NYT: GM, Treasury lied about bailout repayment

This article by Gretchen Morgenson in the New York Times is significant for two reasons.  First, the Times has decided to give this significant coverage, which means the story of GM’s misleading claim of paying back the taxpayer-funded bailout will continue to have some legs. More importantly, it also points the finger at Treasury and the Obama administration for its complicity in allowing CEO Ed Whitacre to make those claims without challenge:

AS we inch closer to a clearer understanding of the products and practices that unleashed the credit crisis of 2008, it’s becoming apparent that those seeking the whole truth are still outnumbered by those aiming to obscure it. This is the case not only on Wall Street but also in Washington.

Truth seekers the nation over, therefore, are indebted to Senator Charles E. Grassley, Republican of Iowa, who in recent days uncovered what he called a government-enabled “TARP money shuffle.” It relates to General Motors, which on April 21 paid the balance of its $6.7 billion loan under the Troubled Asset Relief Program.

G.M. trumpeted its escape from the program as evidence that it had turned the corner in its operations. “G.M. is able to repay the taxpayers in full, with interest, ahead of schedule, because more customers are buying vehicles like the Chevrolet Malibu and Buick LaCrosse,” boasted Edward E. Whitacre Jr., its chief executive.

G.M. also crowed about its loan repayment in a national television ad and the United States Treasury also marked the moment with a press release: “We are encouraged that G.M. has repaid its debt well ahead of schedule and confident that the company is on a strong path to viability,” said Timothy F. Geithner, the Treasury secretary.

Taxpayers are naturally eager for news about bailout repayments. But what neither G.M. nor the Treasury disclosed was that the company simply used other funds held by the Treasury to pay off its original loan.

Scott Johnson at Power Line wonders when the Most Transparent Administration EverTM will investigate this attempt to play a shell game with GM’s bailout and steal a little political capital:

GM’s fraudulent public relations blitz took place with the support of the Obama administration, up to and including Secretary of the Treasury Timothy Geithner. Geithner’s participation makes his tax cheating and related testimony pale in comparison.

In retrospect, it is obvious that GM undertook the blitz at the behest of the Obama administration. It is symptomatic of the era of national socialism in which we find ourselves, and for which GM is a leading indicator.

Scott makes a good point. This kind of misleading statement would be actionable under Sarbanes-Oxley had it been made as part of a disclosure statement. It might still yet be actionable if the SEC concluded that GM intended to mislead investors into buying GM shares the same way Whitacre wanted to encourage car buyers to come back to GM by falsely claiming that they had repaid taxpayers in full. However, that would mean that the SEC would have to investigate the role of the executive branch to which it belongs in the endorsement of Whitacre’s statement. Any investigation of this would have to originate in Congress, and they’re not likely to engage, either … at least not this year.

Too many in the GOP are buckling under when it comes to repealing Obamacare so the likelihood of them pursuing this is equally slim… unless we the voters constantly remind the GOP who they work for.

There’s got to be a way to both get a new Congress to repeal that unconstitutional disaster called “Obamacare” and hold those responsible for this shell game accountable.

Which is why the GOP must retake at least the House this year. And in the meantime, the conservative media cannot let this story die. What GM and the Treasury are engaging in is crony capitalism. How many more billions of our money are they gonna p-ss away before this company is finally forced to declare bankruptcy as it should’ve done over a year ago?

I worked in public relations at GM during my senior year in college in the 80s. People in senior pubic relations leadership at GM now are people I knew back then, either as fellow students or local practitioners, and some of them were close friends. They are leaders in the Detroit PRSA and student PRSSA chapters.

I am so embarrassed that they would be party to this kind of stunt. It’s shameful.

The Obama Administration was touting the alleged GM payback too. Gibbs was out there telling all who would listen to him, but none of the reporters at the daily press conferences seemed to care to challenge him (and we’ve known it was bunk since the day it was first announced).

Why is the NYT suddenly interested in the story? Further, why aren’t the editors the least bit interested in why the Obama Administration would lie/mislead the American public on this issue?

One of Ed’s most charming qualities is his graciousness in writing about those with whom he disagrees. As you all know, this is not a quality that I possess.

So let me be clear — Ed Whitacre, frontman/toady for the Obama Administration/UAW’s takeover of General Motors, did not just decide one day to announce that GM had “repaid” their bailout loans to the Treasury. This propaganda came straight from his government handlers in the Oval Office.

And anyone who doesn’t understand that is just kidding themselves. I am certain that Ed does understand that, and that he is, as I said, being characteristically gracious.

I won’t.

And it soon came out that they had no operating profit at all.

GM’s CEO has floated the idea of an IPO this year (if that is likely to happen is another debate). The government stands to benefit if the IPO is used to essentially sell the government equity to new stockholders. Who these investors would be is an open question, but Obama has proven there are plenty of rubes to be fooled. In this context one could argue that this PR campaign is an attempt to mislead potential IPO investors with the complicity of the government.

I said it the other day, there’s no way Whitacre/GM did this ad on their own. I’ve sat through countless auto ad meetings over the years and everybody’s acutely aware what you can and can’t say from a legal basis. Somebody in the federal government pressured GM to run this ad.

Remember when Pres. Bush suggested that a small percentage of peoples Social Security be put into investments and the Democrats went crazy? If I want to buy stock, I want to pick my purchases. I am not sure what’s going to happen to the NYT’s if they keep this up, will the administration finished them off before the public can catch on to real reporting? Geithner is like part of the Soetoro family, so he has job security. Timmy was the point man during the hand over of billions of taxpayer dollars to Obama’s mother in Indonesia back in the 90s, and Timmy’s brother served with Obama’s mother at the Ford Foundation. That money probably secured open markets for Ford plants in Indonesia, so it was kind of like Ford’s bailout.

Too bad we don’t have a media to look into all this.

Reasons to quash the story: it embarasses the Administration and runs counter to The Narrative, it supports claims made by the Right. Reasons to print it: it’s true (ha!), it embarasses an American corporation (albeit one now run by the UAW), it makes it look like the Bag Lady is developing some spine.

These don’t balance. Something’s at work that we don’t see here. Could it be that Sulzberger has finally realized that he has to do SOMETHING to remain credible besides running pretty ads on cable TV?

Had one of those moments, thinking about this scandal – realizing just how neglectful the Old Media has been in covering this story, even Fox. Maybe I’ve missed it. But Jees, this is such an outrageous, blatant lie, involving taxpayer money. And none of them touched it – not Tapper, not Fox. No one but the blogs. As if the Old Media was not already dying the slow death. The people who get their news only from newspapers and nightly news are slowly dying off as well. That sounds harsh, but it’s true. You would think the powers that be would catch a clue, wanting to stay in existence, make money. My faith in them is nil.

Something a newly elected Republican majority will have that the previous majority didn’t was The Tea Party Movement. They/we provide cover that courageous politicians need to enact Government reform legislation. We need to provide cover and support for those who earn it, and condemnation of those that don’t.

It may be that there are only two options, to mention one is to be subject to HA’s TOU, the other is to Go Galt. Without significant reversal of our ship of state by ’12, I am meeting with atty’s already in preparation of the latter and taking whatever I can escape with abroad.

Unfortunately it seems that tucked into the “Jobs Bill” passed last March there are considerable provisions in it making doing so more difficult. Those provisios are about halfway down here;

Me neither. But the operative phrase here is, “if I can help it”. I have a hunch that when GM sales tank, gubmit will make it almost impossible to buy anything but its own cars.

a friend of mine is taking bets on us being stuck with “The One” for 2 terms.He thinks he will cheat his way in again.I ask him “how will he get thru the debates?”He doesn,t think it will matter.I would love to get in on that for a $100 for a no he won,t..but i so broke i can,t pay attention ;(

It seems to me that there is a third reason. This story is late and incomplete, but it and some others in the last several months seems to indicate that the NYT may be trying to become a half decent paper. clearly the publisher recognizes that they have lost a large fraction of their readers because of their bias.

If GM was still spewing red ink, they would not have repaid anything.

If you are a financial analyst, you understand the difference between a working capital contingency line and the loan which was repaid.

This transaction would be perceived as being predicated on positive operational results.

And Toyotas have price reductions and low financing. I’m a gonna get one and invest the savings in a good term life insurance policy.
