Obamateurism of the Day

What happens when a former, self-professed Constitutional scholar wants to sound tough? They tend to forget about the Constitution. Barack Obama recently had the Department of Justice announce a criminal investigation into BP’s activities in the Deepwater Horizon. When the subject of the criminal investigation took the prudent step of ensuring legal representation, the former lecturer on Constitutional law publicly scolded BP for “lawyering up”:

According to the pool report, BP and Coast Guard officials whose job it is to handle claims “are stationed with each parish president in Louisiana, and [Obama] wants the same arrangement for county governments in all the affected states.”

At that point, the pool report says Obama “lit into BP” because he wants to — Obama’s words — “make sure that BP is not lawyering up essentially.”

Just two days ago, Attorney General Eric Holder traveled to Louisiana to announce that the Justice Department has begun criminal and civil investigations into the oil spill. As a result of that investigation, BP and other companies could be charged with violating a variety of environmental laws, as well as other crimes. Holder pledged to prosecute any offenders “to the fullest extent of the law.” The prosecution could result in enormous penalties and losses for BP beyond what has already occurred because of the spill. And now the president himself goes after BP for “lawyering up.” The company certainly has huge obligations as a result of its actions in this matter. But surely the constitutional-law-professor-in-chief would concede their right to a legal defense.

Well, only if the Constitutional-Lecturer-in-Chief knew what he was talking about then. This is one of the reasons that people questioned the timing of the announcement by Holder and the DoJ. There is plenty of room later for criminal probes, but right now the US needs BP focused on stopping the spill. We don’t need BP “lawyering up,” but that was the completely predictable result of Obama’s attempt to deflect criticism of his handling of the oil spill.

yeah, because, like the Israelis, there is no reason for a corporation to defend itself from any outside aggression unnecessarily. They are to assume the missionary position and begin thanking the government.

The company certainly has huge obligations as a result of its actions in this matter. But surely the constitutional-law-professor-in-chief would concede their right to a legal defense

Israelis have no right to self-defense
Corporations have no right to self-defense
and, before you know it…

Americans have no right to self-defense….

Thus Obama’s test: He needs to establish that he is doing all he can to repair the damage in the gulf even as he maintains his focus on the economy and persuades reluctant conservative Democrats that the job of ending the downturn is not yet done. However unfair the first impressions of Obama’s response to the oil spill may be, he can’t afford to let them stand. He also can’t afford to let oily waters engulf his priorities.

It’s worth remembering that while the daily countdown on the Iran hostage crisis helped create a famous television show, it was an unruly economy that ultimately upended Jimmy Carter’s presidency.

Call me crazy, and I’m no Constitutional scholar (I didn’t even graduate high school), but isn’t legal representation a Constitutional right? I mean, I could lawyer up in reaction to a parking ticket, so why shouldn’t BP lawyer the crap out of themselves now, since our President has announced his intent to broadside BP with legal charges?

And shouldn’t the DoJ wait until the crime is done being committed before announcing investigation? Or are they just keeping a running tally of damages?

Isn’t this the president with the largest legal staff of any president…in fact I believe it is the largest of any two combined legal staffs.
He has nearly 50 on staff advising, and Bush at the end of his term (when you beef up your staff in anticipation of legal lawsuits) he had 26, but normally about a dozen.

Maybe I’m just an old fart but I can remember back in better times when a little common sense was more the rule than the exception. The approach would have been to handle the situation in the Gulf and then sit down and find out what went wrong and then figure out ways to prevent this from happening again. But now we live under a strong arm government and justice system and the first thing they do is charge people with crimes before even stopping the leak. Everything is criminal I guess in some places even down to riding a scooter without a helmet.

BP management have a fiduciary responsibility to their stockholders to get adequate legal representation in this matter. They have no choice in this matter.

Even if they were stupid enough to want to talk to the justice department without “lawyering up”, they would be grossly negligent to do so.

The fact that the President even says something like this means that everything he knows about the law he learned by watching re-runs of NYPD Blue. Next thing you know, he’s going to send Dennis Franz into a locked room with the BP CEO with a telephone book…

Obama has now practically forced BP to wait for a judge to order them to pay each cleanup bill, whereas they might have been willing to volutarily pay it. To do otherwise while under direct threat from the Attorney General would subject them to stockholder suits for irresponsible sqandering of corporate assets.

This move by Obama is abyssimaly stupid and could not be more counterproductive. This administration has now taken more actions to OBSTRUCT correction of the spill than to help correct it.

Similarly, Obama has pawned off responsibility to keep Iran from aquiring nuclear weapons to the toothless UN, which will combat the threat with “stern letters” and other toothless and ineffective responses.

This is why important executive jobs require an experienced executive … not a Chicago mob hack.

Most men intuitively understand power and aggression, it appears that Obama does not.

Obama seems to believe that he can take out his legal baseball bat, threatening to beat BP to a pulp while they stand there saying “Thank You may I have another.”

Unfortunately for America Obama’s understanding of economics is just as faulty.

Time to be an Ant, the Grasshoppers are in charge. Think about where we seem to be going, start reading about how to live on your own, learn to grow food, learn to defend yourself and friends, work together, it’s coming, prepare for lean times. You better start learning how to live without, lest you be without. Too bad most HA readers don’t live in a large community together with a large tract of land, we’d be OK.
