Breaking: Last Navy SEAL acquitted of abusing Iraqi terrorist; Video: SEAL interview added
posted at 6:35 pm on May 6, 2010 by Allahpundit
He was the only one of the three charged with actual assault, and even so, it took just an hour and 40 minutes to acquit him. Why so quick? Because the prosecution’s case collapsed:
The defense called an oral surgeon Thursday who testified by phone from Baghdad. He said Abed might have bitten an ulcer on his lip, causing it to bleed. Defense attorneys hope this validates their position that no assault occurred and that Al Qaeda detainees are trained to injure themselves then claim abuse.
Earlier, after the prosecution and defense both rested their cases, prosecutors Thursday announced they needed time to present a rebuttal. They were basically trying to rehabilitate their key witness, Petty Officer 3rd Class Kevin Demartino, who claims he saw McCabe punch the prisoner in the stomach. Demartino’s character and credibility had been questioned by a string of defense witnesses Wednesday, many of them Navy SEALs. A rebuttal witness Thursday morning, Demartino’s former superior officer, called Demartino “one of my top sailors—I can depend on him for anything.”
Defense witnesses on Wednesday had painted a picture of Demartino as unstable, unreliable and, after the incident with Abed, “distraught.” According to testimony, Demartino was worried his career would be ruined because a prisoner claimed abuse on his watch, and that he would no longer have a chance for his dream job with the California Highway Patrol. This, the defense claims, gives Demartino a motive to lie.
Demartino did not immediately report the alleged assault to his superiors and admits to dereliction of duty. The defense suggested that since Demartino initially said nothing, then later described seeing McCabe punch Abed, he’s an unreliable witness.
Pretty amazing that they brought this to trial with little more than Demartino and a jihadi attesting that it happened, but then the point here was always political. They wanted to show that they take detainee abuse seriously and were hoping the accused would accept some sort of deal. No dice. How’d that work out for them?
McCabe is being interviewed on Fox News right now. I’ll update with the video later when it’s posted.
Update: Here’s the clip. Click the image to watch.

Nice to see that the government cant support an anti military prosecution no matter how vocal the left makes it.
Gives me hope that the American people would not be kind to a jihadist prosecution.
William Amos on May 6, 2010 at 6:40 PM
None of this is about military prosecution. It is all about military police and the complaints they bring forward. Now, the average big-city and state cop in today’s society is a decent, reliable, and reasonably courteous individual, who is well trained for the job at hand. During my experience as a young officer just out of ROTC, some fifty years ago, I did not find this to be the case with most MP’s, SP’s, and AP’s, who generally appeared to be very poorly trained and usually exhibited serious attitudinal problems. Such behavior was particularly inappropriate when directed against a virtually all “draft” military, who were simply “civilians temporarily in arms”. I had hoped that this abusive behavior had creased to exist in the modern, all-volunteer, professional armed forces. However, from the many comments I have read regarding the case at hand, as well as recent similar cases, the situation has deteriorated over the years. Now these SEALS are acquitted the senior command of all armed forces police should be investigated, with emphasis on the training commands. Furthermore, the so-called naval master-at-arms who made the complaint against the Seals, should be prosecuted for perjury to the full extent of what the Uniform Code now allows and the case should be made a matter of example in all armed forces police training. This entire matter, which speaks for itself (Res ipsa loquitur), brings great shame and disgrace upon the armed forces police, not simply the Naval component thereof, including the pathetic NCIS. The high command had better well take note of this fact!

I don’t know too much of this guy’s background, but I figure we’ve lost a good SEAL here. This may dissuade some from volunteering for fear of being made into political hockey puck by the Dems. Oh well, not that we need patriots anymore anyway. With Obama at the helm, everybody in the world loves us now. War is abolished.

