Obama court nominee: Serial killer’s sexual sadism is a mitigating factor

posted at 10:04 pm on May 26, 2010 by Allahpundit

The American Spectator was all over this a month ago but not until I watched the clip at Ace’s did I hear of it. Rather than have me blather at you, take five minutes and read the AmSpec piece to see just how far Chatigny went in gaming the system to try to spare this degenerate’s life. Ross, the killer, didn’t even want to appeal. He was ready for death, but the good judge wouldn’t hear of it. Note well this part:

Shockingly, Chatingly cites Ross’s sexual sadism as a mitigating factor. “But looking at the record in a light most favorable to Mr. Ross, he never should have been convicted. Or if convicted, he never should have been sentenced to death because his sexual sadism, which was found by every single person who looked at him, is clearly a mitigating factor… He can sit on his hands and sit mute and he may find not only that the death sentence is set aside, he may find the death penalty has been abolished. He may find that he gets the life sentence that he has repeatedly said he would take in an instant if it was offered to him.”

Get it? The more depraved you are, the less competent you are and therefore the less guilty you are. Or as Ace puts it, “To commit the crime is de facto proof of innocence of the crime.” Oh, did I forget to mention that Chatigny actually worked as part of this guy’s defense team for a brief time as a lawyer? And that one of his rulings in another case related to sex offenders was called “dead wrong and dangerous” by none other than Dick “Khe Sanh” Blumenthal?

But see, it’s Miguel Estrada who’s too controversial to sit on an appellate bench. Kudos to the Eyeblast Blog for putting this together. Content warning.

It’s all revenge no matter what the punishment. And,, if anyone you love is ever murdered I’ll be sure to tell you not to be vengeful. Because, until you go through it, you will never realize how hard it is to not go after someone yourself.

Death penalty should only be applied to people who admit their guilt.
Narutoboy on May 26, 2010 at 10:52 PM

Many innocent people admit to committing murder all the time, due to mental illness, being homeless, ect.. An admittance isn’t much proof either when you look at how many false admittances there are.

And, most murderers will never admit guilt, even the
“psycho” killers, Charles Manson for example has never admitted guilt, and he’s one of the most unstable killers there is.

Narutoboy, if you have any evidence, whatsoever, that anyone has ever been put to death and later found to be innocent in America, please post a link.

Of course, you’ve made this assertion several times in this thread, but have yet to do this simple thing. I wonder why.

Surely, if it’s as obvious as you say, you should have been able to find any number of examples of it. Of course, all I’m asking for is one. Can you produce it? Of course not, because such a case has never happened in this country. Nope, not once. I suggest you quit being a stupid little bigot and only spout off about things you know about (which leaves nothing, I know, but it would lead to you being more educated and quieter).

When a (monster) sits there and nonchalantly describes how he killed young girls by his own hand, and admits to masturbating bringing forth these fond memories until his member is sore and says all this on camera…time to hand it over to a true People’s Court and let us handle it from there. The establishment lawyers could wash their hands.

But, since Hollywood and the Leftist literati have brainwashed us through stuff like The Oxbow Incident, that could never be. ONLY some clown with a degree in jurisprudence is capable of meting out justice…not the sheeple.

Please do not reproduce. You are an idiot. There have been documented cases of this happening. If you’re too stupid to do a simple search, that’s you’re problem.

Charles Manson for example has never admitted guilt, and he’s one of the most unstable killers there is.

Manson did not kill anyone. The members of his “family” are the one’s who did the killing. The courts found him culpable, however, and he is in prison.
