effect among his target audience.

“Well, we tried.. But, those dumb ol’ Republicans beat us in court.”

franksalterego on June 18, 2010 at 5:46 PM

Arizona should declare that its law enforcement departments will no longer enforce any law in Title 18 USC. All enforcement in Arizona must be done by federal authorities, and state and local agencies will cease any cooperation with said federal authorities.

xkaydet65 on June 18, 2010 at 5:50 PM

I’m curious: Has the federal government ever sued a state for making a law protecting its citizens that mirrors federal law that is not being enforced? Not sure what grounds there are to even do such a thing. Then again, this is Obama & Co., but… seriously? Where do you even file such a lawsuit?

UnderstandingisPower on June 18, 2010 at 5:50 PM

I’d just like to say….

This is awesome.

That’s all.

———-

not to *ahem* toss a “pineapple” onto the dance floor, but isn’t that exact lack of standing what protected Obama from having to show any of his subjects his birth certificate?

How is the Federal Government directly “hurt” by Arizona’s saving the Feds the trouble of enforcing the border? Seems like it goes along with the wishes of 70% of the people – and if the Federal Government government is not representing the wishes of The People at large, then in a properly functioning representative democracy, the Federal Government morally has NO “STANDING” TO SUE.

The people of Arizona are being directly killed and hurt by Mexicans. This is a proven blood standing, justified by repeated and involuntary assaults against the civic clients of the defendant, the State of Arizona.

Weigh this against the Feds’ claim of “standing” that is based upon suffering an unproven indirect harm, said harm which is derived from its own voluntary political decision to blatantly not enforce its own law?

What’s good for the goose is good for the gander.

Just sayin’

cane_loader on June 18, 2010 at 5:57 PM

I should clarify this phrase from my last comment; correction is in CAPS:

“The people of Arizona are being directly killed and hurt by Mexicans. This is a proven blood standing, justified by repeated and INVOLUNTARILY SUSTAINED assaults against the civic clients of the defendant, the State of Arizona.”

Civil war time? Attack arizona?

Okay, so when the federal government rescinds the tenth amendment, is it tyranny yet?

I’m only about halfway through the comments, and this ^ is probably the dumbest post so far. And there are many to choose from.

You pesky bloggers! See why Obama needs emergency power to shut down the intertoobs!? We can’t have Americans learning about this stuff; it’s for your own good!

bitsy on June 18, 2010 at 6:11 PM

You have no chance any more GRINGOS. None at all. Jan Brewer is alone at her own Alamo
NoBordersJose on June 18, 2010 at 3:21 PM

She’s hardly alone, sweetie. Millions of armed, and angry, Arizonans have her back.

If Barry Soetero Obama wants a fight, he’ll damn sure get one here.

Would you mind teasing out your logic a little bit more there MadCon? I have a morbid curiosity as to how you would see this as some sort of 10th amendment violation.

Yep. That’s your official designation, crr6. Forevermore, you shall be Dickford.

How do you like them apples, Dickford?

I didn’t think so.

crr6 on June 18, 2010 at 6:25 PM

As MadCon is an eloquent poster, I would not speak for him. However, young lady, if you indeed are, when the Federal Fovernment decides to overrule the wishes of the majority of the American people and files a lawsuit against a state trying to protect the lives, freedom, property of American citizens, in the defense of people who have crossed our borders in an illegal manner, and harmed and robbed our citizenry, that that is not just bordering on tyranny, but despotism as well. And don’t claim it is a civil right issue. These people are foreign nationals, who broke the law by entering America illegally.

They would be better served teaching Dickford the difference between his ass and a hole in the ground.

But it probably wouldn’t take.
