ICE chief: We might not process illegals referred to us by Arizona

From ICE’s homepage: “Formed in 2003 as part of the federal government’s response to the 9/11 attacks, ICE’s mission is to protect the security of the American people and homeland by vigilantly enforcing the nation’s immigration and customs laws.” If he’s not prepared to “vigilantly enforce” federal law because he doesn’t like how certain suspects were identified, the solution is simple: Fire him. He can while away his days wearing a sandwich board and marching around outside Jan Brewer’s office instead of leeching taxpayer money for not doing his job.

Echoing comments by President Barack Obama and others in the administration, Morton said that Arizona’s new law targeting illegal immigration is not “good government.” The law makes it a crime to be in the state illegally and requires police to check suspects for immigration paperwork.

Morton said his agency will not necessarily process illegal immigrants referred to them by Arizona officials. The best way to reduce illegal immigration is through a comprehensive federal approach, not a patchwork of state laws, he said.

“I don’t think the Arizona law, or laws like it, are the solution,” Morton said.

I looked for a transcript on the Tribune’s site but can’t find any, so we’re deprived of the logic by which (a) an amnesty bill would actually reduce illegal immigration and (b) bona fide illegals caught by Arizona cops are somehow too tainted or whatever to be processed by ICE. But it’s good to know that America’s de facto secretary of immigration enforcement is squeamish about state cops trying to fill the enforcement void created by his own agency.

Speaking of local solutions, here’s the mayor of Costa Mesa declaring his jurisdiction America’s first “rule of law” city. If the feds can’t handle this issue, fine; just don’t cry when state and local governments decide that they can.

The way I understand it, the way ICE has been processing illegals in ALL the states is to tell the police to release them, so all that the head of ICE is saying is that it will be business as usual.

I find it appropriately ironic that on the same page, HA has one story (this one) with Administration officials stating they may not do their job of deporting illegal immigrants and a story with the Mexican President saying they check every immigrants papers.

I realize the liberals have disdain for certain laws, but it stuns me to see the extents they will go to.

The new law took effect Wednesday, although portions, primarily employment verification standards, will be phased in over the coming months.

Ann Morse, program director the National Conference of State Legislatures’ immigrant policy project, said recent legal challenges to the laws in Oklahoma and elsewhere raise “a real question” of how South Carolina’s law will be received.

Legislators here say they pushed the boundaries of federal limitations but crafted a law that is expected to hold up against legal challenges.

I hate to say it, but I saw this coming.

Dereliction of duty is what they do. They have been put in charge of immigration enforcement precisely for the purpose of ensuring that our immigration laws are not enforced.

They’ve been pulling their punches.

The authority to enforce the law carries with it the DUTY to do the same. Just as the state cannot assume powers not defined by law, neither can it neglect to enforce the law using the powers it has been given.

Any government that neglects its duty to enforce the law as written is illegitimate. Any government official who acts in bad faith and shirks his or her duty to enforce the law as written has violated their oath of office and should be subject to civil, if not criminal, prosecution.

INA § 287(g) authorizes the Secretary of Homeland Security to enter a written agreement with a State, or any political subdivision of a State, pursuant to which an officer or employee of the State or subdivision, who is determined … to be qualified to perform a function of an immigration officer in relation to the investigation, apprehension, or detention of aliens in the United States (including the transportation of such aliens across State lines to detention centers), may carry out such function at the expense of the State or political subdivision and to the extent consistent with State and local law.

Does Arizona have a written agreement with the Homeland Security?

It would embarrassing for Homeland Security if they did.

Sorry folks, this is not that surprising. Here in Nebraska, an illegal walked into the ICE office in Omaha and turned herself in.

They wouldn’t arrest her or take her into custody. This was in the Omaha World Herald about two months ago.

But my 2 cents is:
When the federal govt will not do it’s job, someone has to do it.
We are experiencing nothing short of an invasion on our southern border.
Now there are some people who are happy & stupid enough to sit back & let it happen.
Kinda like how some people will let people walk all over them without a fight.
Then there are people who cannot let someone walk all over them without a fight.
This would be the people of AZ.
They are tired of being invaded.
So they are going to defend themselves in any way they can.
You cannot blame someone for protecting themselves from an invasion.
And since the federal govt has abandoned the state of AZ, they are doing only what comes natural.

I live in a small Michigan agricultural county, here our sheriff (as well as most residents) are aware of who amongst the 2 or 3 dozen large farm operations employ illegals. The year around population of illegals is about 2000 but swells to 4000 in the summer months (more than 10% of our population). Illegals at these operations have been reported on numerous occasions to ICE officials in Detroit who will neither do raids at the farms or pick-ups of incarcerated law breakers.

Illegals who find themselves outside the law (usually car accidents/no insurance, drunk driving, domestic disturbances, drugs)are arrested by local statute. Our Sheriff uses a system whereby he houses illegals at the county jail until he has 3 or 4 then transports them to Detroit where they are most often released and return to their place of employment within days. Of course no fines or fees/court costs are ever paid and no reimbursement is ever made for housing or transporting the illegal.

The local Wal-Mart and a few of the other retailers have ceased having illegals arrested for shoplifting choosing instead to handle these situations “in house”, hoping they can retrieve the stolen items before they leave the property thus avoiding the “system”. The 3 hospitals in the county treat the illegals as citizens with no insurance picking up what they can from state Social Services, absorbing the rest of the costs.

Our unemployment rate is 19.5% and growing in this bad economy. All of the jobs taken by illegals would be gladly absorbed by local workers.

I assure you this situation is being reduplicated in thousands of Counties throughout the country.

The very next time the AZ ICE pinheads refuse to take transfer of some illegals from AZ LEOs, the state should immediately file an equal protections suit / petition to the Supreme Court. They can hear such matters with some immediacy, at their own discretion. Do it NOW. Force a showdown with the Obamunists, force a finding of their dereliction, lay the foundation for their impeachments next Spring. DO IT, AZ.

The executive branch consists of the President and delegates. The President is both the head of state and government, as well as the military commander-in-chief and chief diplomat. The President, according to the Constitution, must “take care that the laws be faithfully executed”, and “preserve, protect, and defend the Constitution”.

Since our current sitting president will not defend our borders and ensure that Federal immigration law is executed, he is derelict in his duty to country and oath of office. Articles of impeachment need to be drawn up when the new Congress convenes in January.

Where is the equal protection under the law supposedly provided to us by The U.S. Constitution? Why is it one group of people who aren’t even citizens of this country can break our laws and not be prosecuted but those of us who pay or taxes and are citizens can? Answer: Washington will sell you and your children out for a vote. Let’s dump the incumbents this November if they support anything that even looks like anmnesty for illegals and don’t make hiring them a felony.
