NY lawmaker to force New Yorkers to become organ donors?

I received several tips about this in my inbox. I didn’t believe it could be as bad as it sounded, but yes, of course it is. A New York state assemblyman wants to end the long waiting lists for organ donations in New York by forcibly enrolling all New Yorkers as donors… unless they opt out.
Organ donation has become a vital way to save lives around the world, but a vast shortage of donors continues to mean people are losing their lives while on waiting lists.
But there is a unique proposal that could change all that.
New York State Assemblyman Richard Brodsky nearly lost his daughter, Willie, at 4 years old when she needed a kidney transplant, and again 10 years later when her second kidney failed.
“We have 10,000 New Yorkers on the list today waiting for organs. We import half the organs we transplant. It is an unacceptable failed system,” Brodsky said.
To fix that, Brodsky introduced a new bill in Albany that would enroll all New Yorkers as an organ donor, unless they actually opt out of organ donation. It would be the first law of its kind in the United States.
“Overseas, 24 nations have it. Israel has it. Others have it. And it works without a lot of controversy,” Brodsky said.
Currently one of the biggest obstacles to being a donor is while 9 out of 10 are favorable to it only 1 out of 10 is signed up to be a donor.
Not many people would argue that being an organ donor is necessarily a bad thing. That doesn’t mean that any of those people should be forcibly made an organ donor. Yes, this law apparently will let people opt out. But are all New Yorkers going to be notified first? Will they have a fair chance to opt out, or is this going to be done quietly, so that as few people as possible notice that it’s happened? And what happens if too many people opt out? Will they remove the ability to opt out?
This is just a horrible idea all around. There’s too many questions, and it seems like too much of a slippery slope. While I can understand Mr. Brodsky’s reasons for wanting to do this, it still is wrong. The state does not own our bodies. They belong to us. (I know, it seems like an obvious concept, but look who’s governing our country right now. Apparently it’s not all that obvious.) And if someone doesn’t want to be an organ donor — either for religious reasons, for personal reasons, or because they just don’t want to for no reason at all — then that is their right.
And there’s more to worry about with this bill. Just a few days ago, Peter Orszag confirmed that Obamacare would impose rationing. Sarah Palin’s warnings about the so-called death panels were true. How long will it take for these death panels to make decisions based on the waiting lists for organ donations? Let’s say you’re fighting cancer. It’s advanced, but there’s still a chance you could beat it with aggressive but expensive treatment. Now, be honest. Would it be completely out of the realm of possibility that your treatment would be denied so that your organs could be harvested?
I know, it sounds far-fetched. And this forced organ donation is only taking place in New York… for right now, anyways. What if Democrats in Congress think that this is just a great idea? Would you really put it past them? I know I wouldn’t. If they did, the aforementioned scenario is not that unbelievable. Slippery slopes exist, my friends. It may start off as a well-intentioned state program in New York, but who says that’s where it will end?
Richard Brodsky is currently running for New York Attorney General. He is a typical liberal Democrat who thinks that everything belongs to the government — apparently even your body. Politicians who think this way are dangerous, and hopefully, Richard Brodsky will find himself without a job come November.

I’m all for trying to increase the number of organ donors, but this is stupid. I believe Europe presumes a deceased person’s organs are available, absent some kind of formal indication to the contrary by the decedent prior to death or the family at the time of death. It hasn’t made a significant dent in the donation rate.

My wife s a nurse. She watched a training video put out by the organ donor people. She said it was revolting.
The video stressed the importance of organ donation in the most creepiest of ways. She said it was the oddest video she had ever seen.
During a segment, it showed about 9 different doctors standing around a dying patient, scalpels in hand, waiting for the moment he flat lined. The moment the buzzer sounded, they all began quietly cutting at the same instant. It was disgusting.
I no longer am an organ donor.

In fact, this is one of the issues where I have to say…. the conservative “free-market” type principles may be the best way to solve the problem. Perhaps we should go beyond altruism and offer payment.
What if instead of presuming donation, we asked people to make a choice when they registered for their driver’s license or something? And if they choose to be organ donors, we could offer payment. Or health insurance companies could be the buyers and there could be a centraized clearing system to match donors and recipients. Compensation could be in the form of reduced health insurance premiums.
Any other ideas?