As we all know, the government in place is self-serving and corrupt to the core. Any sitting President that would place the lives of Sovereign US Warriors as less valuable than foreign peoples is in violation of his oath. The Armed Forces of this nation are in fact an asset of this government which is supposed to be a servant of the people. Those ‘assets’ and all elected members of the government swear oaths, as I did, to support and defend the Constitution of the United States of America. How you translate that to mean to-be-the-saviors of the Islamic world is beyond a reasonable man’s ability to answer. There is, of course, only one rational answer and that is that the President has chosen the Islamic peoples of the world over the Americans who voted for him – much less those who did not. How this is not seen as a clear violation of his oath can only be explained in one way.
How you get 536 members of a governing body (Congress), the entire Judicial Branch and all other members of State and Local governments to stay silent while the President of the United States wastes the lives of our Warriors for what is now obviously his perverted personal pursuit, can also only be explained in one way. Why the vast majority of the population of this country is not enraged and taken to the streets over this, again, can only be explained in one way. How a sign ‘ The Marine Corps is at War; America is at the Mall’ placed in a hooch in Afghanistan does not cause the vast majority of this country to feel shame for, essentially, abandoning our Warriors to the madness of this administration, again, can only be explained in one way.
In the Bible it is referred to as Spiritual Blindness.

uber-con on May 6, 2010 at 7:04 PM
This is great news. I have known several SEALs and I can attest to the fact that as a group they are some of the most honorable people I have ever known.
When I was in the navy (1980-1984) the Masters at Arms were the most abusive and power addicted people I have ever known. They once wanted to bust a friend of mine for smoking pot, which he did, but for some reason his urine samples never came back positive so eventually to set him up the MA’s went off base picked some grass and weeds put them in a plastic bag, made a copy of it and claimed at Captains Mast that they caught him with that bag of weed and lickily they made a copy of it because somehow they lost the actual bag of weed. He was of course found guilty and eventually drummed out of the Navy. So much for justice at a captains mast which is known as Non Judicial Punishment or NJP, we sailors always refered to it as No Justice Provided. LOL

Even among those who serve, the intent of this sort of show trial is to keep them from doing their jobs. SEALS brave death as an accepted part of their job, but they didn’t sign on for this kind of character lynching by people who are supposed to be on their own side.
And, regardless of the fact that the liberals and terrorists were not successful in adding physical torture to the character rape, in this case, as the liberals and terrorists are so very fond of saying: “Mission accomplished!”

Oh yes, as regards the master of arms that clearly lied about the three Seals, what we certainly have here is a “Fatso”, like the great actor Ernest Borgnine in the movie From Here To Eternity. This scumbag should be prosecuted and hounded to the ends of the earth! The entire naval police organization should be investigated, along with the ghastly NCIS! There is simply no end to the clear guilt of the naval police services!

Philly on May 6, 2010 at 8:46 PM
First of all, prosecutors do not bring a case but try the case after it has been brought to the court. So in that sense they were just doing their job. If there is someone to gripe about, it is the officers that pursued the court martial case without sufficient investigation to confirm that it was valid.

I have met Petty Officer McCabe – today one of the good guys WON. In response to the commenter who posted the letter about the Congress letting this happen and say nothing, this is not exactly true. These SEALS have received the support of several members of Congress. One of the most vocal supporters of the SEALS has been former SEAL and congressional candidate Scott Taylor, many of you may have seen him on Fox News discussing this case. He is running against a full slate of candidates and a major RINO getting the establishment backing. Notice, these others have been no where to be seen on this. Taylor is an Iraq war vet himself, so if you want to make sure this kind of non-sense ends, check out http://www.scotttaylorforcongress.com and consider helping a great candidate get elected to office.

Well as far as the Navy goes, if it were a shore duty, the different Commands on the base sent folks who weren’t really any good in their rate, TAD (TDY). Among the places these folks ended up in, SP was one of them.
However this guy Petty Officer 3rd Class Kevin Demartino, is an MA-3, MA means Master at Arms, the Navy version of a cop.
I’d bet money MA-3 Demartino is a brown nosing “Rent a Crow”.
DSchoen on May 6, 2010 at 10:12 PM
Also
Could someone please tell Fox news, Petty Officer 3rd Class Kevin Demartino is NOT a commissioned officer!
Petty Officer 3rd, PO3 is an E-4, like a Corporal
DSchoen on May 6, 2010 at 10:14 PM
In all likelihood his former CO most likely promoted him. The CO is just trying to cover his A$$ for a bad decision.
This is why I think MA-3 Demartino is a brown nosing “Rent a Crow”.
Rent a Crow’s make rank, not by passing all the test, but by brown nosing the senior enlisted, going before a senior board along with the command CO.
Most Sailors, btw do not respect rent a Crow’s.
Don’t know if the Army, Air Force has something similar to “Rent a Crow’s”.

At the end of the interview, after Matthew McCabe thanked everyone for all their support, and said that he now wants to “just move on and, and live a happy life,” I suspect Bret Baier spoke for every one of us with his response:
