Does Kagan have a “diversity” problem?

How would the media have reacted had George W. Bush nominated Elena Kagan to the Supreme Court? Besides fainting, of course? Roland Martin of CNN files an pre-emptive slam at his colleagues and at Democrats for a double standard on diversity that focuses not on Kagan’s own identity but on her tenure as dean of Harvard Law School. Martin wonders how Kagan will manage to get a pass for her rather monochromatic hiring record:
If a white Republican president of the United States appointed a white male as his next Supreme Court justice, and upon the inspection of his record, it was discovered that of the 29 full-time tenured or tenured track faculty he hired as dean of Harvard Law, nearly all of them were white men, this would dominate the headlines.
It would be reasonable to conclude that the special interest groups that vigorously fight for diversity — civil rights organizations, feminist groups and other liberal institutions — would be up in arms, declaring that this person’s records showed him unwilling to diversify academia, and unqualified to consider diverse views as one of nine members of the U.S. Supreme Court. There would be widespread condemnations of Republicans having no concern for the nonwhite males in America.
But if what if the choice were made by a black Democratic president, and it was a woman? A white woman? A white Democratic woman? …
Guy-Uriel Charles, founding director of the Duke Law Center on Law, Race and Politics, has heavily scrutinized Kagan’s hiring record as head of Harvard Law School. In a scathing blog post, he has said that of the 29 positions Kagan had a chance to fill, 28 were white and one was Asian-American. And of the group, only six were women — five white and one Asian-American.
This has already started circulating near the surface of the nomination debate in anticipation of Kagan’s nomination, and the White House has already begun its pushback against the meme. Rather than focus on the results of Kagan’s hiring, they argue that Kagan made plenty of offers to people of color and/or women for these positions, but that the people interested in working for Harvard Law School were primarily restricted to white males. Martin says, “Folks, I wasn’t born yesterday,” rejecting the notion that a position at the most prestigious college of law (or second-most prestigious, in the view of Yalies) would be so invaluable that Kagan had to regularly fall back to second and third choices to fill the slots.
Martin also says that Republicans may “rightly” protest at this double standard, especially since Martin thinks the Left will mostly stay silent about it, but Republicans will most likely not make much of an issue about it. It’s worth pointing out for the double standard applied by the media to Republicans as opposed to Democrats, but conservatives don’t believe in using quota systems to establish “diversity” as an end to itself. No one’s going to buy the excuse that Kagan’s first choices all decided to seek work elsewhere, either, but to make this a first-tier argument would be to endorse the bean-counting approach to hiring and the corrosive effects it has on civil rights in the long run.
Could Kagan’s appointment could put an end to this kind of quota seeking as a political tool? It would be nice to think so, but Martin’s more right about the double standard than he thinks. Just as with issues of competency in reaction to crises, the homeless, and spending, the media will always shine a more critical light on Republicans than on Democrats. It’s a double standard that shows no sign of abating.

No, Kagan doesn’t have a “diversity” problem, as far as I know, but the Democratic Party certainly does. It’s weird, really: the more they demand rigid conformity of (leftwing) opinion, they more urgently they shriek about the need for cosmetic diversity.

Roland Martin thinks there should be some kind of quota? Is that legal? I thought people couldn’t be discriminated based on Race,Creed,Religion,Gender…so Roland Martin doesn’t understand she shouldn’t be appointing anyone based on those factors? I am pretty sure that would be illegal to dismiss someone for an appointment, because they are not of a certain race or gender.
Looks like Kagan is smarter than a race baiter.

Conservatives should steer clear of this critique. In fact, someone should congratulate her during the hearings, and the more visibly the better, on her eschewing the PC metrics of color in her hiring decisions. #1–throw it up in the lefies’ collective face; #2–stay principled, oh, and if possible, mention MLK’s goal of “content of character,” not “color of skin.” Then listen for the sound of heads popping all over the place.

At Ginsburg’s confirmation hearings, Hatch asked her whether she thought a case of discrmination could be made against a business that had 55 employees all of whom were white. When she said yes, Hatch pointed out that she had hired 55 law clerks on the D.C. Circuit, all of whom were white.

Republicans should offer a Senate resolution that says that the racial and gender composition of employees hired by a nominee does not affect the nominee’s qualifications for the Supreme Court or any other office.
Democratic Senators will vote in favor of it so as not to criticize Ms. Kagan. Putting them on record will make it harder for them to use this type of issue in the future against Republican nominees.

This would necessarily be true for any hard science department: almost all of those in the candidate pool are white men, so it would require some major non-performance-related evaluation to get a more ‘diverse’ set of hires.

Or, count the seconds before the media says, “Oh, conservatives are attacking her for not having sufficient diversity in hiring, while they attack affirmative action and quotas out of the other sides of their mouths.” I’d rather be getting criticized for being principled than for being unprincipled–and besides, Americans have had just about enough of racial politics–we have a black president now, after all. When is it finally time to get around to MLK’s standard, and put the Sharpton/Jackson/New Black Panther Party standard behind us? And what fun to annoy the crap out of liberals all over the place, who will have to either NOT attack her for her lack of diversity, and be seen as hypocrites for the ommission, OR, be forced to agree with freaking conservatives that she hasn’t toed the PC line if they do attack her. The “what if a Republican did this” argument is not an argument, it’s the mirror image of the Democrats’ accusations on such matters.
I could care less what races and sexes her employees were. To say that the Dems should care, when we always say it shouldn’t be an issue, is a tactical blunder and a needless surrender of that part of the field.

Harriet Miers actually had more experience as a litigator, yet got shot down by both all sides of the political spectrum. Why should Elena Kagan even be considered for an associate justice position on the SCOTUS is truly mind blowing. The only thing she proved to be really good at was conning other people out of their money to fill Harvard’s coffers.

President Obama has nominated Solicitor General Elena Kagan to the United States Supreme Court. Her opposition to the military’s “Don’t Ask, Don’t Tell” policy and her apparent opposition to the Defense of Marriage Act (DOMA) are cause for concern.
While Dean of the Harvard Law School, Kagan threw military recruiters off campus on the grounds of opposing the law prohibiting open homosexuals from serving in the military. “This action causes me deep distress,” Kagen wrote. “I abhor the military’s discriminatory recruitment policy.” It is a “profound wrong – a moral injustice of the first order.” Her decision was essentially overturned by the Supreme Court on a unanimous 8-0 vote, showing how far out of the judicial mainstream her thinking is.
Ms. Kagan has already tipped her hand on one of the most important issues that is likely to come before the Supreme Court. Overturning ‘Don’t Ask, Don’t Tell’ will have a devastating impact on military morale, recruitment and retention. Plus, there will be no possibility of promotions for officers and chaplains who defend natural marriage as a matter of conscience.
Any officer with deeply held views about the immorality of homosexual behavior would have no future in Elena Kagan’s military. Our national security is far too important to become a plaything in the hands of judicial activists like Ms. Kagan would certainly be. Her nomination ought to be rejected on these grounds alone.
Plus, Ms. Kagan is part of the Department of Justice that filed a brief which declared “this Administration does not support DOMA as a matter of policy [and] believes that it is discriminatory.”
Marriage between a man and a woman is the cornerstone of any healthy society. To put someone with such hostility to natural marriage and duly enacted law on the Supreme Court is an unacceptable threat to this profoundly important institution.