Hell, the current Congress would sign ALL OF US up under the “commerce clause”. Just think, AN EXCESS OF DONORS; ergo, the government could SELL excess organs overseas and rake in MONEY to spend on other “promote the general welfare” ideas.

Equipment to say he is brain dead. Send him to a bigger hospital. They did. They met us at the new hospital with a sheaf of organ donor pamphlets and forms to sign. We waited to talk to the new doctors first.

My father in law was a firefighter/EMT for 30 years. He flat out told me that hospitals treat organ donors differently than nondonors and do less to save organ donors. He refuses to be a donor and tells everyone he knows to do the same.

I’m consistantly amazed at how wrong headed people can be, in what reality is this not an excellent idea.
The dead do not need organs, the living however do. Millions of people are currently languishing on transplant lists when the solutiion is so blatantly obvious.
Ofcourse the hospital should assume unless informed otherwise that you wish to donate your organs because after all what kind of a person would you be if your last act in life was to deny another human being a chance to live.
We need to put politics aside here, this is about human life not Obama, not democrats, this is about the men, women and CHILDREN waiting and hoping for an organ that may never come.
My last thought, how many of you aginst this would feel differently if it were your child, your mother, your brother waiting for second chance at life.

Nope. They removed what the surgeon said was “The biggest popcorn seed I have EVER seen.” So no popping sound. He has always had a very deep voice since then, from having a respirator tube in his throat.
And of course perfectly fine is a relative term. He is 15.
Nothing wrong with his vision though. I was watching the news one day and Nancy Pelosi was talking and he said, “Who is THAT?” I said, “She’s the Speaker of the House.” He said. “The House of Representatives? or the House of Horrors?” I said, “Take your pick.”

God bless that doctor, is right. He was from South Africa and he told us he had seen to many small children bounce back from serious accidents not to be cautious. He has moved to another town but not a day goes by but that I am thankful he was here that day. I am so glad that we waited to see our son before we signed any paperwork. We would have signed because of course we would have wanted to save someone and bring joy to another child from our grief.
I am sure that Vera’s uncle is right. There is no doubt in my mind they wouldn’t have tried as hard to save him if we would have signed.

The cornerstone of civilization is the right to property. The source of all property rights is the ownership of ones self. You take away this right – or even hint at taking away this right – then it’s goodbye civilization.
It does not matter that people have the “right” to opt out. You should not have to register your most basic human right of ownership of your own body with the state. By making everyone donors by default, the assumption is that the state owns your body by default. Why should you have to sign any god damn thing to forbid the state to dispose of your most sacred property in a way you disapprove of?
I’m sorry but I’m disgusted by those of you who think this is an excellent idea “because the sick need organs.” There is and always will be some “pressing need” with which to justify the abrogation of the basic rights of liberty. I’m sick of this whole “principles be damned” attitude – far too many of today’s so-called conservatives are willing to set aside the most important principles of civilization out of some misplaced urge to be pragmatic and “caring” on the range of the moment. We all know where the road to serfdom leads. The commies have given up on the idea of flying us there direct – it’s all about imperceptible changes, brick by brick, one grain of freedom at a time. The more principles we carelessly discard, the more future generations will be willing to give up too. We’re already at the point where huge swathes of the population have completely forgotten what individual liberty means and how fragile it is.
The inevitable conclusion of statism is the wholesale slaughter of hundreds of millions of innocent souls. Observe history. We have to keep the state at bay. And that does not involve a process of give and take. Because if we give them an inch they’ll take a mile. We know that. Little things like this may only represent fractions of inches but before you know it we’ve given them that inch in full.
I don’t care if I sound like a drama queen. There is a basic principle at stake here. Pragmatists don’t care about principles because they don’t see the importance of them. If the state owns your organs by default (in order to save lives) then why not let it own every cent you have by default (in order to save lives)? If you die prematurely without having left a will, should the state claim your savings for the purposes of redistribution to the poor?

But I don’t think ANYONE has the right to decide where somebody’s organs go, by fiat. Certainly not the state. Cripes look what they have done to education. If medical organizations ponied up some cash to organ donors while still alive (kind of like a reverse mortgage) and have them sign an irreversable contract, it wouldn’t take long before the body parts would coming flying in.

OMG, some of you people are so totally clueless! It’s not your fault. Organ donation is something that’s whispered about in corners. I am completely against this idea…..organ donation should be completely voluntary. But, the issue of organ donation needs to be discussed openly and realistically BEFORE a person is declared brain dead. The family of the potential donor is in NO position to make that kind of decision in a hospital setting. People need to discuss this with their family.
Organ donation agencies need to get the word out about donation to dispell some of the myths people perpetuate about the program…..as some of the people on this thread have done. Doctors do not let people die so they can harvest organs. An injured person is just as important to a doctor as the person on the waiting list. Also, MOST people who die end up being excuded as donors because of their age, health or the circumstances of their death.
This is a BAD law. But organ donation is not a BAD thing.

Firefighter/EMT’s are present at the exact moment most of these decisions are made. The care a patient receives during transport/immediately upon arrival to a hospital is somewhat dependent upon if they are an organ donor or not. Some of this might even be subconscious, but it happens. Maybe not in every city or every hospital, but he worked in big cities and small, and he had the same warning.
It’s not that he’s against organ donation in general, just claiming to be one on your driver’s license.

Paying cash to the families of organ donors would require a complete overhall of the transplant system, which works pretty darn well under the circumstances. It would also open the door for fraud and pay-offs, which would hurt the sickest people. Also, there are certain organs that can be donated by a live donor…..do we really want people selling their kidney to pay the electric bill?
One more thing……the doctor taking care of the brain dead car accident victim in the trauma unit probably doesn’t even know the doctors and surgeons in the transplant unit. The doctor from trauma does not perform the transplant surgery, unless you’re watching the moooovies.

What will happen under Obamacare is that a bureaucratic panel will decide who will get my organs. Translation: If you’re white and male you have as much chance of getting an organ as Henry Waxman has of looking like Tyrone Power.
If you’re anything else other than white and male-white and female go to the back of the line along with anyone over 55, and misc. others who A. show up on the voter registries as having not voted for Obama, B. are against illegal aliens usurping our country, C ever attended a “Tea Party” D annoyed the IRS by using perfectly legal but revenue-costing tax loopholes, ad infinitum.
And, of course, New York State would be a perfect microcosm of the entire nation reflecting exactly Obama’s views.
THERE IS NO WAY RAHM EMMANUEL OR ANY OTHER LIBERAL SOCIALIST IS EVER GOING TO GET MY LIVER, MY KIDNEY, OR ANY OTHER ORGAN. .Let’s face it folks, that’s what the liberals are after when they attempt to force people to give up their organs. It actually fits in with the death panels killing people of younger age so there will be more organs available for liberal politicians.
The next phases, supplanting abortion, is to harvest a crop of non-liberals to be involuntary organ donors. When these people are “ripe” the liberal in need merely needs to choose the healthier-looking ones out of a crowd.

Cash for organs does several things:
exploits the poor, discourages altruistic giving, commercializes the body, and undercuts human dignity. Bringing money into the argument invariably leads to coercion. The WHO is against commercialization of organs and tissues.

Lily, I do not agree with the NY moron at all. It should be a choice. Just gets my hackles up when people spread rumors. No one is going to frame my liver in the Louvre, but my skin could help a burn victim heal, an working on my body could help many medical students.

And another thing…….this lawmaker, or whatever you want to call him, doesn’t know squat about how available organs are allocated. An organ procured in NY doesn’t necessarily go to a person in NY. Sooooooo, this won’t really do much to help the people from NY who are in need.

I’m sorry, but you are mistaken. Medics and EMT’s are not present when the decision is made. They are there for the initial trauma, they give their report, assist if needed and then they leave to ready the ambulance for the next call. The decision isn’t made until the family arrives and a definitive conclusion of brain death has been made.

Speed, you seem to be missing my point. I’m not suggesting that they outright kill someone the moment they see that they are an organ donor, but rather that it influences decisions made about treatment.
Again, this might not happen in every hosptial or every situation. I suspect that it is largely subconcious, but it does happen. Maybe you’re comfortable with that possibility, but I’m not.
I’m even less comfortable with those same issues being applied to everyone if this measure were to pass.
